Sources say the papers publisher, a close trump friend wouldnt have put out the piece without the president s permission. Is mr. Trump turning against Michael Cohen . Im wolf blitzer and youre in the situation room. Announcer this is cnn breaking news. Were following breaking news. The wlous is refusing to comment on the reported questions Robert Mueller wants to ask President Trump. The leak listed published by the New York Times and infuriating the president who falsely claimed in a tweet the questions did not include any on collusion. And also breaking, the president s former personal doctor is aku accusing the white house of robbery. Harold bornstein said a white house aide barged floor his new york office and stole mr. Trumps medical records. Well talk about the breaking news much more with senator ben cardin from the Foreign Relations committee and our reporters and experts are also standing by. First lets go straight to the white house. Our chief White House Correspondent jim acosta has the latest. The president is clearly irate that these mueller questions have now been made public . Reporter that is right, wolf. The anger is not going away. The president tweeted but it but would not talk about the leak that the questions special counsel Robert Mueller has for mr. Trump in the russia investigation. On the subject of collusion, when it comes to the president , there seems to be some confusion. No comment in the oval office, President Trump tweeted his frustration over the New York Times obtained more than four dozen questions expected to be asked by special counsel Robert Mueller in the russia probe. So disgraceful that the questions concerning the russia witch hunt were leaked to the media. No questions on collusion. I see you have a madeup phony crime and collusion that never existed. In an investigation with illegally leaked classified information. Nice. But there were questions that go to the allegation of collusion. Like when did you become aware of the trump tower meeting . That is the meeting held by the president s son donald trump jr. And Jared Kushner and Paul Manafort with the russian lawyer promising dirt on hillary clinton. The white house declined to weigh in. I would refer you to the president s outside personal attorney, jay sekulow and rudy giuliani. Reporter they didnt want to answer questions about Michael Cohen who suddenly appeared on the cover of the trump Friendly National enquirer, a possible sign a source told cnn, the president is turning against his longtime fixer. Asked what he thought, cohen told cnn, what do you think . The white house wont weigh in on cohen who appears ready to plead the fifth. I cant speak on behalf of Michael Cohen. I refer you to him. Reporter the president is trying to turn the attention from the russia probe to the meeting with kim jongun. I think it is probably going to be announced over the next couple of days, location and date. Reporter as he thanked the south korea president suggestion that he could win the nobel peace prize. I think it was generous of president moon. We want to get peace. Reporter but the white house is in damage control on another aspiring nuclear power, iran. After the administration asserted in an official document that these facts are consistent with what the United States has long known, iran has a robust Clandestine Nuclear Weapons Program and the white house changed the statement from has to had. We think the biggest mistake made was under the Obama Administration by ever entering the deal in the first place. The typo that you referenced was noticed and immediately corrected. Reporter the white house is not admitting any mistakes after the president s former personal doctor told nbc that his office was raided by aides to mr. Trump early last year. The medical records and pictures and anything they could find. They must been here for 25 or 30 minutes. Created a lot of chaos. I couldnt believe anybody was making a big deal about it a drug that is, to grow his hair, which seemed to be so important. And is certainly did not a breach of medical to say they take propecia to grow their hair. What is the matter with that. Reporter the white house denied it was a raid. As a standard preeting procedure for a new president , the white house medical unit took possession of the president s medical records. Reporter now as for the future of john kelly, the white house said he is not considered for veteran as fairs secretary and questions about kelly are swirling after it was learn the the chief of staff made disparaging comments about the president in the past. The white house insists the two men have a good working relationship and we should point out to our viewers back to the question of the collusion, it should be noted that the white house the president is still doing doctoring of the truth. The Mueller Investigation is still not reached a conclusion on that subject of collusion. Fair point. Good work jim acosta at white house. Lets take a closer look at questions special counsel Robert Mueller wants to ask President Trump. Our justice correspondent Jessica Schneider is here and youre getting new information from your sources. That is right. Our sources are telling us at cnn that the special counsel investigators have outlined nearly 50 questions to the president s legal team. And their scope is wideranging and encompassing four major categories. Former National SecurityMichael Flynn and fired fbi director james comey and Jeff Sessions and any possible Russian Coordination with the Trump Campaign. And of course it is the last line of