Donald trumps lawyers have been called to appear in court later this week after a judge rejected their apparent attempt to delay what is normally a routine procedure in the 2020 elections case against their client. After days of back and forth regarding a protective order requested by prosecutors judge Tanya Chutkan put her foot down yesterday and scheduled a hearing on the matter for this friday. Just one day earlier the judge asked trumps lawyers and the Department Of Justice to submit dates for when they would be available this week to discuss the matter in person. In their responses yesterday Special Counsel jack smith wrote that hed be available, quote, at any time this week. Trumps lawyers, on the other hand, gave dates when they would be available next week for reasons they didnt explain they also claim to have, quote, lost friday as an option. Judge chutkan, however, was more than willing to make it an option once more. Quickly scheduling a hearing on the protective order indeed for friday morning at 10 00. Trump himself, however, is not required to attend. But he was staunchly defiant yesterday, lashing out at a Campaign Event in new mexico. Trump vowed not to stop talking about the case despite any protective order that might be implemented claiming it was a violation of his First Amendment rights. And during that tirade he blasted several of his perceived political enemies. They dont want me to speak about a rigged election. They dont want me to speak about it. Where i have freedom of speech, First Amendment. How can my corrupt political opponent, crooked joe biden, put me on trial during an Election Campaign that im winning by a lot but forcing me nevertheless to spend time and money away from the Campaign Trail in order to fight bogus, made up accusations and charges . Thats what theyre doing. Im sorry, i wont be able to go to iowa today. I wont be able to go to New Hampshire today because im sitting in a Courtroom On Bull [ bleep ] because his Attorney General charged me. Terrible. The former president who looks quite sweaty there also previewed a possible defense saying he never thought he actually lost the 2020 election while continuing to push his false claims that the election was rigged. There was never a second of any day that i didnt believe that that election was rigged. It was a rigged election. It was a rigged election and it was a stolen, disgusting election. And this country should be ashamed. And they go after the people that want to prove that it was rigged and stolen. It does seem that trump is really testing the judge there. We will see if, indeed, he might find more legal punishment. Joining us now to talk about all of this and more White House Bureau chief for the Washington Post. Great to see you this morning. Of course, lets setup the contrast here. While donald trump is raging and perspiring at that New Hampshire rally, President Biden is out west. Hes done a multistate trip talking about the economy, dedicating the national park, holding fund raisers getting ready for the upcoming general election, but he and his team have been frustrated that their message on the economy hasnt been breaking through. Talk to us about what theyre trying to do to deliver that message. The easiest way for President Joe Biden to get on all these shows and get coverage would be for him to come in and mock whats happening to donald trump. Its a historic thing happening in our Justice System and political system, but hes not commenting at all on that and instead hes wanting to focus on it economy, and its not at all surprising he wants to focus on a positive message. Its been about a year since he signed his landmark legislation, the Inflation Reduction Act and were starting to see bills start to be implemented and have an impact across the country, and he wants people to focus on those things focus on the new things happening but instead its hard to get focused on that. And when you look at the polls its not clear hes getting much economic benefit from the things happening in the economy. Theres a bit of frustration in the white house they cant comment on trumps legal issues for a number of different reasons. And instead of getting any kind of attention to what President Biden is doing seems like most of the attention is going to his groundbreaking legal case involving former President Trump. Yeah, biden has been clear he wants bright lines between the white house and Department Of Justice. How sustainable is that . Maybe the president cant talk about it, but at a certain point he should empower some surrogates to do so. What do you think . Yeah, theres an issue of not commenting on an ongoing legal case, which is an longstanding practice in politics. But theres also this issue of a president being required and expected to defend democracy. This case is not about hush money or about documents found at maralago. This is fundamental case about the status of american democracy, the attack on the countrys democracy back on january 6th and everything that led up to it. President biden has talked about these things in the past. He built his campaign on the idea of restoration of normalcy. For him to be silent on this does ring different how hes carried out his presidency in drawing that contrast between autocracies and democracies and his predecessor and himself. But because this is a case involving a political candidate, involving his predecessor and top rival for a 2024 race, he feels like his hands are tied. So there are a number of democrats saying at some point youre going have to comment on this. Even if youre not commenting on the direct case involving former President Trump, you need to talk about democracy and talk about the fact all these allegations about the former President Trump, how this is sham trial and how hes trying to lock up his political enemies are not true, and this is how the legal system is supposed to work. If he doesnt say that, it does leave a void for trump and his alhighs to feel all kinds of Conspiracy Theories and attacks. You make a smart point in your piece titled the