Our expectation for 32 decline in the Second Quarter following a 5 decline in the First Quarter, but then we start to see what is the likelihood for an advance. Right now we are forecasting 24 gain in the third quarter, so really, we are trying to figure out exactly what happens before the bad quarter gets reported. What we will do now is we are examining all of the evidence and circumstances in the case and what we plan to do is to make a decision and make that announcement and as weve indicated probably on wednesday there are technical things that we must make sure that they are done prior to announcement. One of those things is to confirm the ballistics. We have to make sure that the guns that were retrieved from the incident, that they are actually matched to projectiles in the body of mr. Brooks, but we are hopeful that we can make this announcement probably some time around wednesday. Dagen what charges are you expecting to bring . Can you give us inside into that . Well, right now under georgia law we are looking at 3 possible charges. First charge being murder, murder is a charge that carries a life sentence up to death and it is essentially around and intentional killing. The second charge that we are looking at is the charge of felony murder. Felony murder involves a death that occurs as a result of the commission of an underlying felony and in this case the underlying felony would be aggravated assault. The third charge that we are considering as we consider the facts would be voluntary manslaughter. Dagen are you considering charges against the second officer who was put on leave david braunson. Are you looking at that . We are looking at both officers and when we reach conclusions as i indicated on wednesday we will reach conclusions on both officers. Dagen the fact that a taser was taken away from one of the officers, did that because i know and this is layed out in the New York Times today that officers bradley speaking are trained that they have the right to escalate their use of force if they believe someone is threatening to incapacitate them. How does the taser play into your decisionmaking on charges . Well, taser is one of the things that happened in this case and factors that we have to consider but what we are focused on the moment of shooting, he was shot twice and we are looking at those circumstances that occurred at the moment. What the law says is that at the time that the shot was fired, what we have to determine based upon the perceptions of a reasonable officer is whether or not mr. Brooks at the time pose a serious threat of bodily harm or death to that officer or someone else and so thats what we are doing. We are focused upon that moment to see whether or not the facts indicate whether or not that occurred. Will you fully if you have a suspect eventually in custody, will you prosecute that case . Yes, we would. H. O. Are who are the principal competitors obviously in scale or has amazon has monopolized a market, all of the data make it impossible to compete outside of amazon . John right now amazon has too much data on consumers and vendors and needs to be broken up. The problem is amazon reels you in with the idea that data will help you as a thirdparty vender but now its happening as amazon is trying to create their own brands within their own store to then compete with the mom and pop shops. That is where this begins to get quite dangerous. Amazon is using their own platform to sell their own, you know, thirdparty products to compete within the platform itself. Dagen i believe that regulators in europe are bringing charges related to this very thirdparty seller issue. Meantime the House Judiciary Committee wants apple to testify amid growing scrutiny over the power of Technology Platforms, john, your take. John well, i think at this point Companies Like google and apple simply need to be broken up and if you put amazon, a company like facebook where they are dominating based again on data and as we get into the next few years, technology is like Artificial Intelligence and Machine Learning are getting more powerful. These are technology that is will make the Companies Even more monopolistic and so i think i consistent said that government lags 3 to 5 years in terms of regulation as it relates to possible monopolistic practices. John if you look at the size of the companies and scale and reach at this point its orders of magnitude out larger than anything that we have seen before. Problem with a company like google who i put in the list is again that they literally own the entire, you know, Online Search business. You look at them and facebook combined, you dont have anywhere where else to go and the size of the businesses is, again, to the point where you cannot compete as an offstart player, theres a reason why there hasnt been a competitor to google in over a decade or competitor to facebook in over a decade. Dagen before we go, siraj, if you look at washington and if you have maybe if the democrats take the senate, these Technology Companies are broadly speaking in terms of their employees very progressive, they are big donors to democratic causes and candidates. Is that something are democrats more likely, would a democrat in the white house more likely crack down on the companies or not . Do they think they would get a free pass if democrats are fully in power in dc . Thats a very good question because it depends which democrats fill up biden administration. Coronavirus concerns growing over a possible of resurgence as several states are seeing an uptick in cases. One state in particular seeing those fears, texas with more than 88,000 confirmed cases. The state reported its highest number of covid19 hospitalizations so far in the outbreak. Joining me now, texas congressman, House Veterans Affairs committee member, chip roy. Congressman, good morning. Whats being done about this in texas . Well, good morning, dagen. Governor abbott has been doing a great job moving texas forward. The other number we have to remember is the nationwide, we have almost 40 million unemployed americans. Its critical that we get back and reopen our society. Weve got a significant number of hospital beds that remain available, significant number of ventilators and our hospitals are working on it, paying attention to who is coming in. The iaustin, houston, where wee seen some additional admits to the hospital, its a tiny fraction of the overall population. Weve got to continue to move forward and watch this carefully as i know the governor is doing. But make sure we continue to engage in the society safely and protect the vulnerable. As a percentage, the numbers of people getting hit tends to be the people who are older in Nursing Homes and assisted living facilities. I know the governors been working hard, paying attention to that and making sure we keep them safe. Dagen i hear people say this on the right and left all the time on national tv. The number of people still collecting Unemployment Benefits, continuing claims, is about 21 Million People. 