SD Supreme Court Upholds Life Sentence In Murder For Hire

A South Dakota inmate serving life without parole is asking the South Dakota Supreme Court to overturn his sentence.
Jonathon Klinetobe was charged with masterminding the plot that resulted in the 2015 murder of his former girlfriend in Rapid City.
He agreed to plead guilty to first-degree manslaughter and left it up to the judge to determine his sentence.
At oral arguments on Tuesday, Jan. 12, his attorney said the life sentence violates Klinetobe's Eighth Amendment right against cruel and unusual punishment.

SD Supreme Court upholds life sentence for Klinetobe

PIERRE, S.D. — In the South Dakota Supreme Court case,
Last year, Klinetobe pleaded guilty to a reduced charge of aiding and abetting first-degree manslaughter. Despite this reduced charge, Klinetobe was sentenced to life in prison without the possibility of parole, with the judge citing Klinetobe as a danger to the community.
Following the four-day sentencing hearing where he received the life in prison sentence, Klinetobe appealed.
During the review of the sentencing, the court was unable to find any abuse of discretion and came to this conclusion:
“Klinetobe’s sentence of life without parole reflects neither an abuse of the sentencing court’s discretion nor gross disproportionality. We affirm the sentence.”

Felony Assault Conviction Holds If Victim Doesn't Know Gun Won't Shoot

A Fall River County woman convicted for brandishing a broken gun at law officers and kicking a deputy has failed to have her conviction overturned.
The South Dakota Supreme Court has reaffirmed that a person can be charged with aggravated assault even if she knows her gun doesn't work.

SD Supreme Court Upholds Rape, Kidnap Conviction

An inmate serving a life sentence for kidnapping and rape is asking the South Dakota Supreme Court for a new trial.
Harry David Evans says several aspects of his 2019 trial were unfair. One issue he raises is that the Seventh Circuit trial judge allowed evidence of Evans's misconduct from about 25 years earlier.
The South Dakota Supreme Court heard oral arguments on Tuesday, Oct. 6.

SD Supreme Court Restores Wind Permits

Permits for two Deuel County wind projects have been restored by the South Dakota Supreme Court.
The Deuel County Board of Adjustment unanimously voted to allow construction of two wind farms. Opponents appealed, and a Third Circuit Court invalidated the votes of two board members, finding they had a conflict of interest.
The high court has now overturned that ruling.

SD Supreme Court: No Summary Judgment For Sheriff Whose Search Trashed Trailer

A property owner in Hamlin County says the sheriff there destroyed his trailer house in an unreasonable search.
The sheriff says he has immunity for damages caused when he's just doing his job.
A lower court refused to issue a summary judgment, saying it's a question for a jury, and the sheriff appeals that decision to the South Dakota Supreme Court.
The Supreme Court will issue a decision at a later date.
