victim needed help. they felt they had at traffic collision in hand but what they found was far worse. to marin county where police are investigating the mysterious death of a man and woman. officers found their bodies inside an apartment on hill road while conducting her welfare check. police are calling the deaths suspicious but did not elaborate. at the same time investigator stress there is no threat to the community. authorities have now identified the couple shot to death in a suspected murder suicide in oakland. it happened yesterday morning at home on keith avenue. police say 54-year-old mark williams shot his 73-year-old wife cheryl and turned the gun on himself as police were about to enter. president trump's daughter- in-law vanessa trump was taken to the hospital as he precaution today after opening the letter with a white powder inside. authority say the envelope was sent to the new york city apartment where vanessa trumps mother lives. it is not clear what the substance was but police it was not dangerous. new york police and secret service agents are investigating. president trump unveiled his budget proposal today pushing aside concerns about the deficit trillion plan for funding with the administration considered to be next years priority on the list $300 billion more for military spending, $23 billion for border security and $13 billion to fight the campaign ad. it was timed for the 14th anniversary of his decision as mayor of san francisco to issue marriage licenses to same-sex couples. newsom has been endorsed by nurses, teachers and firefighters. as far as the polls go, the most recent survey that was out last week shows eight close race between newsom and villaraigosa. the nonprofit found newsom was 22% support and villaraigosa at 21%. there followed by john chung at 9% and republican assemblyman travis allen at 8%. republican businessman john cox has 7%, democratic former superintendent delaine eastin comes in at 4% and republican former congressman douglas he has 3%. the full 24 -- 20% of voters say they are undecided. one place where lieutenant governor newsom has advantages is in fundraising. the most recent deli shows he has more cash than all the other candidates combined. the top two finishers in june regardless of party affiliation will face off in november. >> the new pole is interesting. the polls before reporter: persky sentence brock turner to three years bashan, six months in county jail and he is forced to register as a sects offender for the rest of his life. supporters of the recall effort delete the sentence was not hard enough but cordell contends of falls in line with requirements for cases like turner who was charged with felony assault. persky could have been much more lenient because turner had no previous criminal history. >> he could've gotten no jail, anywhere from 0 to 12 months in jail. this is what the judge opted to do and i think there was no judge that would disagree. >> reporter: successful recall could influence judges to sentence defendants much harsher including wrote -- low income defendants. >> judges are thinking, if i get the sexual assault case and i think it is eight jail case, i have the legal authority to make it lawful sentence and impose jail because i'm looking at all of the factors i'm supposed to look up.>> reporter: cases are made to the south bay labor council in san jose monday evening who will inform the roughly 100,000 union members. >> it is shocking that judge persky and his spokesperson are trying to cast dispersions on the victim's character and try her intoxication in the court of public opinion. the jury found him guilty of three felonies for sexually assaulting an unconscious woman.>> reporter: cordell wanted to be crystal clear about something she said. she said judge persky would have had to taken into account the both the victim and suspect were intoxicated at the time of the assault. i reached out to the labor council to find out when their members will make a decision an issue that to the members that are part of the union. where waiting to hear back on what to do -- when the decision might come down. >> we should mention the victim was unconscious. she was intoxicated and also unconscious. san francisco 49ers linebacker ruben foster is out on bail one day after his arrest on suspicion of domestic violence and for possessing an assault rifle. foster was taken into custody at his home after his girlfriend called 91 accusing foster physically dragging her during an argument. foster posted $75,000 bail and was free. this is not the first time the 23-year-old has had trouble with the law. last month foster was arrested in alabama on marijuana charges. he was and placed in the nfl's drug treatment program. they reporter who covers the 49ers said this time the charges domestic balance and the team may not be so forgiving. >> it was they huge celebration with the signing and brothers under arrest in fremont in connection with the home rental scam. the brothers are accused of using fraudulent names to rent at least five high-end properties in fremont over the last four years. in each case please see the brothers moved their elderly parents into the homes and refused to pay rent. once they were evicted the brothers are accused of trashing the homes and stealing large appliances between unpaid rent and damages police say the suspects or the homeowners at least $120,000. it has been one week since crews cleared out the homeless encampment in san jose but the homeless have moved back yards away from their original location. ann rubin spoke with frustrated advocates about the growing problem. >> reporter: the encampment off of fully avenue has been cleared out, the fence amended but the homeless that lived here have not moved far. >> they are trying to get rid of us but we do not have any place to go.