inquiry that goes to the heart of the collusion questions. Reporter the special counsel investigators are focusing in on several areas where they have questions for the president. Sources tell cnn the questions began taking shape in march when the president s legal team met with muellers investigators and took notes on the various topics the special counsel wanted answered on. Several of the questions focused directly on possible collusion, including what knowledge did you have of any outreach by your campaign, including by Paul Manafort to russia about potential assistance to the campaign . That is according to a list obtained by the New York Times paraphrasing the potential questions. Paul manafort was Trumps Campaign chairman during the height of the primary, leading up to the convention. Hes now fighting criminal charges filed by the special counsel including Money Laundering and tax fraud. You look at the questions, they demonstrate that the president has a lot of very difficult questions to answer and it shows that this investigation is ongoing with respect to russian participation and collusion with the Trump Campaign. And the ongoing efforts of the president to impede, undermine, obstruct or stop the investigation. Reporter the president called the release of the possible questions disgraceful, on twit on tuesday and falsely stated, no questions on collusion. When, in fact, muellers team is looking for answers related to possible collusion, including when did you become aware of the trump tower meeting that donald trump jr. And Jared Kushner and Paul Manafort had with a russian lawyer and others in june 2016, during a 2013 trip to russia, what communication and relationships did you have with the aguilar and russian government officials. Referring to his trip to moscow for the Miss Universe pageant he put on with russian billionaire and what discussions do you have during the campaign regarding any meeting with mr. Putin, since onetime Campaign Foreign policy adviser George Papadopoulos pleaded guilty to lying about his contacts with russians and emailed several high level officials during the campaign about requests from russia to meet trump. It is a witch hunt. That is all it is. There was no collusion with russia. Reporter trumps tweets lashed out even further. It would seem very hard to obstruct justice for a crime that never happened, witch hunt. Legal experts say that argument doesnt hold up. You absolutely can obstruct a crime that never occurred. Reporter the obstruction of justice angle of the Mueller Probe is clear in numerous questions asking for the Details Behind the firing of Michael Flynn and james comey and the uncertain status. Did you discuss whether mr. Sessions would protect you and how was the decision made to fire mr. Flynn on february 13th, 2017. Regarding the decision to fire mr. Comey, when was it made and why and who played a role . The official justification for comeys firing was his handling of the clinton email probe. But the president acknowledged russia played a part in a tv interview days later. When i decided to just do it, i said to myself, i said, you know, this russia thing with trump and russia is a made up story. Reporter the questions touch on a long list of Trump Associates and government officials, including Michael Flynn, james comey and Jeff Sessions as well as then cia director and now secretary of state mike pompeo and Reince Priebus and fired fbi director andrew mccabe. So the questions still looms, will the president sit down for an interview with the special counsel. Now you remember it was back in january when President Trump said he was looking forward to to and would do it under oath but acknowledged he would have to follow the advice of his attorneys. He did most recently address that exact issue again on thursday in a wideranging interview on fox and friends. At that point he said he could talk to mueller, but then argued that muellers investigators were conflicted because of their contributions to politicians in the past. However, wolf, President Trump made this argument over and over again but it should be noted that some of muellers team they have donated but both to democrats and republicans. Good point. Thank you very much. Lets get more on all of the breaking news. Senator ben cardin of maryland is joining us. Hes a key member of the senate Foreign Relations committee. Senator, what stood out to you from the list of questions . Well, wolf, it is good to be with you. I think the questions they are asking are the ones you expect they want to have the answers. There is a lot of information about different People Associated with donald trump and their connections to russia and their connections to the Mueller Investigation. So what mr. Mueller investigators want to know from mr. Trump is his relationship to those individuals and to those with relationships with the Mueller Investigation. Do these 49 questions tell you anything about where muellers investigation might be headed next . Well, hes clearly looking at the relationship between associates of donald trump and russia. As to how the connections were made. And what mr. Trump knew about it. And when he knew about it. Hes also concerned about how individuals affected the investigation. Certainly with the comey firing and other issues, they want to know how mr. Trump was engaged in those issues as to whether hes trying to affect the investigation. So i think they are pretty clear that their concerned about russia engagement with Trump Associates and the progression of the investigation on whether