In order to close down parliament, the Prime Minister would have to go to her majesty the queen and ask for her permission to prorogue. If her first minister asks for that permission, it is almost inconceivable that the queen will do anything other than grant it. Shes advised by her first minister. And she is then in the midst of a constitutional controversy that no serious politician should put the queen in the middle. The queen in the middle of. Now i think this is completely and utterly against parliamentary tradition and against the way in which our government should work. If that were to happen, i think there would be a queue of people who would seekjudicial review. The queens decision cannot be challenged in law. But the Prime Ministers advice to the queen can, i believe, be challenged in law. I for one would be prepared to go and seekjudicial review to prevent parliament being bypassed. The two men vying to be britains next Prime Minister faced each other in their only head to head debate answering questions for an hour, with each insisting that he was the best man to take the uk out of the eu. I might take an existing tory Prime Ministerto court. I mean, ithink it has taken everyone completely by surprise. It points to the fact that the determination of those who want to thwart no deal is not going away. So far, they have been unable to find a parliamentary mechanism to stop no deal. We need to deliver on the result of the referendum because we are a democracy and we follow the results of votes, and then we need to move forward anyway that can bring the party and the country together. In a way, what sirjohn major has said today is just another example of how desperately we need this country to start to come together again. I suppose the great unknown is whether sirjohn major would actually have any legal grounds to stop borisjohnson shutting down parliament. Now, supporters of sirjohn major suggest that if you look at the move by the courts to stop mrs may from triggering article 50 without consulting parliament, that would give sirjohn grounds for hope. But i suspect illegally it is going to be very, very congested. Butjust the sheer prospect of sirjohn deciding that so serious that he viewed the danger of no deal and borisjohnson viewed the danger of no deal and Boris Johnson trying viewed the danger of no deal and borisjohnson trying to take us out by circumventing parliament, that he is prepared, and he says others would too, to go to court to try to stop that happening. If parliament prevented if the government prevented parliament from holding the government accountable, for example by passing on act of parliament or no confidence motion, then to advise the queen to progrowth parliament to prevent parliament doing its job would be to cut at the most basic pa rt would be to cut at the most basic part of our constitution, and with therefor be unlawful. John major is also right when he says you cannot ta ke also right when he says you cannot take the queen to court, because it is wrong to involve her in politics but also she is the head of the court system so cannot be taken to court. The way that would be done would be to challenge legally the advice of the Prime Minister to the queen to prorogue. And, again, john major was completely right when he said the queen would in effect be obliged to accept the advice of her Prime Minister to prorogue, so the legal attack is on the advice being given to the queen. Because it com pletely given to the queen. Because it completely undercuts our parliamentary sovereignty, just like the gina miller attack, which was initially thought not to have much success , initially thought not to have much success, succeeded in court because what was happening there was that the executive will strike to take us out of the European Union without parliamentary consent. The court said you cannot do that and i think the courts would say here, no, you cannot exclude parliament from the process. The gina miller case was a lengthy process. Obviously, things can be expedited when time is of the essence, could Something Like this be expedited in a way that would conform to the october 31 deadline . Yes, the courts are incredibly good at deciding cases within the time that external circumstances, exactly like the point you have just made, the 31st of october deadline. I think what sirjohn major, or those who wished to challenge the government, should do is write to the new Prime Minister when he is in office, he has not yet been selected by the tory party, but once he is selected then right and seek an undertaking from him that he will not prorogue to facilitate a no deal, cutting parliament out of the process. If he refuses to give that undertaking, go straight to court and seek decorations that he cannot prorogue to avoid parliamentary sovereignty. Labours position on brexit has changed. Yesterday, obviously, Jeremy Corbyn outlining a shift. What do you think about that, offering they will push for a referendum and would campaign for remain . I am very worried about what consequences would be of a second referendum when the first was conducted on the basis that it would decide whether we left our remain. If parliament, before any general election, agrees to a deal that has been reached with the European Union, which is possible if Boris Johnson gets one and it passes through parliament, i think the right course is not to have a referendum but to accept the deal. If there is no deal, parliament should put no deal off the table and that should never be put to the public. We should just exclude no deal. If you can pass on act of parliament for a referendum on a no deal, you can equally exclude no deal. I cannot see any circumstances in which there would be a referendum before an election. And i understand from what the labour party is saying about its post general election position, they have not yet decided what they are going to do. In that context, the extrapolation would be, if you are campaigning for remain in one circumstance, you would have to do it in another. It becomes very confusing for voters. And also understanding from the new position that labour would seek to negotiate a deal if it took a powerful stop i think that is the right thing to