Now ktvu janine della vega joins us from the apple headquarters in cupertino. Quite a fight going on, janine . Reporter there certainly is. And you know, tim cook, the ceo of apple, says apple has complied with search warrants and subpoenas in the San Bernardino case, and they have even provided apple engineers to advise the fbi. But cook says that what the government is asking for is just too dangerous to build. Yesterday, a federal judge ordered apple to build software that would help the government break into syed farooks iphone. Farook is one of the shooters who killed 14 people at a Holiday Party in San Bernardino last december. Now, the fbi has been unable to access data on farooks phone, because it is pass code protected. They think the phone may hold clues to who the couple communicated with and where they traveled. Cook posted a statement on his web site, arguing why apple should not help. Cook explains that by making software that breaks into the default encryption of a iphone, it would create a back door. He likens it to making a master key, that would potentially unlock hundreds of millions of locks. And now, cook says quote, the government is asking apple, to hack our own users, and undermine decades of security advancements, that protect our customers. And this moment, calls for public discussion, and we want our customers and people around the country to understand what is at stake. Now, just last week, the fbi director said encryption is a major problem for Law Enforcement, who find a device that cant be opened when a judge says there is probable cause to open it. And the ruling by the judge yesterday is a first of its kind and it is seen as a significant victory for the justice department. And this is really dealing with balancing privacy against National Security interests, so we are just going to have to see how this all plays out. We are not going to see the end of this for a while. Well, Berkeley Police are investigating the shooting of three teenagers who were still in the hospital, and ktvu fox 2ali rasmuss at the Berkeley Police headquarters. What is the latest . What do we know . Reporter well, according to Berkeley Police, it is pretty clear that the teens were targeted. They say it does not appear to be a random attack. What is not clear though is whether it is just one of the three teens who was shot was targeted or whether all three of them in the car were the focus of the attacker. Now, this shooting happened at 7 30 last night on a pretty residential street in berkeley. Parker near san pablo avenue in southwest berkeley. When Police Arrived they found three teens sitting in a car suffering from gunshot wounds. All three rushed to the hospital. Two suffered serious injuries. The third teen was described as nonlifethreatening injuries. Investigators are not certain whether the shooter was in another car or on foot. Last night, Berkeley Police canvassed the area and talked to witnesses and hoping anyone who saw or heard what happened would give them a call. It is going to take a while. They are going to have to obviously, there is a lot of people. A lot of calls came in. It will take some time for us to go through all of the information, and also, talk to the victims, if they are able to provide us with any information. And thats one of the questions we have for Berkeley Police this morning. Talking to the victims overnight, police have asked if they recognized or knew their attacker and find out more what may have prompted the shooting. Other things investigators are trying to figure out, whether the shooter was alone or part of a group and whether the teen victims lived on parker street, or in the neighborhood, or if they were just visiting the area. Later this morning, we are hoping to hear from Berkeley Police about whether anyone is in custody, or whether a person of interest has been identified in this crime. Local Authorities Say all of those things create risks, and along the biggest creek that runs through middletown. It has the potential and still has the potential to flood. We really anticipated a lot more debris flow, a lot more runoff, a lot more land slide activity. And those crews have put hydro seeding blankets on the hills that are most at risk. But they also know their town will never be the same. Despite warmer weather, the past few day, the sierra snow pack continues to grow. The California Department of Water Resources says the snow pack for the northern sierra, which stretches from the oregon border to lake tahoe is 99 of normal. And statewide, that number is slightly lower at 91 . But up to two feet of snow is forecast for the Higher Elevations today and tomorrow. And this is a lot better than last year. Last thursday. During the lunch break. And apparently, this was a girl from a neighboring Alternative High School who came here, to campus, and then beat up a boy, who attends this school, and he was not seriously hurt in this altercation. But the video of this attack has now drawn quite a bit of attention online. Hey, hey. Here is the video. Shared on facebook. And now viewed by millions of people around the world. You can see the girl drops the boy down to the ground, and then knees him in the face. Twice. And the video went viral over this past weekend. After it was posted on the Facebook Page of mma fighter kit dale. And by the way, i