Haaland, Interior approves Cherokee Nation's Constitution | News


The Constitution, with the current legal acknowledgments of Cherokee Freedmen, was recently submitted on March 12.
“The Cherokee Nation’s actions have brought this longstanding issue to a close and have importantly fulfilled their obligations to the Cherokee Freedmen,” Haaland said in a Department of Interior release. “Today’s actions demonstrate that Tribal self-governance is the best path forward to resolving internal Tribal conflicts. We encourage other Tribes to take similar steps to meet their moral and legal obligations to the Freedmen.”
Principal Chief Chuck Hoskin Jr. thanked Haaland and the DOI for “affirming” the Constitution.
“Our Cherokee Constitution embodies a vital link in an unbroken chain of governing law, from time immemorial, of the Cherokee people,” Hoskin said. “Our present Constitution has long been in effect, but acknowledgement of that document by the Secretary of the Interior is of tremendo ....

Cherokee attorney offers take on ‘by blood’ removal
STILWELL – An attorney familiar with the Cherokee Nation’s long and at times bitter relationship with freed slaves and their descendants says the CN Supreme Court’s removal of a “by blood” requirement is a milestone for civil rights within the tribe.
“This is not only a great day for civil rights activists in Cherokee Nation, it’s a great day for our judicial process,” CN citizen and Stilwell-based attorney Ralph Keen II said. “Now the judicial process recognizes that even though yes, we live within the framework of our own Cherokee law, we still have a higher responsibility and we’re still subjugated to federal law and we can’t violate that.” ....