country lacks a unified voice in the aftermath of trump charges, reiterating weve never been here before and previewing the sharply divided and bitter election on our horizon. According to the New York Times District Attorney fani willis is expected to present evidence to a grand jury and seek indictments. If granted it would be the fourth indictment of former president. Earlier this week former georgia Lieutenant Governor jeff duncan, a vocal opponent of trumps election Conspiracy Theories, he spoke about his desire for republicans to move on from trump in an interview he did this week. As a republican i sit here just really, really worried, right. I sense this anxiety of time is going to run out. Sitting members of congress, republican governors around the country are going to have to ban together and call for President Trump to step aside. These are serious charges that we can act like theyre not, we can listen to misinformation and 10 second sound bites but at the end day were talking about hiring the next president of the United States. And if donald trump is our nominee itll continue to be joe biden for four more years. I think republicans like many other people in Donald Trumps past are going to regret being associated with him. Three other subpoenas in this case were also handed out in recent days. We turn now to another significant story this morning. This one out of ohio where voters overwhelmingly rejected a republican backed measure that would have made it more difficult to change that states constitution. More than 3 Million People went to the polls in ohios special election voting to defeat what is known as issue one, which keeps the threshold for passing future constitutional amendments at a simple majority rather than the 60 Super Majority that had been promised. As of now 57 voted against the measure while 43 voted to support it. Voters delivering a crucial victory ahead of novembers vote on enshrining Abortion Rights in ohios state constitution. President biden celebrated after issue one failed. He released a statement that reads this. This measure was a blatant attempt to weaken voters voices and further erode the freedom of women to make their own health care decisions. Ohioans spoke loud and clear, and tonight democracy won. And i will add it certainly shows yet again what a powerful electoral issue abortion is as we start looking at 2024. Meanwhile, republican president ial candidate nikki haley is offering some slight criticism of her gop colleague, senator Tommy Tubberville for his ongoing blockade of Military Promotions. In an interview with Hew Hewitt Haley tried to play it down the middle saying she also opposes the pentagons Abortion Policy that provides paid leave for Service Members and reimburs them or their dependents for travel related expenses. It does not pay for, we should note, the actual procedure. But haley whose husband is currently deployed overseas also said that the lives of military families are in limbo because of tubervilles hold. The department of defense shouldnt be doing this in the first place, but theres got to be other ways to go about doing this. In a time where our recruitment is 25 down, and 80 of those recruits typically come from military families, and military parents are telling their kids not to go into the military, its because they dont feel like anybodys got the militarys back. They look at the fact that 33,000 veterans are homeless. They look at the fact theyre dangling these promotions out there and using them as fodder. Theyre looking at the fact people dont see these Men And Women who serve as heroes anymore, and thats sad and its terrible. And i appreciate what tuberville is trying to do, i do. Its totally wrong the department of defense is doing this, but have we gotten so low this is how we have to go about stopping it . As a reminder senator tuberville of alabama has single handedly stalled more than 300 Military Promotions since february, and hes showing no sign hell end the hold despite growing pressure from fellow republicans in congress. In an interview with fox news earlier this week he was asked about all this. And his answer, frankly, did not make much sense. Its a very extreme policy, and its a policy that weve had for 40 years that was voted on by joe biden in 1985 that we put in. The military has had no problems with this, rape, incest, and health of the mom, and its worked great. And i asked the Briefing Committee about a month ago give me your problems with this. Have you had complaints . Theyve had zero complaints in 40 years from the military. So its very extreme. Look, ive got a hold on these nominees, but they can push through these nominees one at a time. Ive only got holds for groups of them at a time. Ive got a hold on every one of them and they can bring them to the floor any time, but Chuck Schumer doesnt want to work. Okay. Thanks for being with us. Florida governor and 2024 white house hopeful ron desantis is once again shaking up his Campaign Leadership team. Desantis is bringing in his long time Chief Of Staff as his new president ial campaign manager. This comes as the governors allies pushed for a change at the top of the campaign due to lagging poll numbers and the upcoming republican primary debate just a couple weeks away. Just last month the Desantis Campaign fired more than 40 merse of its original staff because of concerns about how fast money was being spent. The governors Previous Campaign manager will stay on as a senior advisor. The new one has no experience running a campaign anywhere near this size. Joining us now to talk about this and more, National Politics reporter for the hill julia manchester. Great to see you again. Another campaign shakeup. This has been sort of a slow bleed for the Desantis Team in recent weeks. You wrote about it for the hill. Tell us the early thoughts as to why this matters and will it make any difference. Yeah, jonathan, i think a lot of republican sources inside and outside of florida are telling me Desantis Campaign is essentially trying anything and everything to see what