How one word is preventing the Sinixt people from recognition in Canada


It may come as a shock to many that a people can be declared extinct in Canada. But this is precisely what happened to the Arrow Lakes people who, rejecting this colonial name, refer to themselves as the Sinixt. In 1956, an order-in-council was passed by the government of Canada declaring the Arrow Lakes Band to be extinct under the Indian Act.
The international border between Canada and the United States partitions the traditional territory of the Sinixt, most of which lies in the southeast interior of British Columbia with only a small percentage of their land in Washington state on the American side. After first contact with European settlers in 1811, the Sinixt were gradually dispossessed of their land, pushed south of the international border and forced to seek refuge in the U.S. They were amalgamated by the U.S. government with 10 other tribes and settled on the Colville Confederated Tribes reservation. Tribes can hunt on ancestral lands north of U.S. border, Canada says

The United States and Canada closed their shared border to “nonessential travel” on March 21, 2020, to curb the spread of COVID-19. Spring turned to summer and then fall, and the closure was extended; it was the first time in a long time that Rick Desautel, a member of the Arrow Lakes Band and a descendant of Sinixt First Nation, did not drive north across the border from his home on the Colville Reservation in Washington to hunt in his tribe’s ancestral lands. 
Desautel’s right and by extension, the right of any tribal member of the Arrow Lakes Band to hunt those lands has been the focus of litigation that began after a strategic elk hunt by Desautel a decade ago in 2010, at the direction of the Colville Tribal Council. He hunted without a license, and then he turned himself in to the Canadian game wardens. You may have seen the headlines.  A recent Canadian Supreme Court ruling affirmed the Aboriginal Rights of “extinct” Sinixt living in Washington state. 
There is a considerable amount of confusion around Sinixt “extinction.” While the landmark ruling in the Desautel case is certainly a cause for celebration, Sinixt are still extinct in the same way they were before this case. 
Rooted in the Kootenay region of British Columbia, the Arrow Lakes Band (Sinixt) were declared “extinct for purposes of the Indian Act” in 1956. The Canadian government’s stated position since 1995 is that Sinixt people do “exist as a tribal group” in Canada. However, the lack of engagement and consultation by the government with Sinixt Peoples in Canada indicates otherwise. ....
