Telecom Groups Fight Back Against New York Low-Income Broadband Access Law

Telecommunication trade groups have filed a lawsuit in an attempt to block a new law in New York that would force them to provide internet service to low-income customers for $15 a month.
The New York State Telecommunications Association, the Wireless Association and other groups filed the suit in the U.S. District Court in Brooklyn on the grounds it violates federal policy to not interfere with internet rates.
The lawsuit says New York has overstepped its regulatory authority and many companies already have low-cost offerings for qualified low-income customers.
Governor Andrew Cuomo signed into law the measure to ensure that everyone in the state can get high-speed internet regardless of income or location. ....

New York illegally attempting to regulate broadband rates, lawsuit says

BROOKLYN, N.Y. (Legal Newsline) - Six telecommunications industry associations want New York Attorney General Letitia James to answer in federal court for allowing state lawmakers to regulate broadband rates. 
The complaint was filed on April 30 in the U.S. District Court for the Eastern District of New York. The plaintiffs in the case include: the New York State Telecommunications Association, Inc.; CITA The Wireless Association; ACA Connects America s Communications Association; USTelecom The Broadband Association; NTCA The Rural Broadband Association; and Satellite Broadcasting and Communications Association. 
The Federal Communications Commission (FCC) protects telecommunications providers from government broadband rate regulation; according to the complaint, broadband service in New York has never been subjected to rate regulation from any federal or state entities.  ....

Last month New York Gov. Andrew Cuomo signed a bill that requires broadband companies to offer a $15 monthly Internet plan for low-income citizens. Telecom companies have fired back with a lawsuit to block the legislation.

(TNS) A group of telecommunications trade groups that represent a broad range of Internet providers has filed a lawsuit trying to block Gov. Andrew Cuomo s landmark new law that would make them provide $15-a-month Internet service to low-income customers.
The new law, which was passed as part of the state budget last month, is part of a broader effort by the Cuomo administration to ensure that everyone in the state regardless of income or location can get high-speed Internet, which during the pandemic has become more important than ever as students and workers have been forced to work and study from home. ....

ALBANY Two weeks after a law was enacted to require telecom companies to offer discount broadband plans to low-income New Yorkers, industry groups went to federal court Friday in an effort to block the legislation.
Gov. Andrew Cuomo has hailed the law as a trailblazing effort to make broadband services affordable for impoverished families.
By June 15, telecom companies doing business in New York must offer income-eligible households basic high-speed internet service for $15 per month. The discount rate for very high speed service is set at $20 per month.
Now, consumers getting the basic broadband are charged at least $50 a month on average in New York. ....

Broadband industry sues New York over $15 price cap


On Friday, a collection of industry groups filed suit against New York State Attorney General Letitia James, arguing states can t regulate broadband services. The suit contends the Federal Communications Commission (FCC) ruled in 2018 that broadband is an interstate information service that can t be regulated as a common-carrier service.
The Rate Regulation expressly seeks to set the rates and speed of an interstate communication services, it said. No state has ever successfully engaged in such regulations.
The FCC s 2018 ruling under chairman Ajit Pai came after a public consultation fraught with controversy. It was hotly contested because it changed the Commission s view of broadband communications from a common-carrier utility to a luxury, relaxing its control over broadband ISPs and effectively overturning federal net neutrality rules. ....
