Canterbury medical officer of health says DHB not allowing him to work


Canterbury s long-standing medical officer of health says battle lines have been drawn after he was not allowed to return to work.
A court order last month temporarily reinstated him to the role, ahead of a full court hearing next month.

Dr Alistair Humphrey was a medical officer of health from 2000 until he was dismissed by the Canterbury DHB for incompatibility in October 2020.
Humphrey is challenging his dismissal at the Employment Court, which last month ordered that he be temporarily put back in his role until a decision is made on his substantive claim against the DHB. ....

A recently-released decision said Ward had started working for the company in 2004 and worked his way up over the years to a site supervisor role.
He had use of a company car, and after five years of service, was a beneficiary of the company’s investment trust. It meant that as long as he stayed with the company until April 1, 2019, he would have a part of the investment trust’s pool when it was distributed.

Covid-19: Lockdown-affected workers weren't entitled to minimum wage, court finds


The case was heard by Chief Judge Christina Inglis, Judge Joanna Holden and Judge Kathryn Beck.
At the hearing on October 13, the company’s lawyer, Emma Butcher, said it was a simple matter of whether the Minimum Wage Act applied to the payment of employees who were not working.
“This is not a case about exploitation of workers,” Butcher said.
“The Minimum Wage Act has no application to these facts and as such the determination is incorrect and should be overturned.”
Following the alert level 4 lockdown in March, Gate Gourmet was deemed an essential service but it told its employees it would need to partially shut down operations. ....
