Arbitration can't decide whether PAGA case goes to arbitration, Calif. court rules

LOS ANGELES (Legal Newsline) – Plaintiffs using California’s Private Attorneys General Act to sue their employers can’t be sent to arbitration to decide if the case will go to arbitration, a California appeals court recently ruled.
On March 1, the Second Appellate District ruled against Zum Services, which is accused of misclassifying the plaintiffs and others as independent contractors. The company, a transportation service for children, tried to invoke an arbitration clause in their employment agreements, but the appeals court overturned a trial court ruling for Zum.
Letting an arbitrator decide whether the plaintiffs are “aggrieved employees” entitled to make PAGA claims goes against the purpose of the PAGA, the court ruled. ....

Public intoxication arrest of disoriented man turns into $6.3 million verdict against San Diego County

SAN DIEGO (Legal Newsline) - A California appeals court recently affirmed a $6.3 million verdict against San Diego County in the case of a man who suffered permanent brain damage after sheriffs’ deputies waved off paramedics and took him to jail for public intoxication.
After being arrested for falling into a planter on a street in Encinitas in December 2016, David Collins became increasingly disoriented and ultimately was transported to a hospital where he was diagnosed with hyponatremia, or severely low sodium and a brain bleed. He claimed permanent brain damage and disability and a jury awarded him $12 million in damages, which the trial judge cut in half to comply with California law. ....

Auto loan company must face lawsuit in open court; Arbitration clause doesn't pass test

SANTA ANA, Calif. (Legal Newsline) – A California auto title loan company faces claims its interest rates are unconscionable, and a California appeals court has just ruled that the arbitration clause in its contracts is.
The Fourth Appellate District ruled Jan. 11 for lead plaintiff Joe Maldonado and his lawyers at Cohelan Khoury and Mesriani Law Group who are pursuing a class action against Fast Auto Loans in Orange County Superior Court.
The 2019 lawsuit says Fast Auto Loans’ terms are illegal under the Unfair Competition Law and the Consumers Legal Remedies Act.
In addition to business registration issues, Fast Auto Loans is accused of offering loans that are basically interest-only and exceed the value of the cars put up as collateral. ....

Calif. court approves attorneys fees 8x more than client recovered

LOS ANGELES (Legal Newsline) – A Lemon Law defendant will have to pay almost $170,000 to plaintiffs attorney despite the client only recovering $22,000.
The California Second Appellate District on Jan. 29 approved the windfall for attorneys at Rosner, Barry & Babbit in a lawsuit against HNL Automotive, which is accused of selling a defective “Certified Pre-Owned” 2015 Nissan Altima, and TD Auto Finance.
Though it was advertised as having cruise control and power-adjustable seats, plaintiff Tania Pulliam, who is disabled and relies on those features, said it did not. She sued the company in 2016, two months after buying it.
A jury in 2018 returned a verdict in favor of Pulliam on only one of her four causes of action – violation of the implied warranty of merchantability under the Song-Beverly Consumer Warranty Act. ....

Garcia v. Haralambos Beverage Co., the California Court of Appeal embraced the adage “time kills all deals” to conclude that an employer waived its right to arbitrate the wage-hour claims at issue in the case by, among other things, delaying two years to seek arbitration as a last resort and waiting to locate the plaintiffs’ signed arbitration agreements.  By waiving its right to arbitrate, the employer also lost its ability to strike class claims as a result.

Garcia, two plaintiffs initiated a potential wage-hour class action against their employer in November 2016.  The employer had an arbitration policy in its handbook.  Soon after the lawsuit was filed, the employer located checklists pertaining to new-hire documents that confirmed each named plaintiff had received the arbitration policy. ....
