TN legislature: Courts may reconsider death sentences over intellectual disability appeal


Nearly 34 years after receiving his death sentence, Pervis Payne may finally have a chance to avert the execution chamber.
Convicted of a double murder in 1987, Payne was sentenced to death despite unanswered questions around the evidence. The 54-year-old Tennessean, who now faces an execution date that could come down from the court any minute, has maintained his innocence for more than three decades.
Carrying bipartisan support, a measure allowing death row inmates like Payne to appeal their sentence on intellectual disability grounds cleared the Tennessee legislature Monday night. It will soon go to Gov. Bill Lee for his signature.
The initiative passed the House 89-4 and the Senate 28-1 Monday night. Sen. Brian Kelsey, R-Germantown, was the lone dissenting vote on the Senate floor. ....

NASHVILLE, Tenn. (AP) - Tennessee lawmakers on Monday passed legislation designed to prevent death row inmates with an intellectual disability from being executed.
The action sends the bill to Republican Gov. Bill Lee’s desk, with implications for the case of a current death row inmate. Pervis Payne’s attorneys have argued he is intellectually disabled as they fight to prevent the state from executing him. He received a temporary reprieve from the governor last November due to the COVID-19 pandemic, but that relief has since expired. ....

In 2002, the U.S. Supreme Court ruled that executing a person with an intellectual disability violates the Eighth Amendment’s prohibition on cruel and unusual punishment. Tennessee Legislature Passes Bill to Provide Death-Row Prisoners Court Review of Intellectual Disability Claims


The Tennessee state legislature has overwhelmingly approved and sent to the governor a bill that creates a procedure by which death-row prisoners can obtain judicial review of claims that they are ineligible for the death penalty because of intellectual disability. On April 26, 2021, HB 1062 passed the Tennessee House by a vote of 89-4
and the Senate by a vote of 28-1.
The bipartisan bill was inspired by the case of Pervis Payne (pictured), a Tennessee death-row prisoner with strong evidence of intellectual disability. Payne has repeatedly attempted to obtain court review of his intellectual disability claim. However, a defect in Tennessee law prevents death-row prisoners from presenting those claims to the state courts if their death sentences had already been upheld on appeal before the U.S. Supreme Court ruled in 2002 that the death penalty could not be used against individuals with intellectual disability. ....