mr. Trump was trying to influence that investigation. The president tweeted this, and ill put it on the screen, it would seem hard to obstruct justice with a crime that never happened. Witch hunt. And legal analysts disagree but it is true, as of right now the department of justice said that a sitting president cant be indicted. Should that standard change . Well, no one is above the law. And Everyone Needs to be held accountable and make sure the Mueller Investigation is able to complete its work without interference. So no, no one is above the law. Obstruction is a pretty clear offense. It is well defined. Well see where the investigation goes. But whether the president of the United States or whom ever you may be, you are subject to the laws of this land. Because the argument is it shouldnt be up to the department of just tois make a decision and there is an impeachment process of the house of representatives, a trial in the u. S. Senate. In that regard, the president would not be above the law as you say. What do you say to that argument . The impeachment process is within the purview of the congress of the United States. The criminal investigation are within the department of justice. And it is independent format. That investigation must meet its logical conclusion. And no one is above the law and Everyone Needs to be held accountable. Lets move to another important topic, senator. The president said the location of his upcoming summit with the north Korean Leader kim jongun will be announced in the next few days. The president seems intrigued by the idea of holding the meeting along the Demilitarized Zone between flork between north and south korea. And he said peace on the border be a more representative and important and lasting site that than a third party country. Just asking. What do you think . Is that a good idea . Well i have been to the Demilitarized Zone and its a neutral site. It is truly a place where you could meet directly on the border between north and south korea. So it is a neutral site. Im not so concerned about the venue of the meeting, but the substance. The diplomacy is our best chance, our only chance to resolve the Korean Nuclear conflict in a peaceful manner. So were root for rooting for. We want to see the president succeed and the flukt crisis end and diplomacy is the way to get there and we hope the venue is not a controversial issue and get the parties together and not just the United States and north korea and south korea, we also need to engage china and other allies in the region. So it is it is very important meeting and it is going to be challenging. Lets make no mistake about it. Certainly will be. Senator, thanks for joining us. Thank you, wolf. Ben cardin of maryland. There is more breaking news. Were following new details of the tabloid cover story that could be a warning for President Trump to his longtime personal lawyer, friend and fixer, Michael Cohen. Stand by. Hes got legs of lumber and arms of steel he eats a bowl of hammers at every meal he holds your house in the palm of his hand hes your home and auto man certainly will be. Stand by. Big jim, hes got you covered great big jim, there aint no other so, this is covered, right . Yes, maam. Take care of it for you right now. Giddyup certainly will be. Stand by. Hi this is jamie. We need some help. buzzer olly. More breaking news. A possible sign of a rift between President Trump and his longtime personal lawyer Michael Cohen. Cnn is working this story for us. Brian, there are questions about a tabloid cover story targeting the man known as the president s fixer. A lot of serious questions, wolf. Tonight Michael Cohen is under some serious legal pressure. And the questions center over whether cohen will flip and on the president and cooperate with prosecutors or whether he already has. That could be a key reason why mr. Trump and a powerful ally in the tabloid media seem to have fired a warning shot at cohen. It splashed all over the nation enquirer, the secrets and lies of Donald Trumps fixer, inside of the tabloid, a rehash of the hush money to Stormy Daniels and Karen Mcdougal and other cases where Michael Cohen has allegedly cleaned up after his boss. A source close to President Trump tells cnn, just the publishing of that enquirer story could be a strong sign that trump is upset with his personal attorney. According to cnn source, enquirer publisher david pecker, a longtime friend of the president , wouldnt have allowed it to be printed without the president s blessing. Someone in the president s camp has determined that mike kmooik that Michael Cohen is talking to the special counsel and that he might flip and this is a warning that the president could turn on his longtime ally. Reporter cohen is under federal criminal investigation nor months over his business dealers and Robert Mueller has sought documents and question witnessed about cohen. Hes under a tremendous amount of pressure. The fact that they actually executed a search warrant on his office, a lawyers office, very, very aggressive thing to do. Very rare that the Justice Department approves that. Reporter according to two Trump Campaign officials and federal election records, the campaign has paid more than 220,000 of cohens legal bills pertaining to the russia investigation. Trump recently tweeted he didnt think Michael Cohen would flip on him. But the president could still be distancing himself from his longtermtime confidant. Well, as a percentage of my overall legal work, a tiny little fraction. But michael would represent me and on some things, he