Landlord Agrees to Resolve Tenant Harassment Claims Related to Displacing Tenants for Discretionary Work

The City of Santa Monica reached a settlement with Marshall Reddick Real Estate and Balthazar Investment Group, landlords of a five-unit apartment building located at 820 Bay Street, to resolve allegations of tenant harassment and wrongful eviction.
The City’s lawsuit alleged that the landlords made two tenants move out of their apartment throughout October 2019 so that the landlord could perform discretionary upgrades, even though the tenants did not want to relocate. The discretionary upgrades included replacing the carpet and painting the interior. The City alleged that the landlords abused their right of entry under California Civil Code section 1954; attempted to wrongfully evict the tenants without just cause; failed to provide legally required relocation benefits; and then raised the rent beyond the amount allowed by State law when ....

City Attorney’s Office Commemorates Fair Housing Month

The Public Rights Division of the Santa Monica City Attorney’s Office (CAO) is commemorating the 53rd anniversary of the Fair Housing Act of 1968 with the virtual workshop Fair Housing During COVID-19 on Thursday, April 29, from 5 to 6:30 p.m.
The online workshop will cover new topics, including pandemic-related issues in fair housing, rental-assistance programs for tenants and landlords, and source-of-income discrimination laws, which protect Section 8 voucher-holders and some users of rental assistance. California Can Enforce Net Neutrality Law After Court Victory
California’s net neutrality law bars internet service providers from prioritizing, blocking, slowing down, or speeding up internet content. California’s law was created after the Trump-era Federal Communications Commission rolled back the federal net neutrality regulation in 2017. The Justice Department sued to overturn the California law, and several trade associations followed with a request for a preliminary injunction to stop the California law pending the outcome of the lawsuit. Judge John Mendez of the US District Court for the Eastern District of California recently gave California a green light to move forward with the net neutrality law after denying a motion for a preliminary injunction to stop the law from going into effect. California Attorney General Xavier Becerra called the ruling a “critical net neutrality win.” ....