>> reporter: doesn't have set up camp on the other side of the fence feet from their holding kevin. this man rejected moving to shelter as it would keep him from his business, repairing and selling bikes. >> the point is they wanted to move them out. the move them 30 to 40 feet and this is more of an eyesore than it was.>> reporter: caltrans so they had to clean the property for health and safety reasons. san jose city officials say this could be part of a but her plan in conjunction with caltrans, this is one of the sites they are considering for their tiny homes project. it is to have about 40 people living here in temporary housing. >> we are continuing to evaluate this site for one of our bridge housing communities at the potential side. no decisions have been made. >> reporter: the homeless are skeptical of the program but say something needs to change.>> when we get comfortable they kick us out. >> we do not want to be able to into anybody. people look down on us but we are not bad people, we are humans just like anybody else. >> reporter: the site is one of three locations on the shortlist for the tiny homes project. there will need to be environmental reviews and public comment before any final decision is made. an woman on the deserted road east of livermore. police on the victim bleeding from stab wounds along rural tesla wrote this morning. she has been airlifted to eden medical center where she gave investigators critical information. that information lead investigators to modesto where they arrested a 19-year-old man and woman. show bipartisanship the u.s. senate where debate is underway on immigration bill. democrat chuck schumer and mitch mcconnell shared the stage today. senator mcconnell said he supports the proposal by president trump to create a past to citizenship for nearly 2 million dreamers as well as money for a border wall and limits to legal immigration. are watching ktvu fox news at 6:30. 2 investigates learned that the city does pay thousands failed to pay thousands of contractors in a timely manner. some have been waiting for up to seven months. >> the new payment system and there are problems that need to be worked out with the. the city was questioned about what went wrong.>> the payment system two years of planning and it came online in june of last year to replace an outdated payment system first put in in 1980. the new hardware and software has left 4000 invoices unpaid at least for now. >> reporter: in a city the keeps growing, expanding and building, contractors and construction workers have no shortage of work but some are being shorted in another way. they are not getting paid. in this letter, united contractors which represent union workers says san francisco has failed to make on- time payments to contractors working for the city. some in excess of seven months. >> for them not to get their money is not acceptable. >> reporter: university of california berkeley professor specializes in labor issues and was upset. according to the letter contractors had been sued and summer taken out second mortgages on their homes because the city is not paying.>> whether it is technological glitches or bureaucratic ineptitude, hardly matters to those who are not getting paid. it is in issue that is urgent -- it is an issue that is urgent. >> reporter: united contractors said software and technical issues would be fixed in a couple of weeks but it has been going on for more than six months even calling out the city controller responsible for the new payment system. 2 investigates when to city hall to find out what is going on. what do you attribute the delays to? >> it it was a host of things. these are generational system projects. >> reporter: san francisco controller ben rosenfield said the old payment system was decades-old in the new system came online last june. software glitch is and bugs along with city, staff and vendors not knowing how everything works contributed to confusion and late checks. more than 200,000 invoices totaling nearly $5.8 billion has gone out the door but roughly 4000 invoices are left unpaid. >> we made a lot of payments using the systems of the fundamentals of it are working but we are not where we need to be. we are sorry for any hardship we provided to some contractors. >> reporter: the comptroller's office said it is running checks daily instead of weekly, and in some cases twice daily. >> we have staff working every day to make sure folks are paid.>> reporter: money the trade organization said should be paid back with interest >> there is a lot in california staying local agencies must pay undisputed invoices within 30 days otherwise they shall also pay interest to the contractors. i asked the comptroller about that and he said no decision has been made but there has been some discussion about that. >> is that -- is it the problem with the system itself or is human error involved? >> it it was a little bit of both. not only is it the bugs getting worked out but it is also the case of people not knowing how to work the system. they are trying to work to do. >> where talking about 4000 invoices, how much money? >> millions of dollars. they were quick to point out that 200,000 invoices have been paid so we have 4000 of that, that has not been paid. for one person who may need that check, that is important. >> it does not matter the amount, debated tonight at the city council meeting as rob roth reports the owner of the property wants to sell the land raising the question, what will happen to the crosses. >> reporter: these crosses have filled this lafayette hillside for about it doesn't years, 4000 of them. they represent those who died in iraq and afghanistan. >> it is and nice tribute and it shows that we care and the where -- and crosses. selling the land places the crosses in limbo. new owner would not be required to keep the. over the years some critics have said the crosses had an antiwar message, something clark disputes. the city has declined the offer. the city council is expected to decide monday evening whether clark can move forward with the plan to reconfigure his property to make it easier to sell. one
