Its described in the indictment it was fuelled by lies, lies by the defendant, targeted at obstructing a Bedrock Function of the us government, the nations process of collecting, counting and certifying the results of the president ial election. The men and women of Law Enforcement who defended the us capitol on january 6 are heroes. They are patriots and they are the very best of us. They did notjust defend a building with people sheltering in it, they put their lives on the line to defend who we are as a country and a people. They defended the very institutions and principles that define the United States. Since the attack on our capitol, the Department Ofjustice Has remained committed to ensuring accountability of those criminally responsible for what happened that day. This case is brought consistent with that commitment. And our investigation of other individuals continues. In this case, my office will seek a speedy trial so that our evidence can be tested in court and judged by a jury of citizens. In the meantime, i must emphasise that the indictment is only an allegation and the defendant must be presumed innocent until Proven Guilty Beyond A Reasonable Doubt in a court of law. He has dismissed this indictment as is done with the previous two, saying this is a political witch hunt, the department of justice Being Weaponised by President Biden in order to stop them running for the white house, unsubstantiated claims he has made. The Republican Party by and large have backed him. They did so with his previous two indictments and have also seen his Approval Ratings tend to go up with republican voters. It is probably going to be the same with this indictment. However, how he does with the rest of the american electorate remains to be seen. Right now however he still remains the clear front rather the Republican Partys president ial nomination. Special Counseljack Smiths indictment caps an inquiry into events surrounding the january 6, 2021 riot at the us capitol. The investigation focused on mr trumps actions in the two month period between his loss and the attack on congress as lawmakers certified democratic president joe biden� s victory. Following the attack, congress led its own investigation and impeachment inquiry of donald trump. The country is very much divided on whether President Trump is liable for what happened, if you should even be prosecuted and former president still has and former president still has a lot of support. And notjust among his base but widely among republicans. What you think it is important is case does go to trial . Im not a political expert and im not really qualified to opine on why it is that our political system is divided but i do believe in justice and i believe the law shall apply equally to everyone, whether he is a former president of the United States or someone of considerably less means and stature. If that concept is going to mean anything, that has to apply in situation like this. I was a prosecutor and worked in the Criminaljustice System for years and believed strongly that the system, in order for it to work, these allegations, allegations like this need to be adjudicated in court. Subject to Cross Examination and the burden of proof. The president is presumed innocent. With an opportunity to defend these charges. The courthouse in washington is slamed with a backlog of hundreds of 6january cases on the docket. There are defendants who were charged in 2021 who have yet to go to trial. Is a speedy trial even possible . That is a really good question. The civil trials are not ones at which he needs to appear personally, the criminal ones of those at which he needs to be present stop its really hard to see how its all going to shake out. For instance, a documents case, while it is set for may 2a, still too early to tell in the process with pre trial motions and discovery, whether or not it will go. With his new indictment, typically you can count on a trial going about a year after indictment. We will see if that holds the case here. The reason why only one defendant was charged in this case was in order to try to get it to trial faster than if they had tried or charged other defendants. I think for instance, the Co Conspirators who may be charged later. Its really hard to see how its going to shake out in terms of the schedule. Whats interesting with a new indictment is if you have a Parallel Universe Going On Were Trump has created a narrative that he was forced out of office before, illegitimately, and lost the election because of the big steel. And the indictment talks about the big lie, so if you have them going on, the trial going on, parallel to the campaign, it will be an interesting dynamic hearing from him, his voice, one narrative, and from the trial, facts, supported facts, supported by average, evidence that tell a different narrative. He has really played this by textbook and his team is really highly skilled as a group of prosecutors who keep their nose to the wheel and just really focus on presenting the evidence. It sounds to me like theyve done an awful lot of research, one of investigation, and that they have nailed Down Everything in indictment, 100 and something paragraphs that information on things that they are completely confident that they can present to a jury. In other words, they can present to a jury. In otherwords, its they can present to a jury. In other words, its notjust information on paper. It is information on paper. It is information that can be converted into evidence, many it is admissible and a courtroom. As your previous guest talked about, not everything presented in the courtroom is in indictment. So my guess is that they have developed this information into evidence, without completely confident they can present it to a courtroom and they are ready to go. I think well see once they get one of a judge will start as early as thursday when the former president is arraigned on these charges, they will process to proceed with the case as quickly as possible. I dont think that it is such a complex case that should not proceed properly. That is indeed what the Special Counsel said, he was a speedy trial, but if you look at this courthouse in washington its a slab with a backlog of hundreds of cases linked to the 6 january riot. There was one defendant or several defendants charged in 2021 who are yet to go a speedy trial possible . It really depends on the charge, the particularjudges docket and how they were triage their cases. So you make a great point, does this case get put in the queue with a lot of the 6 january cases in the queue with a lot of the 6january cases board as the judge moved up in the queue, given the significance . A criminal case the certificate all the faces involved, each has its own significance, this one has a particular significance and it may well warrant thejudge moving It Significance and it may well warrant the judge moving it up in the queue. Obviously that will come over the objection of the trump camp to try to slow things down because most defendants try to put things into slow motion. Defendants try to put things into slow motion. This particularjudge was appointed by president obama, so one might assume, and perhaps accurately or not, that they have a more of a band one where the other, but i think they are just going to stick to the law here, they know they are being watched carefully and they will be very thoughtful about how they proceed. I think the bigger issue is not so much the judge that was appointed but thejury four. Ajury judge that was appointed but the jury four. A jury of his peers in northern