Arthrex filed its reply brief on February 19
th, submitting what will be the final word in the case until oral arguments are presented next week. In its reply, Arthrex seeks to shore up its own arguments while rebutting the arguments made by Smith & Nephew and the United States in their individual replies.

Arthrex cases (docketed as 19-1434), ask the Court to determine whether administrative patent judges (APJs) are principal or inferior officers and, if they are principal officers, what remedy should be employed to bring their appointments into compliance with the Appointments Clause of the Constitution. Currently, APJs are appointed by the Secretary of Commerce, and are assigned to panels as designated by, and otherwise supervised by, the Director of the USPTO.  The United States and Smith & Nephew have argued that APJs are inferior officers because they are supervised “at some level.” Because AP ....

The US Patent and Trademark Office (USPTO) has urged a federal court to uphold its finding that patents cannot cover inventions by artificial intelligence (AI), and dismiss a suit challenging its position.
In August, physicist Stephen Thaler sued the USPTO in a challenge to the office s rejection of patent applications for inventions created by ‘creativity machine’ “Dabus”.
The office submitted the 24 page summary motion at the US District Court for the Eastern District of Virginia yesterday, 24 February, defending its April finding when it confirmed that an AI can’t be named as an inventor on a patent application. ....

Hirshfeld, the Federal Circuit upheld the USPTO’s determination that a Patent Term Adjustment (PTA) award for “C” delay is not available when an examiner reopens prosecution after an Appeal Brief is filed, because an award for “C” delay requires actual appellate review. The court warned of the consequences of filing a Request for Continued Examination (RCE) early in the examination process instead of pursuing an appeal right away, because that prevented an award for “B” delay over the time periods at issue. While not at issue in this case, patent holders may be wondering when the USPTO will start calculating PTA correctly under the 2019  ....

Peloton launches legal battle over "Spinning" trademark

Exercise bike manufacturer Peloton has filed a petition to cancel a rival’s trademark of “Spinning”, claiming it is abusively enforcing the mark.
Peloton claimed that rival fitness company Mad Dogg Athletics is “abusively enforcing” its trademark rights of ‘Spinning’ and ‘Spin’ across the indoor biking industry in a petition filed to the US Patent and Trademark Office’s Trademark Trial and Appeal Board (USPTO) yesterday.
The petition argued that the terms are generic and that Mad Dogg’s lawyers have been ceaseless in their campaign to chase down infringers. It also cites John Baudhuin, co-founder of Mad Dogg, admitting to spending “hundreds of thousands of dollars a year” on litigation. ....

‘Extend patent bar to design practitioners’, say academics

The US Patent and Trademark Office has been urged to extend patent bar eligibility to design patent practitioners to increase the number of women patent attorneys and inventors.
This latest development comes after former USPTO director Andrei Iancu wrote to senators last month outlining policy changes under consideration by the office after senators expressed concern over a lack of women patent attorneys.
Issued on February 8, the letter held that the proposed change would help diversify the patent bar and would also remove barriers to women in patenting.
