In a romantic relationship with a subordinate. that could be an ethical issue that could cause her problems with disciplinary authorities. that s a management problem within her office. what it is not is a conflict of interest as to the defendants. judge mcafee immediate that finding. the theory is because they were traveling together, they were comingling funds, and so by paying nathan wade for his work on this case it was somehow to the benefit of fani willis. the judge heard all of that testimony and found there was no conflict, she wasn t bringing this case just so she could profit financially from it and made those factual findings. the idea that the case must stop so that the court can review that is really, i think, a miscarriage of justice. there is no conflict between fani willis and the defendants. there is nothing about her relationship that suggests that the defendants are more or likely guilty or not guilty. ....

Nbc s lisa rubin is following this story for us. so why did a georgia court of appeals halt this case and what does it mean for the timing? reporter: so, chris, the georgia court of appeals halted the case because that is their standard practice where there is a criminal appeal, it is typical for them to halt all proceedings, but i should note for you that they have halted all proceedings only with respect to a certain group of defendants who are appealing judge mcafee s ruling with respect to fani willis staying on the case. the case continues with respect to a number of others, but where it comes to a trial before election day, it is almost a complete certainty that that won t happen. argument is not scheduled until october, chris, and so this is one more case that our viewers can count on not happening before november. lisa rubin, thank you. we go to long island now where two new murder charges have just been brought against the suspect accused in the gilgo beach serial killin ....

so what s going on? i think it s obnoxious overreach before i court of appeals in georgia. the stay of proceedings is not unusual, the cessation of the proceedings while they re trying to hammer out this issue, though there s a wrinkle that i haven t brought up. the appeal was taken by not all of the defendants. so judge mcafee could theory receiptically move forward with the defendants that are not part of the appeal. just those defendants that appealed his decision, they appealed, and my opinion, the way i would read it is their cases stayed, but the other defendants that never objected to the judge s decision, their cases should keep going. they should push it, why not? the state is not ready, of course. i wonder if they would fold if they got pushed into a trial with the other defendants. ....
