The title of this post is the title of this great new report authored by David Schlussel that was assisted in various ways by folks at Collateral Consequences Resource Center and Drug Enforcement and Policy Center (DEPC) at The Ohio State University Moritz College of Law.  Here is the abstract to the report:
Early 2021 was an unprecedented period for policymaking at the intersection of marijuana legalization and criminal record reform. Between February and April, four states enacted legislation legalizing recreational marijuana.  In conjunction with legalization, these states (New Jersey, New Mexico, New York, and Virginia) also enacted innovative criminal policy reforms including the automatic expungement of an exceptionally broad array of past marijuana convictions along with a variety of social equity provisions. ....

Michael has struggled with kidney disease since he was in his early 20s serving in the military. The high stress of the job ultimately put him in the hospital, and he was not able to return to the service due to his condition. The 37-year-old Virginia Beach resident, who requested his name be changed because of concerns about retaliation from future employers, said that a nurse mentioned during that hospital stay that marijuana could help alleviate many of his symptoms, like nausea and vomiting. But at the time, the substance was not legal in Virginia. ....

Bargained Justice: The Rise of False Testimony for False Pleas
The title of this post is the title of this new article available via SSRN and authored by Andrew Pardieck, Vanessa Edkins and Lucian Dervan. Here is its abstract:
The authors conducted a multi-year psychological deception study in the United States, Japan, and South Korea to gain greater understanding of the phenomenon of false pleas of guilty by the innocent.  The study also explored whether innocent participants would be willing to offer false testimony in return for the benefits of a plea bargain.  Our data indicate that a significant number of individuals are not only willing to falsely plead guilty in return for a benefit, they are also willing to falsely testify against others in official proceedings to secure those advantages for themselves. ....
