Tampa Bay man released from life sentence, set free pending review
Freed from a life sentence for a murder he committed when he was 16, recent court rulings put Kyle Moran’s liberty in jeopardy.
 
 
TAMPA — Kyle Moran will not need to return to jail, at least for now.
Weeks after an appeals court decision overturned a judge’s ruling that set Moran free from a life sentence for murder, prosecutors and defense attorneys have agreed that he has served enough time to qualify for a 25-year review of his sentence.
In a brief court hearing Thursday morning, Hillsborough Circuit Judge Kimberly Fernandez affirmed that Moran can remain free on probation pending that review. The next hearing in the case is set for August. ....

He was sentenced to life in prison at 16 after shooting a man during an attempted armed robbery. In 2018 the U.S. Supreme Court found it unconstitutional for juveniles to face life sentences so Moran was released after serving 24 years in prison, but the state recently appealed, saying his re-sentencing was unconstitutional. Driving Miss Daisy was in the theaters, the Berlin Wall was coming down, and phones still had cords when Talmedge Hayes disappeared from the world. 
Just a teenager in the late ’80s, the fatherless youth had fallen in with criminals in his Tampa, Fla., housing project and was arrested for armed robbery. The sentence was severe: life without parole.
Hayes was one of many black teens discarded by the system, abandoned forever to prison, for a crime that might have gotten a white defendant a more lenient sentence. He could have let incarceration consume him and become just another bitter, violent inmate, racked with despair. Instead he chose a different path, one of self improvement and hope. He decided to learn a trade.  ....