represented me like with this crazy Stormy Daniels deal and he represented me and you know, from what i see, he did absolutely nothing wrong. Reporter for years Michael Cohen vowed to protect his clients no matter what. Hes a man of great intellect and abilities. But if he flips, what kind of damaging information would cohen have on the president . Hes been kind of his advanced man looking at the idea of building a trump to youner moscow so Michael Cohen has been someone who has cleaned up some of the rough stuff in the Trump Organization through the years. Whether it was paying off the porn star on behalf of the president , or going out and threatening reporters. What might the longterm consequences be if there trump and coen turn on each other . Legal analysts say this could start a downward spiral and President Trump could make comments to incriminate him and coen could violate Attorney Client privilege and when asked if the nation enquirer was sernding a message and he said what do you thixt and we heard from the publisher of the National Enquirer that call the characterize is on the story of mr. Cohen would not be printed without president s blessing, they call that ridiculous and absurd. Wolf. Michael cohen is now facing some questions about unpaid taxes. A lot of them, right . That is right. Cnn identified 16 taxi medallion companies owned by Michael Cohen or members of his family. Cnn analysis of the companies shows they owe more tan 280,000 in unpaid taxes. Cnn has reached out to cone for comment. He hasnt gotten back to us, but bloomberg, which first reported on this said cohen claims that he does not owe those taxes and that a wealthy taxi magnate in new york named evgeni jean freed plan is responsible for the payments. Well continue to work this part of the story. There is more breaking news were following. Earlier this afternoon over at white house, the president secretary sara sanders avoiding inquires about the questions of Robert Mueller and the president to answer and the president took to twitter to call the leak disgraceful. And lets bring in our correspondents and analysts. Laura what, stands out in your mind from these 49 questions . Self inflicted wounds, wolf. All of these questions circle around what the president has tweeted, has spoken about, has alluded to, has insulted people of a variety of ways and now it is coming back to haunt him. I find it ironic to call it disgraceful but it is a composition of the things youve said and in the Public Record and mueller would be inquisitive about the things you said and your motivation and intent and why and it answers all of the why. The one thing you cannot get from any other evidence is what the president s motivation was, what was the state of mind, especially when it comes to obstruction cases. Susan, do these questions reveal where muellers investigation is heading . They confirm that mueller is interested in russian interference in the election and whether or not flynn in the trump camp assisted in that effort and any obstruction of justice question. There isnt new information there. Legal commentators suggested these are the kind of questions you might ask if you already had evidence of some kind of criminal conduct. There is a risk of overreading here. Muleler only get one shot in interviewing the president if he gets that. So they are going to want to be thorough and leave no stone unturned and the fact some questions arent here, particularly those related to trumps finances. Just because they are not in the list dont mean they are part of the interview. You could ask the question and he could give an answer and you could do a followup. And these are topline topics. They arent the verbatim questions and not necessarily a complete list. Do you think it would be wise for the president to sit down and have an interview with Robert Mueller and his team . If he was watching television today, every single lawyer said if he was my clients, i would not let him sit down. And you have to wonder, one of the things we cant forget about these questions is that Robert Mueller gave team trump these areas and these questions in order to try to convince them it was okay to sit down. That was what was behind it, originally. However, as we know, the president has a tenuous hold on the truth and a very tenuous hold on consistency. So perhaps one of the motivations for this coming out now is his lawyers are saying, reminding him, maybe this is not so good. They have to make a decision because it looks like mueller is beginning to move towards a conclusion in this investigation. Well see if that happens. And bianna, the president was pretty angry about the leak to the New York Times. This is what he tweeted. So disgraceful that the questions concerning the russian witch hunt were leaked to the media. No questions on collusion. Oh, i see. You have a madeup phony crime and collusion that never existed and an investigation begun with illegally leaked classified information. Nice. That is the president s tweet. But it isnt exactly true because there were several of the questions that clearly revolved around collusion or cooperation or conspiracy between the Trump Campaign and the russians . That was actually an entertaining tweet for a number of reasons. Because there is speculation about where that leak actually came from. These questions may be closer to the president than hes willing to admit. And to be fair, there were 49 questions, maybe he didnt get to question 45 which said, which knowledge what knowledge do you have about any outreach by your Campaign