MADAWASKA MALISEET FIRST NATION, NB, April 13, 2021 /CNW/ - Honouring Canada s legal obligations to First Nations and working collaboratively to renew relationships are key to righting historical wrongs to advance reconciliation with First Nations in Canada.
Chief Patricia Bernard of the Madawaska Maliseet First Nation and the Honourable Carolyn Bennett, Minister of Crown-Indigenous Relations, announced a major step forward on the path of reconciliation and renewal. The Madawaska Maliseet First Nation and the Government of Canada have concluded a negotiated settlement that resolves the First Nation s Alienation of Reserve Lands Specific Claim. Canada has provided the First Nation with $145 million in total compensation. ....

Multi-million dollar compensation for Mosquito

The compensation is as a result of “breach of Crown fiduciary duty arising in 1905 out of a surrender of lands from Indian Reserve No. 110/111 (IR 110/111)” according to the decision of the Specific Claims Tribunal.
The surrendered land consists of a parcel of 14,670-acres, or approximately two-thirds of the reserve. The ruling notes the federal government had admitted it breached its fiduciary obligation to the Mosquito reserve that rendered the 1905 surrender invalid.
According to the decision from Hon. Harry Slade, where “reserve land is affected by an invalid surrender, section 20(1)(g) of the SCTA requires that the Tribunal award compensation equal to the current unimproved market value (CUMV) of the subject lands. The Tribunal must also, under section 20(1)(h) of the SCTA, award compensation equal to the value of the loss of use (LOU) of the lands, brought forward to the present value of the loss.” ....

Peepeekisis Cree Nation to vote on $150M federal settlement agreement

It s kind of not council s fault that not everybody can attend, Frank said.
Because we were under a strict confidential agreement between ourselves and Canada, we could not disclose anything, too much. These were high-level talks.
He said the community intends to distribute a portion of the claim money among band members and use money set aside in a community trust for community-based projects or improvements.
