Top Military Court Considers Challenge to DoD's Authority to Court-Martial Some Retirees

The Court of Appeals for the Armed Forces, or CAAF, heard arguments March 9 in the case of a retired Navy sailor who is challenging the constitutionality of his conviction by court-martial after he left military service.
Attorneys for retired Chief Petty Officer Stephen Begani say the current laws are flawed because they treat retired members of the active and reserve forces differently when it comes to recalling them for court-martial, and Congress overstepped its authority in making active-duty retirees subject to court-martial.
The government has argued that the military proceedings were fair because Begani, as a member of the Naval Fleet Reserve, which includes enlisted Navy retirees who leave active service after 20 years but under 30 years and receive retainer pay rather than retired pay, was subject to recall to military service in a national emergency. ....

NORFOLK, Va. - Kimberly Cedar didn’t meet a female chief petty officer until she had been in the Navy for seven years. 
Now serving as Reserve Force Career Counselor at Commander, Navy Reserve Forces Command (CNRFC), Master Chief Navy Counselor Kimberly Cedar is responsible for training and mentoring all 250 career counselors across the Reserve force, while simultaneously serving as an inspiration to women at every leadership level. 
“The Navy has changed in so many ways,” said Cedar, who joined in 1994. “We had the first two women in the nuclear program in my bootcamp company. I didn’t realize how significant that was until several years later. It was a lot different in the ‘90’s, and it is great to see women are making up a larger percentage in our military ranks.”  ....

The commanding officer of a Navy reserve center was fired this week after his superiors lost confidence in his ability to command, according to a service release.
Capt. Scott Moss was relieved as head of the Navy Operational Support Center in Knoxville, Tennessee, on Wednesday.
While the details behind Moss’ firing were not disclosed, Navy Reserve Forces spokesman Cmdr. Ben Tisdale said it came about following a command investigation that was sparked by an Inspector General complaint. ....
