Convicted murderer fails to overturn sentence of minimum of 15 years


Webber, a patched member of the Nomads gang, stabbed Heappey to death on December 8, 2018 over a perceived debt and for failing to “collect his punishment” from the gang.
It is not unusual for a convicted murderer to be sentenced to life imprisonment, but in Webber’s case there were aggravating circumstances to be considered.
At the time of the sentencing, Webber had already been sentenced for four different strike offences, receiving strike warnings for two of them.
A strike offence is a serious offence identified by law as “strikeable”, meaning it is subject to the three strikes law. The three strikes law was introduced to increase penalties for repeat offenders of serious violent and sexual crimes.

An aspiring Nomads gang member has been jailed for more than five years over the killing of a gang associate who was "due a hiding".
Justin Richard Burke, 33, had denied killing Shayne George Heappey, 25, during a brutal attack where he was stabbed and cut 14 times in December 2018.

But after a two-week trial at the High Court in Christchurch last November where he was cleared of murder, a jury found Burke guilty on a charge of manslaughter.

A Christchurch man has been jailed for his role in a fatal stabbing he had hoped would be his ticket to becoming a patched member of the Nomads gang.
Justin Richard Burke, 32, was sentenced at the High Court in Christchurch on Wednesday to five years and two months’ imprisonment.
In November, Burke was convicted for manslaughter for his role in the death of Shayne George Heappey at a house in Russley, Christchurch, on December 8, 2018.
