Illegal bid to reform Kenya's constitutional head: Supreme Court Politics News


The Kenyan Supreme Court ruled that President Uhuru Kenyatta’s proposal to change the constitution was illegal, stopping the movement by critics that it was publicly designed to verify his deputy.
Parliament has already approved the proposed amendments – known as the Institutional Bridges Initiative – which mark the biggest change in the governance structure of the East African nation since the new constitution was adopted in 2010.
However, in a ruling on various challenges posed by various parties, the five-judge court on Thursday said Kenyatta had used the constitutional provision reserved for citizens to initiate changes, making the process illegal.
“The bill to amend the constitution is an initiative of the president and the law makes it clear that the president has no constitutional mandate to initiate constitutional changes through the people’s initiative,” the court said in its ruling. ....

The country and the world for a few days was glued to television and other multimedia as the Supreme Court sat to hear the presidential election petition filed by presidential candidate runner-up Robert Kyagulanyi, aka Bobi Wine, after the January 14 General Election. 
Under the laws of the land, only the Supreme Court is seized with the jurisdiction to “inquire” into and “adjudicate” the question of whether the president was validly elected. The same supreme law of the land provides that the presidential election shall be conducted by an independent Electoral Commission and shall be by universal adult suffrage and by secret ballot. So many statutory clauses go into further details but, the gist of this particular election and the reluctance to tamper with its outcome is founded in two big reasons.  ....

Uganda: Suspension of Democratic Governance Facility Highlights Growing Concerns
President Yoweri Museveni’s order to suspend the initiative comes as opposition parties bring allegations of electoral fraud to the Supreme Court.
In response to the suspension of the Democratic Governance Facility and other recent developments in Uganda, Freedom House issued the following statement:
“We are alarmed by the decision to suspend the Democratic Governance Facility,” said Jon Temin, director of Africa programs at Freedom House. “This fund is critical to the operations of many Ugandan civic organizations mandated to advance the rule of law and good governance and some government bodies, including the Uganda Human Rights Commission. Through this action, the government of Uganda is standing in the way of progress driven by Ugandans themselves.” ....