20. 9 Million People. That north of 40 million is the total number of people who have filed for Unemployment Benefits but many of those people arent still collecting them. So i hear that all the time. So i wanted to correct thats fair. Dagen to correct that. Again, its actually double the number of people who are still on unemployment when they throw out that 40 million number. Thats fair, dagen. Let me say theres a lot of people who have not gotten to the office to make their claims when they got hammered when the businesses were shut down. Lets talk to the restaurants and live music venues and the barber shops, people struggling to keep business open. They dont look at numbers on wall street. They know their business is hurting. What they know is theyre trying to go to the the bank to get more dollars in order to survive. Its a strong concern for people across the country. I think its heading in the right direction. We saw 2. 5 million in may. Weve got to do our part to make sure people can keep their businesses open and survive so that people have places to work. So i think it would be good news if we see number go south, i hope of it goes south of 20 million soon. Dagen i want to point this out, no ones been a more vocal advocate for getting help to Small Businesses and getting them reopen than i have been, quite frankly. I understand being the child of Small Business owners where quite frankly people in power and government and leadership never did jack all for my family or anybody i know running a Small Business. So dagen, im dagen government gets in the way. They wont they say theyre going to help. They dont provide it. Its too slow. And quite frankly, a lot of people feel like the only thing that government governors, mayors can do is open up, lets open up and just see what happens. Dagen, i could not agree with you more. Let me say, youve been talking about that and thats exactly what we need to talk about. Thats why its important to put in perspective the impact of what the government response has been to the virus on real families, real people. 41 of black businesses that are shut down over the last three months, because of whats happened with the government response to the pandemic. I could not agree with you more that it is our government that is interfering with the livelihoods. Dagen what about more stimulus . What are the gop members in the house onboard with in terms of additional stimulus . Another package . Yes, sure. As you know, i was very proud that last week the president signed the ppp flexibility act, bipartisan bill that i introduced along with dean phillips, unanimous consent in the senate, that will give additional flexibility to businesses to continue to survive. I hope thats a model well continue to look at as we go forward. Sevenpage bill. We try get the ppp to work for these businesses, extend the period in which they can hire people back in order to apply for forgiveness. We shouldnt be paying people more not to work than to work. The federal government and all its wisdom got in the way of Small Businesses like you just said, where they put Unemployment Insurance provisions to make it literally impossible for Small Businesses to hire people back because folks are getting paid more to not work. The president , the administration has been talking about this, republicans on the hill about payroll tax relief. There are ways to do this without running into another 2 or 3 trillion mass of ive still husband effort. I massive stimulus effort. I hope there is something more focused for businesses to hire people back. Two flights, one from new york, one from seoul, south korea slipped through the coronavirus sort of cracks going forward. One flight, an American Airlines flight 341 from new york already the shutdown had begun but a retired manhattan surgeon was already infected. The next day he was rushed to an la hospital, spreading the infection to everyone he came in contact with. That reached an assisted Living Center where nurse and others died. On the other flight, a woman had a fever, she had a heart attack the day after landing in los angeles and became la countys first coronavirus victim. In both cases, the times said that no one alerted anyone else on the plane that they were exposed. The cdc says local Health Officials failed to tell them. So no order of quarantine or trace cog happen. La county Health Officials say they did tell the cdc about the south korean flight but closed the case on the new york flight because they couldnt reach the surgeon in the hospital for an interview. About 200 people were on both flights. Senator john kennedy on sunday morning futures said regardless of the cases, now is the time to reopen the economy if we want it to survive. Thats my question. A lot of restaurants can open but they arent opening because they refuse to open at a loss because we can open, but you can only have 20 of capacity. On top of that, you have the consumer thats still confidence is still kind of low. The thing im looking for here is decoupling between Investor Sentiment and Consumer Sentiment to reverse itself. You have to have Consumer Confidence shoot up to the magnitude and velocity which weve never seen and we have yet to see that happen. Dagen mitch, you want to jump in . Katherine, good morning. What im trying to figure out is the way our economy is synchronized with the rest of the world, when we saw the bull market really taking off it was because global economies were synchronized in growth and now were synchronized in perhaps slower than we all want growth, what does that really mean for equity markets around the world in terms of where theyre headed . I think that equity markets, mitch, are certainly way beyond where they need to be. Theyre pricing in really euphoric perfection and i think we have three things in the offing, and ive been saying this for several weeks to our investors, both High Net Worth and institutional. Its the fear of missing out. There is no alternative. Dollar cost averaging, thats the way to do it in volatile markets. You can get a v that turns into a w. We are overstretched in the markets. The communist party of china picked up the phone called zoom and said eliminate their account, we dont want them talking about this and zoom did it. Now, thats not right. Thats not right by the communist party of china or by zoom. Zoom needs to decide whose side it is on. Dagen siraj, you first. What do you make of this kind of growing recognition of what zoom is doing . Zoom is obviously a huge problem. I mean, i use it for work and its obviously i kind of cringe at the thought that the Chinese Government is taking my information but one thing that we