New law against improper advertising contracts has competition implications


Introduction
After gaining fast-track approval, President López Obrador issued the Law for Transparency, Prevention and Combating Improper Practices in Advertising Contracting (the Advertising Contracting Law) in the Official Gazette on 3 June 2021. This will become effective on 2 September 2021 and will grant new powers to the Federal Economic Competition Commission (COFECE) but may fall outside the constitutional objectives of the competition authority. Application of the new law may be problematic and may disregard the competence of the Federal Telecommunications Institute (IFT).
The Advertising Contracting Law, in general, provides that:
Agencies may only acquire advertising spaces on behalf of and for an advertiser, and may not acquire them on their own account for subsequent resale. ....

FTC abandons challenge to Philadelphia hospital merger.
On March 1, 2021, the FTC, suffering its first loss in a hospital merger challenge since 2016, voted 4-0 to end its effort to stop the proposed $599 million merger of Philadelphia-area health care systems Jefferson Health and Albert Einstein Healthcare Network. The FTC’s decision comes about a month and a half after the Pennsylvania Attorney General’s office dropped out of the joint challenge.
The FTC challenged the merger on the basis that it would hurt competition in the Philadelphia-area health care market, and after a defeat at the district court, told the appellate court that the judge had applied “faulty economic reasoning.” The FTC alleged that a combined network would control over 60% of the market for inpatient general acute care services in and around North Philadelphia and at least 45% of the market for those services in and around Montgomery County. New FTC officials announced.
On Jan. 21, 2021, President Joseph Biden designated Commissioner Rebecca Kelly Slaughter as acting chair of the FTC. Slaughter, a Democrat, has served as an FTC commissioner since May 2018.
On Jan. 25, 2021, FTC Chairwoman Slaughter announced a number of FTC staff leadership changes, including replacement appointments of the acting general counsel, acting directors of the FTC’s three operating bureaus (the Bureau of Consumer Protection, the Bureau of Competition, and the Bureau of Economics), as well as the acting director of the Office of Policy & Planning. The previous leaders in those offices resigned effective Jan. 29, along with departing FTC Chairman Joseph Simons. ....
