Major Right-Wing Funders Push Supreme Court Case Against Donor Disclosure

The U.S. Supreme Court is hearing oral arguments today in 
. The case challenges the constitutionality of a California law that requires nonprofits operating in the state to provide regulators with a copy of their Internal Revenue Service (IRS) form listing their largest donors.
The Americans for Prosperity Foundation (AFPF), a $19 million nonprofit in the vast political network of billionaire Charles Koch, and its allies argue that the rule infringes on their First Amendment rights and will open donors up to harassment and deter their giving, despite the fact that the information is kept confidential from the public. The case has been consolidated with another challenge to California s law by the Thomas More Law Center, a  Christian Right litigation group. ....

EFF to Supreme Court: States Face High Burden to Justify Forcing Groups to Turn Over Donor Names


Throughout our nation’s history most potently since the era of civil rights activism those participating in social movements challenging the status quo have enjoyed First Amendment protections to freely associate with others in advocating for causes they believe in. This right is directly tied to our ability to maintain privacy over what organizations we choose to join or support financially. Forcing organizations to hand membership or donor lists to the state threatens First Amendment activities and suppresses dissent, as those named, facing harassment or worse, have to decide between staying safe or speaking out.
In a California case over donor disclosures, we’ve urged the Supreme Court to apply this important principle to ensure that the bar for public officials seeking information about people’s political and civic activities is sufficiently high.