obviously are missing is how the Younger Generation has been popularizing the app tiktok which is another chinese spy app. So this growing use of zoom and tiktok and theres no really good alternatives to use, because theyre seeing so much good content coming from these things, thats been problematic and there needs to be a good solution or a market competitor to bring an alternative to americans. Dagen lee, ive been on Conference Calls recently or video calls and if youre communicating with like a big corporation, they dont use zoom. I mean, do you find that . I do find that. In fact, many of my clients you cant if you use zoom, you cant have conversations with them. Theyre looking at web ex, looking at microsoft teams, google hangouts, theres lots of alternatives out there that people can look into and i think by and Large Companies are looking at those not just because of the ties to china but really because of data concerns and people being able to jump in and jump out of meetings. So i think people really need to be aware and be careful when youre looking at zoom and as you mentioned tiktok. People need to be very, very aware. The thing that concerns me as theyre talking most people dont think about these things. Most people a lot of young people arent thinking about the issues related to particular toke and data tiktok and related to zoom and i think people need to educate themselves. Do you have a sense of who this could come down to . For biden. Im hearing a lot of names, susan rice is certainly emerging as a frontrunner, i think in that world. But im just really excited first of all that hes committed to picking a woman. Not that i think that the most qualified people out there for the Vice President ial pick are women, but the le electorate, te women will be so important. I think this pick is more important than it generally is. It may be in other years. So i think probably youre looking at val demings emerging because of her history as a Police Officer. But susan rice and certainly senator marris has always been at the top of the list. Dagen kristin, stay on that with val demings work running a Police Department and then Kamala Harris, the senators work as attorney general in the state of california, does that hurt them with voters more than it helps at this point . You know, i dont think so. I do a lot of work with were seeing people want to have someone who can bridge the divide. Were seeing a lot of protesting, peaceful protesting but we need to be able to heal. I think with a background in Law Enforcement, those are actually the types of candidates who can bring people together. I actually have a candidate who is running for congress in kentuckys sixth district. He is a former cop and is talking about it in ways that is healing for the country. I think this actually might be a positive for them. And not a negative. Dagen regardless of who the running mate is for joe biden, brian, he will likely get at least a shortlived boost from that, wont he . Yeah, i think the Democratic Party coming together at the convention sort of encapsulating joe bidens 40year career and hitting this high mark, there will be something nostalgic about it. Hell certainly get it. Once the voters analyze his policies and what the plan looks like post covid i think the honeymoon will end quickly and abruptly. Dagen if his running mate is a black woman, thats not nostalgic, thats groundbreaking. Yes and no. You have to remember the type of black woman thats coming to the table. Kamala harris is a prosecutor in california, im a californian and i can say wholeheartedly that the black and brown experience was very difficult and very challenging during Kamala Harris as da of San Francisco or attorney general of california. I think she has to circle that square with respect to her record. I mean, she had gone further than most prosecutors in the country at that time. She wanted to put parents in jail for their truant children. That affected black and brown communities. She was looking to score cheap political points as she made the way up the ladder. Now she has to address the disparities in her record. Dagen california, blue, but lets talk about the middle of the country and looking at most critical swing states right now, wisconsin, michigan, pennsylvania, by the way, President Trump won those three states by less than 78,000 votes. He needs to win at least two of them to stay in the white house according to many strategists. Wisconsin, michigan, pennsylvania, florida, North Carolina and arizona in the polling average for real clear politics, joe biden leads in every single one of those states except for North Carolina where trump has a 3 0. 3 percentage point lead in North Carolina. What is a concern for you as a democrat about those states . How quickly could they turn . I think you never i think we saw in the last president ial election, you can never take these states for granted. Have you to go in and its really interesting running right now, during this time of covid, because youve got your traditional ground game is different, right. I mean, its going to be different. So it concerns me im not necessarily concerned. I think weve got our eye on the ball. I think that president or Vice President bidens team is adapting to the new world that we live in and campaigning in the right way. But youre right, i think that were doing well right now. Youre looking at states like pennsylvania, we have increased voter turnout. If you even look down ballot at the primaries in the house which are an indicator to me, have you a lot of people coming out. Very to make sure we keep the momentum up, though, going into the general election. Dagen brian, with President Trump resuming rallies, which are kind of a hot spot for his certainly his 2016 president ial campaign, how can they help . You know, i think they help energize him and they help energize the people who are supporting the president , his base as they say. I think any time the president s out doing that retail poll of politics, traveling to middle america, traveling to the southwest, having conversations, showing up in peoples backyards and communities and saying hey, this is my plan for the future, this is my plan for post covid and how were going to rebuild this great economy, i think thats a good thing and i think the activeists, the people who support him feel that energy and leave these rallies energized, enthusiastic about what tomorrow looks like and they move that energy into the communities and the neighborhoods. I think its a good thing. We have challenges we have to deal with, with Health Concerns, but i didnt hear a lot of liberal politicians talk about Health Concerns during these mass protests a couple weeks ago. Dagen but a lot of the media literally you cant you dont see a headline about a potential trump rally without it mentioning coronavirus.
