May 1 When a young Joseph W. Hatchett took the Florida Bar exam in 1960, he could not stay in the Miami hotel in which the test was given because of Jim Crow regulations.
Within 15 years, Hatchett would become the first African American to serve on the Florida Supreme Court.
Former Florida Supreme Court Justice Hatchett died in Tallahassee on Friday, April 30, Florida Supreme Court spokesman Craig Waters said in a post Saturday morning. Hatchett was 88 and Florida s 65th justice since statehood was granted in 1845. ....

What Does The ICWA Ruling Mean For The Mountain West? For Now, Not Much


 
The Indian Child Welfare Act still stands, with some of its key provisions weakened by a sharply divided U.S. Fifth Circuit Court of Appeals this month. The 325-page opinion has no immediate impact on child welfare cases in the Mountain West, but it s likely to be challenged in the U.S. Supreme Court.
Since 1978, ICWA has required that tribal nations have a voice in adoption, foster care and custody proceedings involving their youngest citizens. The federal law was intended to reverse a long legacy of federal and state agencies forcibly removing Indigenous children from their families and communities.
Initially filed in 2017, the lawsuit - Brackeen v. Bernhardt then, Brackeen v. Haaland now - took aim at ICWA s constitutionality, arguing that its preference for placing Indigenous children in Indigenous adoptive and foster homes violated the equal protection clause. Thirty tribal governments in the Mountain West and the states of Colorado, Utah, Montana and Idaho ....

AUSTIN – How many attorneys does it take to elect a bar president? While that may sound like the opening to a bad joke, it’s actually the focus of House Bill 2393.
Currently, the number of Texas Bar members required to support a petition to run for president is 5 percent, which means a candidate must collect roughly 5,000 physical signatures from his or her fellow attorneys to appear on the ballot. 
Authored by state Rep. Yvonne Davis, HB 2393 would reduce that number to 500 and allow for electronic signatures on petitions – opening the field for more candidates, especially minorities, to run.
The Judiciary & Civil Jurisprudence Committee heard the bill last Wednesday. ....
