Because this was a board requirement, dpw doesnt have the done wave that condition. In some cases if a developer is not required to plant a required tree, we look at alternatives like additional landscaping to mitigating the loss of that tree. That is something that is available to us. What we are here is to get guidance from the board to pursue this. Frankly i do think there is a dispute about what can be planted.