works at this point because right now what theyve been doing isnt helping him gain traction in the polls. And i had one republican source tell me that its not that donald trump is getting stronger even though he is, but whats also important is that a number of other republicans running are starting to gain some traction. Not particularly in the polls. Weve seen its remained relatively stagnant, but theyre getting some big donor interest, and i thought it was notable earlier this week when you saw one of desantis biggest donors, roy bigalow, said hes consider stopping donating to the Desantis Campaign if desantis didnt take a different approach. Prior weeks ago he wasnt necessarily sitting down with mainstream outlets. However, he sat down with nbc news, cnn, and notably said earlier this week and acknowledged in his most definitive terms that donald trump lost the 2020 president ial election. So it definitely marks a bit of a messaging shift on his part. Hell see if it works but im curious to see how that plays with the hard core very much promaga make America Great again conservative republican base. Yeah, and so many republicans try to dodge the issue of 2020 their response is, well, whoever puts their hand on The Bible On January 20th Is president. Desantis did go a step further and actually acknowledge trump lost, and that does seem like a slightly more aggressive tact with him and trump. Preview for us briefly, if you will, what else is planned . Yeah, look, a lot of republicans behind the scenes have been calling for desantis really to go on a more aggressive approach against donald trump to stop doing this trump without the baggage approach, push him to be more aggressive sort of carve out of his own lane against the former president. We could start to see that happening right now with those comments about january 6th. I think its notable this also happens just a few weeks before the first president ial primary debate. Its unclear whether donald trump is going to show up or not, but rals ron desantis will be target number one. Theyre going to be want to vie for that second place spot. And on the other side of it you have donald trump whos been hammering desantis this entire campaign. So desantis is going to need some sort of aggressive messaging to push back on that. Julia, lastly, we want to return to burnf our other top stories today, the result in ohio. It was cleary a proxy battle for Abortion Rights. Give us a sense youre getting from republicans, democrats alike how this continues to almost guarantee abortion is going to be such a driver of next years election, too. I think in a state like ohio which for all intents and purposes is red state, jonathan. You only have one statewide elected democrat, senator Sherrod Brown, standing in ohio. And then you have this major victory for people on the Abortion Rights side of the aisle, the democrats. And i think this definitely bodes where democrats feel it bodes well for them going into the midterms especially in a state thats going to be difficult for democrats with the senate and president ial levels. So democrats very much preparing to continue to hone in on abortion as a major issue. Yeah, its another defeat in a republican leaning state for those who try to restrict Abortion Rights. This is really just a reaction to what happened a little bit earlier this year, what we saw out of the Banking Sector, particularly the likes of mnt bank, webster financials, those were getting downgrade at least one notch on the back of how things had looked for regional lenders earlier this year. But some of the bigger banks and even Northern Trust have also taken a bit of a hit only because theyre now on review for a possible downgrade. More than 60 Million People from arizona to florida are currently under an excessive heat warning. The Washington Post is predicting that dallas, new orleans, phoenix, and orlando will be among the hottest cities this week with heat indexes as high as 115 degrees. The National Weather service is now recommending people stay in airconditioned places, drink lots of water, and wear light, loosefitting clothes. Joining us now nbc news medical contributor dr. Ven gupta. Great to talk to you again. Its been an extraordinary summer of heat around the world but certainly here in the United States. What are some of the Biggest Health concerns as this record breaking heat wave continues . And do you have any other advice to add how people should try to protect themselves . Jonathan, thank you for always highlighting this vital story, something we need to be talking more about. At first the problem here amongst the highest Risk Counties across the country southwestern florida. We know 45 of vims in those counties, that part of the country are underinsured or uninsured. 18 are high risk senior population. Thats important because we know the most vulnerable are often the ones who dont have durable health care systems, dont have hvac systems in their homes. What weve seen in places like phoenix, places like houston, to answer your question about health risks here is the traditional rise in er visits. Upwards of 50 increase, jonathan, in places like uc methodist, as a result of heat exhaustion, traditional heatstroke. But now were seeing new evidence an additional link strongly between prolonged exposure to heat and disease conditions like dementia that we previously didnt realize existed. And even more research between heat and premature aging but a lot still to learn. Were going have to learn and learn soon with the growing impact of climate change. Dr. Gupta the other health story were following, covid19. To be clear this is not a surge this summer, at least not yet like previous summers, but cases are up, hospitalizations are up across the country, so give us an update. But then secondly tell us as we head into the fall what americans should be doing, the young, adults, the elderly, what should we be doing in terms of vaccinations . What should we be receiving and when . Well, thanks, jonathan, for that critical to stay prepared for the fall and winter