કાયદાની જે કલમ છ વર્ષ અગાઉ રદ થઈ ચૂકી છે એ કલમ હેઠળ પોલીસ દેશભરમાં આજે પણ હજારો FIR નોંધી રહી છે એ જાણીને સુપ્રીમ કોર્ટે આશ્ચર્ય અને આઘાત દર્શાવ્યા હતા. સાથે જ કેન્દ્ર સરકારને બે અઠવાડિયામાં જવાબ આપવા નોટિસ ફટકારી છે. પીપલ્સ યુનિયન ફોર સિવિલ લિબર્ટીઝ (PUCL) દ્વારા સુપ્રીમમાં અપીલ દાખલ કરવામાં આવી હતી. ઈન્ફર્મેશન ટેકનોલોજી (IT) એક્ટની કલમ ૬૬-છ સુપ્રીમ કોર્ટ ૨૦૧૫માં રદ કરી ચૂકી છે અને ૨૦૧૯માં રાજ્ય સરકારોને આદેશ કરી ચૂકી છે કે બધા જ પોલીસ કર્મચારીઓને આ હકીકતથી વાકેફ કરી દેવા.
તેમ છતાં દેશભરમાં પોલીસ કર્મચારીઓ IT એક્ટની આ જ કલમ હેઠળ હજારો FIR દાખલ કરી રહ્યા છે અને ટ્રાયલ કોર્ટોમાં એની સુનાવણીઓ ચાલી રહી છે અથવા પેન્ડિંગ છે. સુપ્રીમની જસ્ટિસ આર. એફ નરિમાનના વડપણમાં કે. એફ. જોસેફ અને બી. આર. ગાવાણીની બેન્ચે તેની સુનાવણી કરી હતી. કોર્ટે જણાવ્યું કે ૨૦૧૫માં શ્રેયા સિંઘલ કેસમાં સુપ્રીમ કોર્ટે આ કલમ રદ્દ કરી દીધી હતી અને ૨૦૧૯માં રાજ્ય સરકારોને બધા પોલીસ મથકોએ તેની જાણ કરી દેવા આદેશ કર્યા હતા. છતાં આજે આ સ્થિતિ હોય તો તે ભયાનક છે. સરકાર તરફથી એટર્ની જનરલ વેણુગોપાલે બચાવમાં દલીલ કરી હતી કે સુપ્રીમ કોર્ટે કલમ રદ્દ કરી દીધી છે, પરંતુ IT એક્ટમાં આજેપણ કલમ ૬૬છ લખાયેલી છે. પછી તેની સાથે ફૂદડી કરીને નીચે ખુલાસો લખવામાં આવ્યો છે કે સુપ્રીમ કોર્ટ આ કલમ રદ કરી ચૂકી છે.
સુપ્રીમે આ તબક્કે ટકોર કરી હતી કે પોલીસ નીચે જોઈ નથી શકતી? બે અઠવાડિયામાં કેન્દ્ર ખુલાસો કરે. આ તો આઘાતજનક અને સ્તબ્ધ કરનાર છે. અમે પગલાં લઈશું. PUCL દ્વારા માગ કરવામાં આવી હતી કે સુપ્રીમ કોર્ટના રજિસ્ટ્રારને સૂચન કરવામાં આવે કે તેઓ દેશની તમામ ડિસ્ટ્રિક્ટ કોર્ટોને જાણ કરવામાં આવે કે IT એક્ટની ૬૬-છ કલમ અંગે શ્રેયા સિંઘલ કેસમાં સુપ્રીમે આપેલા જજમેન્ટને ધ્યાનમાં લે.
શું છે ૬૬-એ કલમ અને ચુકાદો?
સુપ્રીમ કોર્ટે ૨૦૧૫માં IT એક્ટની કલમ ૬૬-છ રદ કરી દીધી હતી. તેમાં પોલીસને અધિકાર મળતો હતો કે સોશિયલ સાઈટ કે ઈન્ટરનેટ ઉપર વાધાજનક લાગતું કન્ટેન્ટ મૂકનારની ધરપકડ કરી શકે. સુપ્રીમે કહ્યું હતું કે આ કલમ અભિવ્યક્તિના અધિકારનું ઉલ્લંઘન કરે છે. કારણ કે તેમાં વાંધાજનક શબ્દની વ્યાખ્યા નથી કરાઈ.
