Oklahoma City Public Schools sues over charter school settlement

The district on Wednesday filed a legal petition asking a court to find the State Board of Education didn t have the authority to settle a 2017 lawsuit with the Oklahoma Public Charter School Association in a way that will allow charter schools to receive more local tax dollars.
The SBE (State Board of Education) is granted certain powers by the Legislature. Those powers do not include making changes to Oklahoma statutes or the Oklahoma Constitution, particularly to the public school funding mechanism, according to the lawsuit filed in Oklahoma County District Court.
The district seeks a declaratory judgment on state law regarding school funding and a decision on whether the State Board of Education has the authority to implement the proposed settlement to boost charter school funding through local tax sources. ....

Gov. Kevin Stitt signs Oklahoma school funding, open transfer bills

How did HB 2078 change Oklahoma school funding?
Stitt signed House Bill 2078, which passed the Oklahoma Senate on a vote of 27-19, with 11 Republicans and eight Democrats voting against.
The proposal incited fierce debate and a slew of questions on the Senate floor. 
“You know it’s a big day when bills pass off the floor, and the governor has them on his desk ready to sign that afternoon, said Senate Pro Tem Greg Treat, R-Oklahoma City. 
HB 2078 will have school funds be based on the enrollment count only from the prior school year, not two years ago. It also would allow districts to carry over more money from year to year in their general fund, which supporters say will allow districts to carry over more federal stimulus funds to offset any state funding reductions. ....

Monumental Court Rulings In Oklahoma Affirm Tribal Sovereignty

Last week, the Oklahoma Court of Criminal Appeals delivered two monumental rulings affirming the tribal sovereignty of the Chickasaw Nation and the Cherokee Nation. The cases are now part of five Oklahoma tribes effort to regain their reservations following a historic win in the U.S. Supreme Court.
In each case, the defendants challenged the state s ability to prosecute them based on the location of the crime and the fact that both involved citizens of tribal nations in Oklahoma. In siding with the defendants, the court found that the reservations for both the Chickasaw Nation and the Cherokee Nation were never disestablished. ....

Oklahoma Killer's Conviction Overturned By State Appeals Court Based On McGirt Ruling

OKLAHOMA CITY (AP) An Oklahoma man’s murder convictions and death sentence have been overturned following a U.S. Supreme Court ruling that much of eastern Oklahoma remains an American Indian reservation.
The Oklahoma Court of Criminal Appeals on Thursday reversed the decisions against Shaun Bosse, 38, because the crimes occurred on land within the Chickasaw Nation’s historic reservation and the victims were Native American.
Bosse was convicted and sentenced to death in the 2010 killings of Katrina Griffin and her two young children. The victims were found inside a burning mobile home near Dibble, about 35 miles south of Oklahoma City. ....
