Consider this scenario: an employment contract requires an employee to assign to the employer the entire right to any IP that the employee conceives, develops or creates during the term of employment. Does that provision give the employer co-ownership rights in an invention admittedly conceived after employment ends if the former employee based the invention at least in part on ideas allegedly developed during employment? In this week s featured case, the Federal Circuit resolved
an interesting case where a patent-owner appellant appealed a
district court judgment holding its patent claims invalid but asked
the Federal Circuit to affirm invalidity. That perhaps surprising
situation arose because the district court s opinion supporting
its judgment appeared to address multiple invalidity grounds, and
the patent owner was seeking to protect against potential

It has been a little while since we took a look at what from a statistics standpoint went down at recent oral arguments (see last post here). Since the Federal Circuit went remote, there was an initial wave of a high percentage of appeals that would have gotten oral argument pre-pandemic that were decided on the briefs instead with several sessions having a 40% or more cancellation rate for cases originally scheduled for argument. As we’ve now eclipsed the one year mark since telephonic arguments began, we thought we should look at how the most recent calendars have looked as far as cancelled arguments since the January session (which had 45% of arguments cancelled). ....
