Are Wayne County voters being disenfranchised?


“The governor does not have the discretion” to fill a vacancy in the 19th Delegate District by selecting from a list of candidates supplied by the state Republican Party, argues Wayne County Republican Executive Committee Chairman Jeff Maynard. Such an appointment would “usurp the statutory rights of the Wayne County Republican Executive Committee members of the 19th Delegate District as well as their constituents.”
Maynard insists that Gov. Jim Justice is obligated to fill the vacancy with one of three names presented to him by the Wayne County GOP Executive Committee.
“The state committee has no authority under the law to inject a veto or control the process,” says attorney John Bryan, who is representing Maynard. ....

Controversy erupts in Charleston over selection process for former delegate Evans | News, Sports, Jobs


CHARLESTON – The effort to replace the former Delegate Derrick Evans has created a controversy of its own.
Jeff Maynard, the chairman of the Wayne County Republican Executive Committee, filed a writ of mandamus with the West Virginia Supreme Court of Appeals on Monday asking the court to require Gov. Jim Justice to pick a replacement for Evans from the list of three candidates the committee sent to Justice on Jan. 14.
Evans, who was elected to the House in November, resigned Jan. 9 after being charged the day before by the U.S. Attorney for the District of Columbia with one count of knowingly entering or remaining in any restricted building or grounds without lawful authority; and one count of violent entry and disorderly conduct on Capitol Grounds. ....

Gov. Jim Justice’s vaccine rollout is a boondoggle that is costing lives, Every county has been left to fend for itself, and here in Cabell County, those 65 and over with underlying conditions continue to wait (and wait) for their shots. Why hasn’t Justice centralized this life-saving process? Why hasn’t he called upon FEMA and the National Guard to open up arenas, gyms and stadiums so that vaccinations can become streamlined and efficient? Teams should be visiting remote hollows right now! People are dying — and will continue to die — as this modern-day Nero fiddles while the virus burns throughout West Virginia. ....

UPDATE: Wayne County delegate charged for taking part in storming of U.S. Capitol resigns


CHARLESTON – A newly elected Wayne County delegate now faces federal charges after taking part in storming the U.S. Capitol earlier this week has resigned.
Derrick Evans (R-Wayne) was charged January 8 with entering a restricted area an entering the U.S. Capitol, according to federal officials taking part in a press call about the January 6 events. Attorney John H. Bryan, who is representing Evans, said his client was picked up by federal officials and was taken to federal court in Huntington. Evans 
“The past few days have certainly been a difficult time for my family, colleagues and myself, so I feel it’s best at this point to resign my seat in the House and focus on my personal situation and those I love,” Evans said January 9 in announcing his resignation. I take full responsibility for my actions, and deeply regret any hurt, pain or embarrassment I may have caused my family, friends, constituents and fellow West Virginians.  ....