do. My think that is the right thing to do. My position is that if Parliament Passes a deal, we should not have a second referendum, we should accept that deal and get on with moving on to the things that matter to this country, like improving the economy, health, education, etc. So, what is your view of the position that the party is in and what it says about leadership when there is this lack of clarity . Well, i am against the fundamental shift that the leadership has made to adopt a referendum on remain position of course, i would like to remain, ime remain, buti course, i would like to remain, ime remain, but i have to accept the vote of the people in the first referendum. I think what has happened is that the majority of my party, the labour party, are in favour of a referendum and remain, and ultimately jeremy and favour of a referendum and remain, and ultimatelyjeremy and the leadership have in effect succumbed to that position. Their position before was lets not have a referendum, necessarily, and that would be my position as well. The same with any symptom changing technology. The beauty when you see a Health Care Professional as they are not listening to the words you say, they are looking at you as a whole person. A Global Operation to tackle wildilfe crime has led to the seizure of tens of thousands of animals, birds and Sea Creatures in less than a month. In a joint operation across 109 countries, 30 big cats were seized, and large quantities of animal parts. 440 pieces of Elephant Tusk were taken, and more than half a tonne of ivory were found. And more than 10,000 live turtles and tortoises were siezed, as well as just under 1,500 other reptiles. It is an astonishing hole and a reminder that Wildlife Crime is on the rise across the world, and the kind of illegal trade which is interconnected with organised crime. With me now is our reality check correspondent, chris morris, to take us through some of the claims made during last nights debate. Lets start with the fact that both candidates said they could renegotiate the withdrawal agreement. What do you make of that . The debate reemphasised at the point they plan as are quite similar and it is to take what has been negotiated so far, renegotiated even though the eu says it is no longer at the negotiation, then ratify it, then legislate for it and all before then legislate for it and all before the 31st of october. So it means we are in a position where we are vulnerable however good our economy is doing domestically. Absolutely. There is a global slowdown and we have seen it in all of the major countries. Germany is a negative growth territory. The uk is not immune to those global headwinds. There is also no particular domestic reason why the uk economy should be contracting. This is very much linked to uncertainty. Sooner or later this uncertainty will lift and we will see some of that growth can back but it could be later rather than sooner. You touched on what the bank of england might make of this. They are keeping an eye on what happens because they have a few tools at their disposal to maybe encourage demand and things like cutting interest rates. In the United States there is an expectation that rate they could be cut at the end of the month. The Central Banks are really worried about the state of the Global Economy right now. Central banks have shifted in a conservative man over the past month. The disruption will linger and that will continue to feed that slowdown that we have with no upward momentum and growth already stagnating the risk of a recession have increased. That said, Central Banks in the bank of england in particular do not have the vaccine that hedge the Global Economy from recession a decade ago. This time around its linked to uncertainty that is beyond Central Banks to queue. It will take some time before that lifts and in the meantime that disruption to supply chains and Business Investment and productivity and profitability will be with us for some time. How long is that enquire expected to take . Very difficult to know. If you compare and contrast into the inquiry into the National Security league, these telegrams could go to hundreds of figures in west hall and whitehall as opposed to 15 or 24 if you cross reference whitehall as opposed to 15 or 24 if you cross reference everybody who received all of the telegrams, you could probably narrow it down quite dramatically. But i would think it is going to be difficult to actually kneel someone for this. Who knows, it could indeed be a foreign power. Although, there has been a degree of scepticism about that. Nevertheless, we know russia does engage in this sort of Cyber Espionage and clearly it would be in russias interest to destabilise relations between britain and america. So, you know, it could involve more than the Cabinet Office. Who knows, we may need to involve gchq as well. I suspect this is probably got a way to run it in terms of actually concluding who was behind this league, if we have managed to establish conclusively who are which country was responsible. That is the action that i have taken, not just as Prime Minister but also as home secretary. I will give him an example. The race disparity audit, which shines a light on inequality in the Public Services, is enabling us in the Public Services, is enabling us to put into place action that helps to ensure that people across this country, whatever their background, whatever their background, whatever their background, will ensure that they have access to the Public Services they need. This year, this year marks the 70th anniversary of the legal aid and advice act. That act introduced by the post war Labour Government gave all people access to justice, not just the government gave all people access to justice, notjust the rich. It was an essential pillar of a welfare state and decent society. The tory, Lib Dem Coalition slashed legal aid in 2013 and the results are clearly very unfair. The number of law centres and other not for profit legal aid providers has more than halved. There are no legal aid deserts across the whole country. There are now. Does the pro minister think that has helped or hindered the fight against burning injustice . The point that i was making to the right