Including your Campaign ChairmanPaul Manafort to russia about potential assistance. I think most people would read that that implies any sort of potential collusion with russia. So that question is laid out bare right there and obviously this is a question and issue that had been discussed now for months. So none of this should be a surprise. And as you said, the president said this is wrong, this is clearly written in one of the questions. Certainly is. And laura, my own suspicion and yours as well, the mueller team, theyve collected so much information. They probably have the answers already to all of these questions. Theyre trying to determine if the president sits down and does an interview will he commit perjury. And that is true. No good prosecutor would ever really ask a question they didnt already have information to support what answer they expected. That is the number one thing but it is all about incentive. Both President Trump and muellers team have an incentive it come together and have a volunteer sitdown. Why . If your trump, you want your lawyers there, they cant be there in a grand jury to rein you in and muzzle and the parameters of the questions they ask. If you are mueller, you have to be hoping the president of the United States would not simply thumb his nose at a grand jury subpoena and would not require you to hold him in con contempt and there has never been a request to say hold the president of the United States in contempt. So both have an incentive to come together and you may see the category information that says, look, can we make this work, in the back pocket is a grand jury subpoena, and it is a strong one, only if the Court Supports it. Susan, the Deputy Attorney general Rod Rosenstein overseeing this investigation, he was asked today if a sitting president could actually be indicted . This is what he said. Im not going to answer this in the context of any current matters. So you shouldnt draw any inference about it. But the department of justice has in the past when the issue arose, has opined that a sitting president cannot be indicted. Does this reluctance by him to answer that question tell you anything specific about where this might be heading . I dont know that if provides any hints. We expect Rod Rosenstein to be careful. Hes referring to two memos by the office of legal counsel, one in 1973 and in 2000 and found the sitting president could not be indicted. Those opinions are binding on all Justice Department officials. There is an open question, a minority view belief maybe this isnt binding on the special counsel office. So the most interesting question here is really, whether or not Robert Mueller believes that he is bound by these legal questions, these legal decisions or whether or not he thinks actually he can answer that question for himself. Deputy attorney general responded to the threat of impeachment that House Republicans are putting forward and said the department of justice would not be, in his word, extorted and that he wouldnt let threats have an impact on how he does his job. What does it tell you about his state of mind . I dont think he ever imagined that he would be in this position. He is known to be apolitical and professional and competent and worked for five different d president s and when george push left he was one of three u. S. Attorneys that stayed over for that obama kept. So i think he is stunned to be in this situation and sort of shrugged it off and used humor and said they even leaked their drafts. So i think hes trying to keep it in context. Thank you. Ladies there is more we need to discuss. Everybody stand by. Cnn has just spoken with President Trumps former doctor. Breaking news, the president former personal doctor is accusing the white house of stealing the medical records from his medical office. Our correspondent Alex Marquardt is in new york. I understand you just spoke with dr. Harold bornstein and what did he tell you . Reporter we spoke with dr. Bornstein outside of his park office here a couple of hours ago. He told us in no Uncertain Terms that he was robbed. I asked him point blank, was a crime committed and he said, they stole them. Referring to President Trumps medical records. The they are two men, first is keith schiller, the long time bodyguard and the second is someone by the name of allen garden, an attorney for the Trump Organization. Now dr. Bornstein is telling us that normally in these situations, when medical records are handed over that a release would be signed, known as a hippa release. He told us that had not been signed. Instead, he said, they barged through the back door, terrified the secretary, pushed aside the patient who was in there. So very dramatic account from dr. Bornstein which the white house disputes. They do not dispute the fact that they came here to take control of the president s medical records. But they do dispute the fact this was a raid. They said this was standard proceeding procedure for the white house medical unit to take possession of the medical records. Dr. Bornstein said they could not be farnl farther from the truth and hes been waiting for a year and this allegedly took place in february of last year and how would you care if you cared for someone for 35 years and they came and raided your office. So dr. Bornstein bornstein is alleging that a crime was committed. We checked with the nypd and they say that no Police Report was filed. Wonder why he didnt file a Police Report. But that is an interesting question. Thanks very much for that good reporting. It is a very bizarre