SC can't strike down 24-day detention under anti-terror law —OSG

Government lawyers on Tuesday said the Supreme Court (SC) could not strike down a provision in the anti-terror law that allows authorities to detain a suspected terrorist for up to 24 days because it is a policy determined by Congress.
During the continuation of oral arguments on the petitions assailing the law’s constitutionality, Associate Justice Rodil Zalameda inquired into the Congress’ decision to set the detention period at 14 days, which may be extended by a maximum of 10 days.
This period of detention is longer than prescribed by Article 125 of the Revised Penal Code, which requires law enforcement personnel to bring a crime suspect before the proper judicial authorities within 12 to 36 hours depending on the offense’s severity. ....