honourable gentleman that he seems to fail to recognise is that the whole question of burning injustices is not aboutjust access to the legal system. Shouting it is all very well members from the opposite benches are shouting. If the labour party cared about burning injustices, they would have done a darn sight more when they were empowered to with it. To deal with it. Some people have very short memories. It was the tory. Shouting it is all right, it is ok. The tory Lib Dem Coalition cut legal aid but also brought in fees for employment tribunal. The then minister for employment relations, the honourable memberfor east employment relations, the honourable member for east dunbartonshire, piloted that through the house. But since that time, my union, the unison, took the government to court and won and as a result, employment fees were cancelled. The cuts to legal aid affect people, mr speaker. Like marcus. Marcus is a 71 year old on credit, a leaseholder who is threatened with being evicted. He says, and i quote, open quote i paid taxes and National Insurance all my life. How is it right that i am being bullied and threatened with homelessness . The state will not protect me. He goes on to say, i have been working until 2am every night for the past six months, collecting evidence. I have got no idea if i have prepared my evidence correctly. Does marcus, trying to save his own home, not deserve legal aid to get proper representation in aid to get proper representation in a court and be fairly heard . Obviously, i recognise the concerns that marcus has about taking his case. But the right honourable and might reflect on the fact that one quarter of the ministry ofjustices budget is spent on legal aid the we spent £1. 6 billion on it last year. We are committing to ensuring that people can access the help they need into the future, but that is only one part of the picture. We have published a plan for Legal Support to maintain and improve access to support for those in need, and we are conducting a fundamental review of criminal legal aid fees schemes, which will consider criminal legal aid throughout the life cycle of a criminal case. So, there are aspects of this issue that we are, indeed, looking at. But i think it is important that we ensure that we are careful with the provisions that we make for legal aid. As i say, one quarter of the ministry ofjustice budget is spent on legal aid. We arejust going budget is spent on legal aid. We are just going to leave Prime Ministers questions for a few moments. We will be back, but we just want to get some more reaction to that resignation of the uk ambassador to the United States, Sir Kim Darroch, after correspondence that he had sent to the government was leaked and led to donald trump tweeting and criticising him, saying that he was inept and a pompous bill. Well, just in the past few moments, as you have been hearing, Sir Kim Darroch has resigned. We heard theresa may saying it was a matter of great regret that he found it necessary to leave his position. We can talk to james landale, our Diplomatic Correspondent. A really swift resignation and, actually, not one that was expected to come like this . Sir kim darroch is an incredibly honourable man of great distinguished public service, and he has taken the decision, which actually gets the British Government out of a hole. He has, by falling on his own sword, removed a problem that potentially could have a damaged uk us relations further. He has also meant that the fact that this story, potentially problems around his own position could have dragged on for a long time, that has now been cut short. Also, in the statement made by his boss, the head of the Foreign Office, in response to this hints at one of the other reasons why he has gone. He talks about the wish to relieve the pressure on your family and your collea g u es pressure on your family and your colleagues at the embassy for stopping other words, donald trump made sir kims position untenable, it simply could not work. And so he has relieve that pressure by resigning. He has also opened up this intriguing possibility, it is now possible for theresa may, she remains Prime Minister, to appoint his successor in the remaining weeks she has an office. You say that he removed a problem that could have damaged us uk relations further. Also what it is a shows the absolute power of somebody who wants to leak something with whatever intention they might have, to actually see somebody leave their job as a result. Yes, it shows that, in part, the agenda of whoever leaked these documents has been, in part, fulfilled, because it meant that Sir Kim Darroch has now gone and that uk us kim darroch has now gone and that uk us relations are damaged as a result. The interesting question is how both the existing feminist and future Prime Ministers try to pick up future Prime Ministers try to pick up some of the pieces. One of the leading contenders has always been sir mark sedwell, currently the National Security adviser to the Prime Minister. He has been in the frame for this. He has behaved honourably and comes out with his reputation intact. But we need to find out who did this because it was a very carefully prepared and orchestrated leak indeed. Will this make other diplomats very wary of sending open assessments of the host country and the characters involved in future . They were some things they that were political gossip about the Trump White House but there were more details about iran and its development of nuclear weapons. And the circle is much smaller than the general diplomatic telegram so when the investigation gets under way they will narrow it down quite quickly to who and where was responsible for it. We did see borisjohnson last night talking about ministers leaking things so the big question is what it Civil Servant or a minister or some kind of ministerial aide . The general view on white or was or was it was a political person who leaked this because it would be such a career ending thing for a mandarin to put this into the press. He has the whiff of a political motive. But im sure the next Prime Minister will wa nt to sure the next Prime Minister will want to move quite quickly and get this wrapped up as soon as possible.