reached out to kit this morning, looking for a comment from him. And we will let you know what we hear about. After the assault, the girl who attended creek Side High School next door, she ran off, and a teacher chased after her. The district has asked facebook to remove this video because of the violent content but according to the district, facebook has declined to take it down. Now, in a statement, the superintendent here in sonoma says that we hope says quote, we hope that you as parents take this incident as an opportunity to remind your children about the acceptable use of social media and the responsibility that goes with it. And now, some people commenting on this video on facebook, have said that the boy who was assaulted here had been bullying other students. That not confirmed. And the district says that many people commenting on this video, online, their comments are inaccurate. As far as what prompted the attack. All right. Alex savage, in sonoma, thank you. The man suspected of a triple shooting at a Popular San Francisco tourist spot may be charged as early as today. 26yearold Richard Contreras is facing charges that include two counts of murder and one count of attempted murder. If prosecutors add in certainly circumstances like multiple murders, they could seek the death penalty. He is accused of opening fire at the scenic Twin Peaks Lookout last sunday morning. Killing 21yearold jewelo peraza and 19yearold renee mora. And critically wounding an 18 yearold man. We believe the three victims were targeted by the suspect. What the connection was, we dont know. We are trying to figure that out. And the motive for the shooting is still yet to be determined. Sources are telling ktvu, contreras has a long criminal record. And includes auto theft, evading police, and weapons violations. Police say in 2014, he was driving a stolen honda that crashed into an ac transit bus in richmond that slammed into a house. That bus barely missed a three monthold boy inside that home. Well, as Police Search for a motive in the twin peaks shooting, the father of one of the young men who was killed is talking about his familys loss. He wanted to join the army. He wanted to go to school. He held his plans in front of him. It is such a change, it is such a terrible thing. Now, renee mora senior says his son loved basketball. Soccer. And rap music. And the father says he is trying to stay strong for his wife and two other children. And he says he never heard of the suspect, Richard Contreras, and doesnt know why he would hurt his son. Mora says he finds little comfort that police made an arrest in the case because it doesnt bring his son back. Also new this morning, the city of almeda is a step closer to having a rentcontrol measure. Ktvu fox 2 reporter brian flores is live in almeda this morning and talking about the topic that is controversial and hotlydebated topic, for months, brian. Reporter no question about that, pam. Not just here in almeda, but really across the bay area where the issue of rent control remains a very heated topic. Here in almeda, the City Council Meeting talking about this rent control ordinance, started at about 7 00 last night, and went on until about 2 30 this morning. And from what we can gather, this almeda City Council Gave preliminary approval to a rent control measure. There still needs to be another reading of the proposal, keep that in mind, at another meet can scheduled for later. Meeting canceled for later. The last meeting back in november as you may recall led to injuries and even arrests. Last night more than 100 people spoke, either Property Owners or renters. We need very fair strict guidelines monitored and enforced to be able to make renters feel safe in their own homes again. That they are not going to come home to a 60 day notice. It is about time landlords and Property Owners are not demonized. Now, some of the details included in this proposed rent control measure, include a review process, by a rent control advisory committee. And for any proposed rent increases, and a no cause eviction, and it would require a landlord to provide some type of relocation assistance. And this was the approval of the First Reading of this ordinance, and again, another reading scheduled for another City Council Meeting, to be determined later. Pam, back to you. Thank you, brian. In east bay, a city, has now a ban on shortterm vacation rentals. And danville adopted a crackdown on what are commonly called air b b rentals, and last nights meeting was packed with people who wanted to speak out about the ban. Supporters of the ban says the rentals create traffic and parking problems and cut into visitors spending money in hotels and restaurants and proopponents say people should be able to do what they want on their property. And it was pass odd an 41 vote and danville will set up an agency to enforce the ban and handle the violations. It starts with a citation and goes upwards from there. Three within the span of a year, the fines increase. And then presumecally it could be pursued through the courts. The debates started after one Property Owner had a two story inlaw unit built by the neighbors fence and they say that has been used by more than family members and the family that built the rental unit says it will be only used by tenants staying a month or longer and it is still