New Jerseyans voted two-to-one in November to legalize recreational cannabis for people 21 and over. The constitutional amendment was supposed to take effect January 1. So, is it okay to light up?
“Right now – no,” said Captain Keith Kimkowski of the Vernon Township Police Department. “We have to wait for the legislation to come out. We’re waiting for guidance because it’s going against how we’ve been policing for years.”
The passage of a pair of bills – one to legalize and establish an adult-use marijuana industry, the other to decriminalize up to six ounces of possession – will make New Jersey the first state in the mid-Atlantic where recreational marijuana will be sold and taxed, similar to alcohol. But as of this writing, those bills are now three weeks overdue, as lawmakers duke it out with the governor over thorny questions like penalties for underage marijuana use. ....

NJ legal weed bill would lower penalties for underage marijuana users

TRENTON - For the second time in less than a month, New Jersey legislators advanced changes that are expected to be the last hold-up in legalizing weed in the Garden State. 
The Senate Judiciary and Assembly Appropriations committees on Thursday advanced a clean-up bill that makes minor changes to the Legislature s already approved legislative package to legalize marijuana.
The main thrust of the measure changes penalties for underage marijuana users who are found in possession of the drug. 
Under the newest proposed changes, anyone between 18 and 21 years old would be subject to a $50 to $250 fine if they possess 6 ounces or less of marijuana, the legal threshold for adults over 21 years old. Possession of over 6 ounces would come with a maximum fine of $100 to $500.  ....

NJ legal weed: Changes for underage marijuana use


TRENTON - The governor’s office and Senate leaders are nearing an agreement that would remove criminal charges associated with underage marijuana possession and use, a deal that all sides hope will be the last one required before Gov. Phil Murphy signs the bills to legalize weed in New Jersey.
While negotiations are continuing, legislative sources said Monday that a deal appears likely to remove all penalties for minors under 18 years old found in possession of marijuana and levy fines on those between 18 and 21 years old, instead of bringing forth  criminal charges.
Cases involving minors would be handled by local police departments and the child’s family, the sources said. Underage users between 18 and 21 years old would be subject to civil penalties of $250 to $500 depending on the amount of marijuana. Details of the negotiations were first reported by Politico New Jersey. ....

New Jersey law enforcement officials are opposing a plan to release hundreds of people from jail who are awaiting trial, dimming the chances that the state’s top court will fast-track a mass release as the pandemic continues to delay new juries.
Anyone who can safely await trial at home has already been released, the state attorney general’s office and the county prosecutors association argued in court documents filed Wednesday. Letting more out would be both dangerous and illegal, they said. ....
