Appeal Seeks to Resurrect Claims of Contamination From Aerospace Plant


(CN) A Florida man is asking a three-judge panel of the 11th Circuit to revive his lawsuit claiming that his late wife’s kidney cancer was caused by industrial runoff from a Pratt & Whitney aerospace plant nearby their marital home in a rural South Florida community.
More than a decade deep into the litigation, Marcos Pinares took his case back to the Miami division of the federal appellate court. He’s fighting to keep his lawsuit alive over Pratty & Whitney’s alleged contamination of the Acreage community in Palm Beach County.
The Acreage was the site of a highly publicized pediatric brain cancer cluster that was confirmed by the Florida Department of Health in 2009. After the cluster was identified, a string of toxic tort lawsuits flowed into South Florida courts, alleging that pollution from Pratt & Whitney’s plant had migrated into the well water of nearby Acreage homes. ....

(CQB), owner of the namesake banana label, failed to halt U.S. lawsuits brought by thousands of Colombians who said they or their relatives were tortured or killed by militias the company paid. U.S. District Judge Kenneth Marra in West Palm Beach, Florida, today denied Chiquita’s motion to dismiss some of the claims brought under the Alien Tort Statute and the Torture Victim Protection Act.The.company was fined $25 million by the U.S. after pleading guilty in March 2007.for paying Colombian paramilitary militias $1.7 million from 1997 to 2004.“While the court allowed some claims to move forward, it is important to understand that at this stage of the proceedings, the court is required by law to treat plaintiffs’ outrageous and false allegations as if they were true,” Ed Loyd, a company spokesman, said. ....

Law360 (May 19, 2021, 1:31 PM EDT) A Florida federal judge rejected a Panera and Applebee s franchisee s push to make the U.S. Equal Employment Opportunity Commission pick up the tab for $1.1 million in attorneys fees the company incurred defending a suit over worker arbitration pacts.
U.S. District Judge Kenneth Marra on Tuesday turned down a bid for attorneys fees and nontaxable costs from Doherty Enterprises Inc., saying the EEOC s suit wasn t frivolous and the agency hadn t acted in bad faith during discovery.
The arbitration agreement at issue which the EEOC said blocked workers from filing discrimination charges with the agency was ultimately updated, and the. ....

A Palm Beach County resident was sentenced to 24 months in prison for evading taxes and hiding funds in offshore accounts, bankrolling his lavish lifestyle that included buying a $1.6 million Lake Worth Beach mansion.
Dusko Bruer, who owned and ran the profitable farming equipment company American Made Equipment, did not report $7.7 million in income from 2007 to 2014 and secretly stashed nearly $6.3 million in Swiss, German, Serbian and Croatian banks, prosecutors said in court filings. He did not file tax returns and also filed false tax forms, evading payment of nearly $2.8 million to the Internal Revenue Service. ....