story. Was a crime potentially committed . Laura . Bizarre isnt even the word for what is happening here. But, yes, if you rob somebody, that is a crime in the general sense of things. If you say you have a justifiable reason, based on white house protocol, well look into that. But generally speaking, the medical records belong to the provider. The content in the medical records belongs to the person getting the treatment and they could have access and copy it and trans and to take it and remove it is a violation because of the hippa clause which seem e seeks to protect team and privacy of medical records. So trump didnt take his medical records, it was a surrogate or proxy and if that wasnt signed over by hippa, any reasonable doctor would say this is a violation of hippa and would report it and that the fact that he didnt report it as odd and would he not alert the authorities of the president of the United States activity. Susan, is it too late for the doctor to notify local police and say i was robbed a year ago . It is certainly bizarre. Particularly if President Trump himself is not sort of concerned about this. The white house is saying that this is ordinary process. It is not surprising that the white house would want to take possession of the president s sensitive medical records that would be a security vulnerability. But everything about this process seems utterly bizarre. That said, if we go back to sort of february of last year, that post the postinauguration period, things that were occurring without resort to process maybe it is not surprising that this was going on. Apparently the white house the president wasnt happy that New York Times interview that the doctor gave that one of the prescription drugs, propecia, helped hair grow. You never know what is going to make him sensitive. But hair is certainly one of the things you can count on. There are three sides to every story. His, hers and the truth. I think were getting pieces here and there. What is true, im told, is that the doctor,s sa as you said is supposed to keep the original. Patient could get a copy. So at the very least the fact that everything disappeared from his office, whether or not an authorization was signed is unusual. Weve also heard one report that he didnt know how to work his copy much so he just gave it to them. But this is in the world of donald trump, this is not so unusual. And remember, this is the doctor who famously said if elected, mr. Trump, i can state unequivocally will be the healthiest individual ever elected to the presidency. And it was bizarre. Bianna give us some context. I can say, wolf, there are some names and some people that prior to the election we thought we continued to hear from. I can honestly say this was not one of them. I didnt think we would hear from dr. Bornstein, a 2. 0. But in this world, anything is possible. I will say there are a lot of Unanswered Questions had the white house reached out to dr. Bornstein first and asked for his records, had he denied that request . We dont know a lot of things here. But i can say, weve never seen this type of interaction about issues that seem to be rather mundane. What other president s former president s doctors names do you know off the top of your head and yet people seem to be coming in and out of our lives and become celebrities in their own right it doesnt seem norma normal but this is the new world we live in. And keith schiller, the bodyguard is now on the payroll of the Republican National committee so still working indirectly for the president of the United States who is the leader of the republican party. Stick around. There is some more breaking news were following. Details of the alarming new provocation of the United States military by a russian fighter pilot. Navy surveillance plane like this one and what pentagon sources are now calling unprofessional conduct by a russian fighter pilot. Lets go to our pentagon reporter, ryan brown, whos covering this for us. What happened, ryan . Well, wolf, a u. S. Navy p8 surveillance plane was intercepted by a russian fighter jet known as an su27 in International Airspace over the baltic sea. Officials originally described this intercept as being unprofessional but safe. The u. S. Navy not commenting publicly on intercepts, saying they will only comment publicly on ones considered unsafe, but this is in an area heavily contested between russia and the United States, where they monitor each other closely, both have forces in the region, there are many nato allies and the russians have a significant military presence as well. How common, ryan, are incidents like this . Well, these intercepts are fairly common. Unsafe intercepts are much less common. Youre seeing video from an unsafe intercept from january where a russian fighter jet came within five feet of a Navy Surveillance plane in the black sea. U. S. Officials believe that russia does this both to send a message to u. S. Military forces in the region, kind of indicate they see this as their backyard, but also to closely observe u. S. Activities as they fear that the u. S. May be gaining critical intelligence about Russian Military assets in the region. Whats the usual u. S. Response . Does it deter the u. S. From engaging in these activities that the russian clearly dont like . The u. S. Continues to say theyre going to fly, sail and operate anywhere international allows. The u. S. Is seeking to, quote unquote, desensitize russia to these types of surveillance flights so theyre going to keep this activity up in the hopes russia gets used to it.