Florida Weather document case is a bit different in terms of demographics than the jury pool in the District Of Columbia which i think most folks looking at this will look at is less favourably to the former president than the one in Northern Florida might be. Cbs news reports that a senior advior says hes focused, defiant, and more determined to win than ever. I spoke to robert costa, cbs Chief Election and Campaign Correspondent about his response and what comes next for his campaign. Bob, great to have you back. What are you hearing from the Trump Campaign tonight . Its a completed moment forthe Trump Campaign, they are trying to cast the Justice Department in a very stark light. Today they compared the doj to another germany in the 1930s but whats happening on the legal front will affect what is happening on the political front especially in terms of scheduling. On thursday trump has been summoned to appear in Washington In Federal Court for the first time in this case. If we look at some reactions coming into this, i want to ask about what weve heard from republican president ial candidate Florida Governor ron desantis who said on the other hand, his former Vice President and now opponent, mike pence, said these are two campaigns youve been following. What do you make of the different tones . Lets begin with former Vice President mike pence. Its highly significant and historic to have a former Vice President now running against his former boss for the republican president ial nomination while also serving potentially as the key witness in an historic investigation of an attack against the United States in alleged conspiracy to overturn the 2020 election, and if you read this indictment today it is so evident that the special Counseljack Smith and his team believe that mike pence has provided them with enormous value in terms of how they are building their prosecution. Insights into what trump said behind the scenes, pence is noted to have taken contemporaneous notes in the post 2020 election period and provided hours of testimony to the grand jury, so now they have him as someone who can really reveal at least from his perspective how trump was operating with the alleged scheme to overturn the 2020 election. So pence has a sharper take against his rival, his former boss, with his statement. Publicly governor desantis, the top rival in the polling to trump, and others are being critical of the Justice Department but whats more important is what is happening behind the scenes. When i talk to the rival campaigns tonight publicly they will criticise the Justice Department but privately i cant tell you, i could list at least a dozen of trumps rivals or opponents who are hoping, believing that what has happened today, an indictment onjanuary 6 could become an immense burden on trumps shoulders and maybe lead down the line to his Campaign Imploding as he deals with this deluge, notjust on 6 january but the classified records, Hush Money Payments in new york, and georgia investigation. They hope because he is still clearly the frontrunner to be the republican candidate and if we look at the polls, recent polling from siena New York Times it has President Trump and President Biden, we see here the choice are present, the current president at 43 and if you look at donald trump, even at 43 . Of course we are still a long way out, and a lot could happen, but what do you make of the polls . Inside the white house tonight there is a sense thats what happening with trump could be favourable to them long term but they also know it is activating his base, notably the white house declined to comment today about the indictment from the Special Counsel, the Attorney General appointed by President Biden at least nominated by President Biden, he confirmed, Merrick Garland declined to comment. They are trying to avoid a back and forth at least on the trump investigations but bidens inner circle believes the president retained so much power in his party and independents and some centre voters because he is seen as the last stop against another trump presidency. So the more trump is consumed with investigations in the petina of scandal, they believe it actually protects bidens political standing even as he faces questions about his age at some of his decisions as president. Yet we have seen the former president and his Campaign Fundraising offers indictment as they did the two previous indictments. Will this be another boost for the former president . It is not surprisingly fundraising because they have spent so much money in the trump orbit on legal fees. In a filing on monday it was revealed the trump Legal Action Committee save america has already spent more than 40 million on Legal Expenses this year, they have now made a new Legal Defence Fund to make it more separate from what is happening in the Political Campaign for trump. So trump needs money, he is leading in the polls, above 50 in the republican primary Race Committee polls but at the same time he needs money to try to survive in the primary race especially as his rivals smell blood in the water and are looking for the breakthrough potentially later this month in milwaukee at the first debate. But first of all, we start off with the news that for northern ireland, weve had the wettestjuly on record, with over double the averagejuly rainfall. Those records go back to 1836. It was also the wettestjuly on record for greater manchester, merseyside and lancashire as well. Now, weve got more rain to come through wednesday. This area of low pressure continues to strengthen and were going to see a swathe of particularly strong winds just running to the south of this hook of cloud you can see just here. Now, that is going to be working into the south west of the uk, but already those winds are picking up across south west england, across Southern Parts of wales, as our band of rain gets driven northwards and eastwards across much of the country. And, ok, its going to be a mild start to the day on wednesday, but those winds will continue to strengthen during the first part of the morning. The windiest weather works in across the south coast of england, where were looking at gusts of around a0 to 55 miles an hour. Even stronger for Northern France and the channel islands, where we could see gusts of 60 odd miles an hour. Now, winds that strong could bring down one or two trees, so you might find some localised disruption. You might also see the ferries running with even some cancellations or delays, so it might be worth checking before travelling if you have plans that way. Therell be plenty of heavy downpours for england and wales, some thunder mixed in, some really heavy downpours. But for northern scotland, well, this is probably where the brightest, driest weather is going to be. Youll manage a little bit of sunshine. It probably wont be too bad a day. Now, through wednesday night, the worst of the rain clears away eastwards, but you can still see some tightly packed isobars across the uk as we head into thursday. But across inland areas, you probably have to wait, really, until the afternoon until we start to see those showers become really widespread and heavy. Now, its not going to be the warmest of days for for august, with temperatures generally high teens, maybejust about the low 20s. And that kind of Weather Pattern continues friday and into the weekend. We might even see some longer spells of rain across england and wales as the low pressure potentially moves its way in this weekend. But if youre fed up with being rained on over the last, what, six or seven weeks, better news for next week.
