Permitting alternative business structures could spur tech innovation, Arizona justice says

Arizona is hopeful that its decision to permit alternative business structures in the law will produce greater technological innovation within the legal industry, said Arizona Supreme Court Vice Chief Justice Ann A. Scott Timmer during the ABA Techshow 2021 on Monday.
Timmer also expressed optimism that her court’s unanimous vote in August 2020 to eliminate Arizona Rule of Professional Conduct 5.4 barring nonlawyer ownership and investment in law firms will lead to greater access to justice and defended the court’s action. ....

ABA becomes plaintiff in lawsuit over treatment of children affected by remain-in-Mexico program

The ABA’s immigration project in Texas has joined a lawsuit alleging that unaccompanied children affected by the Trump administration’s remain-in-Mexico program are being denied basic legal rights.
The ABA’s South Texas Pro Bono Asylum Representation Project, known as ProBAR, joined the lawsuit as a plaintiff Feb. 12, along with a New York nonprofit called the Door, according to an ABA press release. The amended lawsuit, filed in federal court in California, is here.
The suit says some of the children sent to Mexico under the policy have entered the United States on their own, yet they are denied legal protections given to other unaccompanied children. ....

Utah Supreme Court Justice Constandinos “Deno” Himonas is fond of saying that trying to tackle the growing justice gap with the same strategies is “Einstein’s definition of insanity.”
One key reason he says that is because of the size of the problem. The Legal Services Corp. reported in 2017 that low-income Americans receive inadequate or no professional legal help for 86% of the civil legal problems they face annually. ....

ABA launches initiative to help measure effectiveness of regulatory reforms

The ABA Center for Innovation has launched an initiative focused on developing uniform metrics that states could use to measure the effectiveness of new approaches they are taking to regulating the legal industry.
The center’s project comes as states such as Utah and Arizona have in recent months approved opening up their legal marketplaces to alternative business structures featuring nonlawyer owners and investors.
Officials involved with the ABA’s metrics initiative say a primary goal is assisting jurisdictions with determining whether their regulatory reforms are achieving the desired outcomes, such as increased access to justice for members of the public. States collecting the same type of data would also allow for comparisons between different regulatory approaches, they argue. ....
