As long as undemocratic laws like sedition remain on statute books they will be misused.

One cheer for the Supreme Court of India. Why only one? Because we still have some way to go before all arbitrary and unreasonable obstructions to freedom of expression are removed in this country.
The June 3 Supreme Court ruling in the
Vinod Dua case came as much-needed good news in an otherwise grim year. In their 117-page judgement, Justices UU Lalit and Vineet Saran stated, Every journalist will be entitled to protection in terms of Kedar Nath Singh, as every prosecution under Sections 124A and 505 of the IPC must be in strict conformity with the scope and ambit of said Sections as explained in, and completely in tune with the law laid down in Kedar Nath Singh. ‬ ....

India's Sedition Law and Media Freedom


Two orders given by India s Supreme Court in two separate cases early this month have, once again, brought into sharp focus the issue of the colonial-era law relating to sedition in the context of media freedom. Both cases involve journalists and their reporting.
One of the cases relates to the booking of two journalists of Telugu language news channels under Section 124A of the Indian Penal Code (IPC) for telecasting a speech by a dissident leader of Andhra Pradesh s ruling YSR Congress Party, which allegedly spread disaffection with the state government. The other case pertains to an FIR filed against noted journalist Vinod Dua, who was accused of having made remarks against Prime Minister Narendra Modi and his government s handling of the migrant labour crisis during the Covid-19 lockdown in 2020. In the hearings in both cases, the top court has made important observations which have a strong bearing on media freedom and the future of the sedition law. ....

Landmark Ruling in India for Survivors of Sexual Abuse with Disabilities


I interviewed a woman with a psychosocial disability who was gang raped in Kolkata in 2014, who said police told her, “She’s mental, why should I pay attention to her?” This is exactly the kind of thinking that needs to shift. The recent judgment emphasizes that testimony of a person with a disability should not be devalued or the person deemed incapable of testifying on grounds of a disability. 
The judgment notes that the rape survivor identified the perpetrator by his voice, which was familiar to her, and stresses that such testimony should be given equal legal weight as a visual identification. While the incident took place in 2011, before adoption of the Criminal Law Amendments Act of 2013, a law enacted following the gang rape and murder of a young woman in Delhi, this ruling demonstrates that accommodations can be made for people with disabilities in the judicial process. ....

‘The reform that’s supposed to happen in these homes isn’t taking place’
CHENNAI: In July of 2016, 33 boys ran away from the Government Observation Home for Boys and Girls in Kilpauk here.
While in the early investigation stages some sort of trafficking racket was assumed, it simply turned out that the boys tried to escape because of the poor conditions in the home.
More recently, despite a call by the Department of Social Defence, no NGOs volunteered to help rehabilitate children in conflict with the law in the city.
The reasons for both these incidents are more or less the same. “We have a strong law, but we never cared to train our staff on how to implement it,” says child rights activist Andrew Sesuraj. ....
