IPOPHL: New revised rules will speed up prosecution of IP cases

The Intellectual Property of the Philippines (IPOPHL) said the Supreme Court’s (SC) 2020 Special Rules on the Prosecution of Intellectual Property (IP) Cases will speed up the adjudication of IP rights cases.

“The Revised Rules is yet another example of the whole-of-nation approach in promoting and enhancing the intellectual property system, where the judiciary and executive branches, as well as the private sector, have worked in synergy, guided by the shared vision of enhancing judicial processes in adjudication of IP rights cases,” IPOPHL director general Rowel S. Barba said. ....

Revised rules to speed up resolution of IPR cases

The government has revised the rules of procedures for intellectual property rights (IPR) cases to further speed up resolution of disputes and sustain the country’s robust innovative economy.
 The adoption of the 2020 Revised Rules of IPR Cases was a collaborative effort among private sector stakeholders and various government agencies led by the Intellectual Property Office of the Philippines (IPOPHL), the Supreme Court, and the Department of Trade and Industry, among others.
 IPOPHL Director-General Rowel Barba cited the importance of the 2020 Revised IPR Rules in ensuring an effective and speedy adjudication of IP rights cases stressing the IPR is an essential pillar in creating an environment that fosters innovation, promotes investments and entrepreneurship. ....

SC expedites resolution of IPR cases in trial courts

The Supreme Court (SC) has expedited the resolution of cases involving Intellectual Property Rights (IPR) which will now be solved within 60 days from the date the cases are submitted for decision instead of the 90- day period in other cases.

Chief Justice Diosdado M. Peralta explained the salient features in the filing and adjudication of IPR cases in the online launch on Wednesday, December 16, of the 2020 Revised Rules of Procedure for IPR cases.
The new rules were approved by the SC, as a full court, last October 6 and became enforceable last November 16.
The SC decided an online launch of the new rules which “aim to improve, facilitate, and expedite IPR litigation.” ....

Chief Justice Peralta leads online launch of 2020 IPR rules


MANILA, Dec. 16  Chief Justice Diosdado M. Peralta today led the Supreme Court in the online launch of the 2020 Revised Rules of Procedure for Intellectual Property Rights Cases (2020 IPR Rules) which aims to improve, facilitate, and expedite IP rights litigation.

In his keynote address during the launch at the Supreme Court En Banc Session Hall, Chief Justice Peralta stressed that the 2020 IPR Rules are the product of extensive consultations and thorough discussions between the Judiciary and the stakeholders from various sectors, practitioners, the academe, and the Intellectual Property Office of the Philippines (IPOPHIL). ....