a legal rental. The Oakland City Council delaying any decisions about a controversial decision to allow train loads of coal to roll through oakland. Ban coal now. Ban coal now. Environmentists, community leaders, faith groups, rallied last night, in front of oaklands city hall before the council meeting. They opposed building a new shipping terminal at the old Oakland Army Base near the bay bridge, they say it would handle materials, including coal, mined in utah, that would endanger the community. We are against coal. Because of the coal dust pollution exacerbating asthma, and cancer and heart attacks. The City Council Members tell ktvu the Mayors Office asked for that delay. And the council was asked to put off a vote on hiring a consultant to study the health and the safety impacts of transporting coal. Now more debate is expected again in april. We have an update to a story we have been following for a while. A former San Francisco political consultant pled guilty to charges of possessing a biological toxin. And a gun with its serial number removed. The fbi says agents found bomb making materials and chemical weapons, at ryan chamberlains polk street apartment. Back in may of 2014. And after the apartment was searched the fbi launched a national man hunt for him. He was arrested days later. And chamberlain is sentenced april 12 and could get up to 10 years in prison. Ted cruz and marco rubio are fighting to frve to stay in south carolina. I have never seen a human being lie so much. Marco rubio voted to confirm john kerry at secretary of state. I voted against john kerry and donald trump supported john kerry and not only that gave money and supported him to be president. John kasich who came in a surprise second in New Hampshire has been adding some lastminute events in south carolina. Hoping to stay in the race. On the democratic side, Hillary Clinton and Bernie Sanders are courting African American voters. The Africanamerican Community suffered more and has recovered in a much less significant way. Senator Bernie Sanders spoke out about the economy at a Prayer Breakfast in south carolina. And the democratic primary is a week from saturday. And Hillary Clinton was in harlem, meeting with al sharpton and other civil rights leaders. I know very well that both my campaigns, but more importantly, my presidency, if i am so fortunate to be in that position, must reflect the thinking and the planning and the proposals people like you do around the state. It is 6 53. Mental Health Experts from the centers for disease control, they are now in palo alto, investigating a trend of teen suicides. Now, since 2009, nine teenagers have committed suicide, on the train tracks, near palo altos gun high school, and prompting the investigation into what Health Officials cau a rash of suicide call a rash of suicide clusters. For the next two week, the cdc mens, they will be meeting in private with the health department, the School District and community groups. One of the reason has we invited the cdc to come and look at this, is we wanted to look at it through a Public Health frame. The purpose of the cdcs visit is really just to help us look at patterns and trends, in suicides across the county. And particularly among youth. And now the cdc members will report to the county health department, after their two week visit. A Concord Charity is asking for help to get a stolen pick up truck back. The Monument Crisis Center says the truck is crucial to its work to help feed the hungry. It is used to carry donation barrels and food to and from the center. On monday night, someone stole it, from right outside the facility. And just before the theft, the camera caught a man walking up to the front of the building, and looking inside. And then you see the truck. Driving out of the Market Street parking lot. I want to find the truck. I want to hope that it is in one piece. So that we can go back to doing the work that we are doing. Concord police say they have seen a rash of truck thefts this year. Officers say 34 trucks have been stolen, in concord. And now, if you have information, you are asked to call concord police. Time is 6 55. Californias crab task force, is recommending the commercial fishing season only when the crabs are deemed safe to eat everywhere in california. Last thursday, the ban on recreational crab fishing was lifted, but just south of point reyes. The commercial season has been delayed since november, after higher levels of a possibly deadly noro toxin was found in the crabs. The California Department of fish and wildlife could make a decision this week, on whether to partially open the commercial season. Or just wait until it is safe along the entire coast. Crews at ocean beach in San Francisco are moving tons of sand from one end of the beach to the other. And returning some of the sand that is lost at the southern section of the beach near the zoo. The San Francisco puc says erosion is carrying the sand and depositing it about two miles away on the north side of the beach, where there is too much of it. The concern is that too much erosion could jeopardize an undergrounds sewer pipe that is feeding a waste treatment plant. Worst case scenario, a massive pipeline carries tons and tons and sewage and if that were to rup pure that, would go into the office rupture, that would go into the office.
