MontClairVoyant: Rent Control in Jeopardy, and That's No Game Show


Much has been made of pro-rent control lobby recognizing the rent control ordinance was a compromise. Many felt it should have covered more housing types & units. Let’s assume a referendum vote happens where the question of rent control goes to all the registered voters. Will the question be structure along the line of the flawed ordinance?

Thank you for the comment, Frank. Yes, one reason why the rent-control measure was a compromise was that it doesn’t cover all types of rental units something I should have mentioned in my column. If there is a referendum, I think (though really have no idea) residents would vote on the measure “as is” rather than on a revised measure or on the general concept of rent control. But if the referendum result allowed rent control to happen, I assume the measure could be strengthened at some point albeit at the risk of the litigation-inclined Montclair Property Owners Association going to court again. ....

Judge Reverses Montclair Rent Control Ruling; Special Election Possible for Ordinance

Montclair, NJ – The Township of Montclair announced that Superior Court Judge Jeffrey Beacham earlier today reversed his January 15 ruling on the Township’s rent control ordinance, adopted April 7, and ordered the Township Clerk to certify the Montclair Property Owners Association petition to put the ordinance on a ballot as a referendum question.
The ordinance will now go back to Township Council. If the Council chooses not to repeal the ordinance, the Municipal Clerk will schedule a special election which could be held in late April or early May.
The Council could also decide to appeal the court’s decision. ....

Judge to Dismiss MPOA Lawsuit; Rent Control Ordinance on Hold Until Feb. 19

Montclair, NJ – The Township of Montclair announced Tuesday that Superior Court Judge Jeffrey B. Beacham stated he would sign an order dismissing the lawsuit brought against the Township of Montclair by the Montclair Property Owners Association. The ruling would end the Association’s challenge to the Township’s rent control ordinance.
Judge Beacham agreed to stay the order until February 19 when the Montclair Property Owners Association will argue that the judge should reconsider his ruling.
According to the Township, Montclair Property Owners Association attorney Charles Gormally stated the Association’s members wanted to hold off the effective date of the ordinance so that landlords could raise rents by more than 10 percent on vacant apartments before the ordinance could take effect. ....

MontClairVoyant: Rent Control Gets a New Lease on Life


Yes, crazy times. Now Montclair’s Historic Preservation Commission is being sued over blocking the demolition of historic 109 Union Street. They join the other land use bodies being sued – the Planning Board and the Council. As I recall, the Zoning Board has an active appeal.
In this most recent case, the HPC played nice and polite (unlike the other bodies) and that led to their second mistake. The first mistake was the demolition ordinance.
The HPC was totally right in their justification to deny the application. They just didn’t execute properly. Again, timing.
I said the demolition ordinance wouldn’t work. I said it many times (as I have a habit of). It is not fixable. It is something that we will keep on the books to trip up those property owners who do not have the level of lawyering this applicant hired. ....