here. Where are we . Were about 9,000 hospitalizations across the country from covid19. Lets give some context here. What does that mean . In january this year were at 45,000. Were 20 the level the worst weve seen from covid so very different reality than say prior summers to that, 2020 and certainly 2021 when it was a lot worse. The highest hospitalizations weve seen is over 100,000. So things are a lot different right now. Thats good. Were seeing some new variants, we arent talking a lot about it because frankly the existing vaccines protect against it. It continues to be more contagious, and so very transmissible here. Existing vaccines still do work. When it comes to vaccines here for you and your love ones, for everybody watching, really important to recognize that the fdas going to have a new set of vaccines out against some of these newer variants probably middle of september. If you are able, this existing evidence does suggest if youre able to space out the vaccines, probably that might be the straltagy here. Thats what i recommend to my patients, two weeks between vaccines say flu and covid. You can get them together. Theres no safety risk if you were to get them together. But if you are able to space them out and make a few trips to the pharmacy or clinic it is preferred here. A twoweek delay between the vaccines here starting midseptember, though. Officials in ukraine are accusing moscow of targeting Rescue Workers after two strikes hit residential buildings in the city of Eastern Donetsk region. According to ukraine president , volodymyr zelenskyy, the strikes killed more than nine people and 80 others were injured. Ukrainian Authorities Say many of those wounded were Police Officers and Emergency Workers who had rushed to the scene to assist residents. Images there of pure devastation. Else with whereby President Biden says he might travel to vietnam soon. He made that somewhat surprising announcement during a fundraiser in new mexico yesterday. Now, last month, biden said the Vietnamese Leader told him he wants to meet during the g20 summit, which is being held in india next month. The two spoke over the phone in march. The white house said the leaders discussed expanding the two countries relationship while also discussing regional issues. The move is likely to be seen as a show of some power and influence as the United States tries to counter chinas reach in that region. President trump, while in office, went to vietnam twice. No official dates have been set for that trip. As of this morning, its unclear when it would take place. But certainly, vietnam on the mind of this administration. It seems to me that its more a campaign of terror from Vladimir Putin going after these Rescue Workers. But it comes against the ukrainian counteroffensive. Now, weve talked to you a number of times in recent weeks, and youve been pretty optimistic about where it would go. But reports so far say its been pretty slow progress. Whats your assessment . Where do you think things stand . Lets start with tactics. You can sum them up in one word. Its terrorism. This is the type of thing that al qaeda or the Islamic State used to do routinely. Plant one bomb, attract all of those marvelous, heroic first responders, boom, second bomb goes off. Thats a war crime on a stack of other war crimes from attacking ds from bombing civilian infrastructure, torture chambers, rape rooms, you name it. Therell be accountability for this eventually, it is terrorism. From where things stand down, theyre going slowly, admittedly. And i would attribute it to three things. One is that defense is always harder than offense, in any military operation. We say defense is to offense as three is to one. Russians had a lot of time to dig in. Its taking time for the ukrainians to overcome those defenses. Secondly, i would say, lets keep it in perspective. Yes, its going slowly, but think where we were a year ago when russia had twice as much territory as they currently have. Ukrainians have taken back enormous tranches and were having a conversation about a campaign thats going slowly, but ill take that over where we were about a year ago, worried about, was kyiv or kherson going to fall. And third and finally, Silver Lining here, if it does grind along very slowly, i think in an obtuse way, that could raise the chances for effective talks. It would put pressure on ukrainians to talk. Theres certainly a lot of pressure on the russians because of all their losses. Its not a terrible thing. Having said all of that, ill conclude with this, my money is very much on the ukrainian military. All right. And it has been all along, admiral. We appreciate that. So lets turn to asia now. And in particular, where things stand with china. President biden floats this idea of potentially going to vietnam at some point in the future. Please weigh in on that. But also, our friends at cnbc send along this note, that the chinese economy has fallen into deflation. Another sign of potential weakness there in chinas economy. Tell us about what the National Security implications of that might be. Lets start with what a smart, tactical move it is for really a strategic move for the president , potentially, to go to vietnam. Vietnams a huge country. Ive traveled there many times. My father fought there in vietnam. The u. S. And vietnam, i think, have a powerful future together. That puts pressure on china and its also sending a signal, for example, to the philippines, who are on the Receiving End of a lot of bullying by china in that south china sea. So two thumbs up to the administration. I would push forward on that trip. The chinese economy is slowing. Thats concerning from a National Security perspective, because when autocratic regimes have internal problems, they tend to blame external actors. Look for china to wrap up, to ramp up incidents in the south china sea. Thats a problem. At the end of the day here, i think were going to see some announcements from the administration shortly, cutting back on investment in china, that will further exacerbate these tensions.
