California Can Enforce Net Neutrality Law After Court Victory
California’s net neutrality law bars internet service providers from prioritizing, blocking, slowing down, or speeding up internet content. California’s law was created after the Trump-era Federal Communications Commission rolled back the federal net neutrality regulation in 2017. The Justice Department sued to overturn the California law, and several trade associations followed with a request for a preliminary injunction to stop the California law pending the outcome of the lawsuit. Judge John Mendez of the US District Court for the Eastern District of California recently gave California a green light to move forward with the net neutrality law after denying a motion for a preliminary injunction to stop the law from going into effect. California Attorney General Xavier Becerra called the ruling a “critical net neutrality win.”

California Attorney General Announces Approval of Additional CCPA Regulations. On March 15, now former California Attorney General Xavier Becerra announced that the California Office of Administrative Law approved his fourth set of proposed modifications to the California Consumer Privacy Act’s (CCPA) implementing regulations (Fourth Set of Modifications), completing the finalization process. The Fourth Set of Modifications focus on providing consumers with clarity as to how they can opt out of the sale of their personal information and include provisions (i) banning so-called “dark patterns” that delay or obscure the process for opting out of the sale of personal information; (ii) permitting businesses to use an opt-out icon in addition to any “Do Not Sell My Personal Information” link; and (iii) requiring businesses that sell personal information collected offline to provide an offline right-to-opt-out notice. The recent passage of the California Privacy Rights Act (“CPRA”) has ushered in the first agency in the United States created for the sole purpose of protecting the privacy rights of Californians: the California Privacy Protection Agency (“CPPA”). The CPPA will have the full administrative power, authority, and jurisdiction to implement and enforce the California Consumer Privacy Act (“CCPA”) and the CPRA. Because of the potential for exposure due to violations, businesses should familiarize themselves with the new law and the accompanying requirements before enforcement commences. The CPPA is governed by a five-member board, consisting of Jennifer M. Urban, John Christopher Thompson, Angela Sierra, Lydia de la Torre, and Vinhcent Le, whose appointments were recently announced. The CPPA will have three main functions: education, rulemaking, and enforcement. Below is a synopsis of the CPPA’s predominant functions.
