The Fair Work Commission has ruled a sacked Deliveroo driver be reinstated as he was found to be unfairly dismissed for taking significantly longer to complete deliveries.
A tribunal determined the man was not an independent contractor but an employee of the delivery company which is a “really significant decision” in the future of gig economy workers and companies, according to Transport Workers Union National Secretary Michael Kaine.
“This is a really significant decision the eyes of the world are on it in fact, what it means is the Fair Work Commission has essentially called out on exploitation of food delivery riders,” he told Sky News. ....

Workers 'not consulted' over new aviation plan

Transport Workers Union National Secretary Michael Kaine says the federal government had “no consultation” with workers or unions regarding the new aviation stimulus plan.

“Never has the prime minister agreed to meet with workers or unions. He has rejected our calls repeatedly to speak with us”, he said.

“It is critical that the prime minister makes an announcement extending JobKeeper in aviation until the effects of the virus have passed.

“It’s only that measure that is going to ensure we have an aviation industry that’s ready to go.

“The federal government has ploughed hundreds of millions of dollars into JobKeeper in domestic aviation and they run the very real risk of that falling at the final hurdle . because he’s decided rather than to extend it, to kill it today.”

Gig economy workers 'terribly exploited' while big business 'rakes it in'

Big businesses perpetuate the “mythology” that they cannot maintain a flexible work arrangement for workers and also provide them with benefits, says Transport Workers Union National Secretary Michael Kaine.

Mr Kaine told Sky News business like Uber are “raking it in” when it comes to making money while those employed in the gig economy are “terribly exploited” in the process.

“The mythology that these companies push out is that you can’t have a flexible work arrangement and provide workers with rights,” he said.

A recent Supreme Court ruling in the United Kingdom found Uber drivers were entitled to benefits like paid holidays and a minimum wage.

Mr Kaine said the court ruling “should inspire similar types of action” in Australia citing a two-month period at the end of last year when five delivery drivers lost their lives.
