Montgomery County has settled a lawsuit with a man who was kneed in the back of the head two years ago by a county police officer during an arrest.
Officer Kevin Moris was seen on video kneeing Arnaldo Pesoa, now 21, outside an Aspen Hill McDonald’s in July 2019. Police said they were arresting Pesoa for selling psilocybin mushrooms – a type of drug that can cause hallucinations. As Moris tried to handcuff Pesoa on the ground, the officer struck Pesoa using his knee. ....

Lawsuit dismissed due to lifting of indoor dining restrictions

A Montgomery County judge agreed to dismiss a lawsuit on Thursday objecting to the county’s soon-to-expire ban on indoor dining after the parties agreed the litigation was not necessary.
The Montgomery County Council approved an executive order by County Executive Marc Elrich on Tuesday, which allows restaurants to open at 25% capacity indoors starting on Sunday at 7 a.m. Customers are limited to 90 minutes inside, under the order.
On Thursday, Ed Hartman, an attorney for the plaintiffs, said their case is “moot” due to the lifting of the dining restrictions this week, and asked for the case to be dismissed Silvia Kinch, who represents the county, agreed. ....

Montgomery County officials are considering reopening indoor dining at 25% capacity, but might limit each customer’s dining time to one hour.
A draft executive order County Executive Marc Elrich sent the County Council on Tuesday says the one-hour dining period for each customer would run from when they are seated until when they leave.
Restaurants would be required to keep a daily record of the date, time, name and contact information of at least one person in each dining party. The record would be kept for at least 30 days for contact tracing purposes. ....

Another hearing in a lawsuit by dozens of Montgomery County restaurants seeking to overturn the county’s indoor dining ban might happen next month, according to a law clerk for the presiding judge.
The restaurateurs, represented by the Restaurant Association of Maryland, filed the lawsuit in Montgomery County Circuit Court last month.
They sued, seeking an injunction and a temporary restraining order, after the County Council approved the dining ban on Dec. 15. The ban was a response to rising numbers of COVID-19 cases and deaths this winter. The order allows outdoor dining, as well as takeout and delivery service. ....

Montgomery County health inspectors investigated at a Clarksburg restaurant last week after photos on social media showed a group eating inside the restaurant and not wearing masks at an event hosted by attorney and gubernatorial candidate Robin Ficker.
The Clarksburg Tavern, at 23315 Frederick Road, posted on Facebook on Jan. 1 that it was hosting a celebration on Jan. 5 called “USA THEMED PARTY.” The bottom of the invitation stated that the event was hosted by “Robin for Governor.” ....
