LG Electronics QNED Mini LED TV unveiled in December / Courtesy of LG ElectronicsBoth Samsung and LG have failed to register QNED as trademarks with the U.S. authority, documents showed Sunday.
The U.S. Patent and Trademark Office (USPTO) on Feb. 25 notified Samsung Display that its registration for QNED was refused because the mark merely describes an important feature and characteristic of the applicant s goods. Samsung s display manufacturing unit applied for the trademark in September of last year.
QNED stands for quantum nano-emitting diode and is considered to be the next-generation display technology. ....

The Trademark Modernization Act of 2020 offers foreign brand owners new tools to remove problematic marks from the US register, but it could also pose challenges, explain Brett Heavner and Yinfei Wu of Finnegan.
On December 27, 2020, then US President Donald Trump signed the Trademark Modernization Act (TMA) into law. While the TMA can benefit foreign brand owners with its new rules and proceedings, it may also present them with challenges.
One of the TMA’s principal goals is to reduce the number of spurious trademark registrations and applications that are based on inaccurate claims of use in US commerce.  ....

Senators unveil bill to close patent gap faced by women

Proposed legislation aimed at closing the gap that women and minorities face when procuring patent rights could direct the United States Patent and Trademark Office (USPTO) to collect demographic data from applicants and make this public.
US Senators Thom Tillis, Mazie Hirono and US representatives Nydia Velázquez and Steve Stivers introduced the Inventor Diversity for Economic Advancement (IDEA) Act of 2021 on March 9.
The IDEA Act is cosponsored by Senators Chris Coons and Patrick Leahy. The same coalition of senators and US representatives first unveiled the IDEA Act in 2019. ....

AI security commission lambasts US 'failure' over IP

The National Security Commission on Artificial Intelligence (NSCAI) has criticised the US government for failing to recognise IP policy as a national priority and lagging behind China in protecting key technologies.
In the latest NSCAI report on the AI market, the commission dedicates an entire chapter to the importance of reforming the country’s IP. Citing China’s continued “leverage and exploiting” of IP policies, NSCAI calls for ‘comprehensive’ IP policy reform surrounding AI to ensure the US leads the sector.
“The US has failed to similarly recognise the importance of IP in securing its own national security, economic interests, and technology competitiveness. The US has not developed comprehensive IP policies to incentivise investments in and protect the creation of AI and other emerging technologies,” said the report. ....
