While many Americans watched in horror as family separation policies tore families apart at the border, many of us didn’t know how frequently our laws tear apart families of color here in Connecticut.
When judges sentence parents to incarceration, they can unknowingly sentence children to family separation through termination of parental rights (“TPR”). After TPR, a parent has no right to care for, visit, or communicate with their child. TPR is the death penalty of family law: If the length of a parent’s sentence triggers TPR, children suffer permanent, legal separation from their families.

In spring 2020, Kristine Cook thought she would finally be reunited with her kids. A year earlier, after a relative had sexually abused three of her four daughters, protective services in Greene County, Mo., had placed her children in foster care. Cook was recovering from a decade of domestic violence and drug, alcohol, and mental health problems, but she said she was still able to care for her daughters. Since then, she has attended therapy, parenting classes, and drug treatment. She was doing everything to prove to the authorities that she was capable of rebuilding her family.

Clinic Releases Report on Preserving Parental Rights for Incarcerated Parents
Connecticut Voices for Children (CT Voices) and the Criminal Justice Advocacy Clinic of the Jerome N. Frank Legal Services Organization at Yale Law School (CJAC) released a report on March 12, 2021 that examines the collateral consequences of the Adoption and Safe Families Act on children with incarcerated parents.
The report, “Incarcerated Parents and Termination of Parental Rights in Connecticut: Recommendations for Reform,” examines the unintended impacts of the Adoption and Safe Families Act (ASFA), a federal law passed in 1997 that shifted the goal of child-protection policy from family preservation to adoption, and outlines recommendations to protect parental rights and promote the welfare of children with incarcerated parents.

At Minnesota’s Shakopee Correctional Facility for women, where I am incarcerated, solitude is something we seldom have a chance to experience. Loud, muffled over-head announcements begin every morning at 5:30 and continue until 9:30 p.m. when we are counted for the last time of the day. There is little privacy; everyone can hear each other’s business when we talk on the phone. Every aspect of our life is micromanaged, from when our blinds have to be raised and lowered, and how many books we can put on a shelf in our room, to the date we have to wear our winter coats regardless of the outside temperature. Prison is manila-walled, grey-clothed and full of blue plastic chairs. Any prisoner could tell you what’s for breakfast on a Wednesday or what’s on TV on a Monday night because our lives are a study in monotony. All of us are called “Offender” all day long.
