The senate is gearing up for a showdown this week over President Trumps nomination to the Supreme Court and it is a fight that could affect the court and the senate for years to come. For some analysis lets turn to our washington insider marc sandalow. Good morning. What makes this fight so monumental . Reporter good morning. You know, all Supreme Court nominees since they serve for life if they are confirmed are consequential. A year ago now Antonin Scalia died and there was an opening on the court. Merrick garland was nominated by president obama. The republicans did not have a hearing or vote. Once President Trump was elected, he put forward his nominee neil gorsuch so now democrats are saying, okay, fine, well filibuster. So a filibuster is coming and republicans say if you filibuster, we are going to eliminate the filibuster forever in the senate on Supreme Court nominations. Now, why is that more than just an inside washington process story . Because if the senate gets rid of this 150yearold tradition of filibustering, first of all, its going to affect the court for years to come because its only going to take a 50 vote threshold. Forget about compromising. Whoever the president wants if he has control of the senate will get into the Supreme Court. And how long could it be if they get rid of the filibuster for a Supreme Court nominee until republicans get rid of the filibuster for all legislation . So there will no longer be a supermajority required. Some people think thats a wonderful thing. Democracy requires 50 votes plus one. Thats perfect. Others claim the senate was supposed to be the softer, the cool, the worlds most deliberative body and if you only have a simple majority then legislation starts to pass too quickly. Its a showdown definitely along party lines. So marc, is either side likely to give in . No. Republicans say no. They are dead set on getting neil gorsuch on the Supreme Court. Heres what democrats have to decide whether they want to filibuster and they have to figure out. If they force republicans to use the nuclear option, which seems like an insanely overblown way to describe it. This is not nuclear war. Its not going to war. It just changes the procedure in the senate. Democrats have to decide if they push this to force republicans to use the nuclear option, they got donald trump in office, who knows for how long and he may make several more Supreme Court nominations. If thats the case and they get rid of the filibuster, the republicans on this nomination, they got nothing to use next time. So if democrats are going back and forth on this i can tell you Dianne Feinstein and kamala harris, california senators, both appear certain to vote in favor of filibuster. So as a matter of politics, who is the winner and loser in this fight . Reporter in the short term the winners are going to be the republicans and conservatives in that they will get a conservative replacement for Antonin Scalia on the court. But in the long term, this is exactly the kind of thing that donald trump complained about not that he is not pushing this now, but on the campaign trail, where it looks like a pox on both houses. You have republicans now hollering about how the president deserves deference to all the Supreme Court nominees but six months ago the same senators were saying, we have the votes to stop president obama from doing this. So why shouldnt we use it . The democrats, too. Ralph Waldo Emerson said a foolish consistency is the hobgoblin of small minds. Which is a pretty thin excuse for people of both parties simply grabbing whats most useful to them and if people like me try to explain theres a lot more in washington than simply political fighting, there are principles, there are passions people care about an argument like this makes it more difficult to make that case. Marc sandalow in washington, dc, thank you. A vote today on a measure to ban certain advertisements from bay area buses.
