That retweet i mentioned at the top some conservative believes is the whistleblower has led to federal law. Led by senator Chuck Schumer over when impeachment will move from the house to the senate. Are you concerned pelosi will hold up the articles of impeachment indefinitely . Well, my poll numbers are the highest theyve ever been. Our fundraising in the Republican Party is the highest its ever been. She hates the Republican Party. She hates all the people that voted for me and the Republican Party. Clarifying comments he made to the editorial board. If he were to be subpoenaed to testify at an impeachment trial, he would not appear. You have to be able to have some knowledge whether or not he committed the officials he is accused of committing. I have no firsthand knowledge. My point is there will be no basis to an event that i could not have any impact on. A local person who had no idea what went on. As you point out, you dont think you have any relevant facts to bring to the matter. Ill read from a few tweets. He said in my 40 years of public life i always complied with the lawful order, cooperated with legitimate oversight requests. Im just not going to pretend there is any basis for my testimony in the impeachment trial. Garrett haake, let me start with you. We have this period when we dont know whats going to happen, when this trial is going to begin. In that vacuum, all of this starts to swirl once again. We are seeing the debate who might be a witness, who might be called to testify. The reality is the witness that is likely to play out, any four senators will decide whether there will be witnesses and 51 to decide who will be called. Theres an outside chance biden coulcalled. Republicans argued from the beginning here if you take the trump line that this was purely concern about corruption in ukraine, the bidens will potentially know something about it. The question is really are there 51 votes to appear at a Senate Impeachment trial. The answer is probably not. Does this become part of the horse trading democrats and republicans might have to do as they get into an actual trial. Will we want joe biden, mick mulvaney. Maybe there are back room deals that can many into this. Say your piece. Theyre not going to call me. Lets talk about health care. And move on. Right now we are stuck in this impeachment purgatory waiting to see what can be hashed out january 6th. Your synonym for purgatory is limbo. We are in this period when all of that seems to have stopped much we dont have a lot of new information on what happens next. I hate to say it but we are still in limbo. They are gone for a twoweek holiday recess. Well be back the first full week in january. So we really dont know. Senator Mitch Mcconnell and senator Chuck Schumer, the leaders need to gettogether to try and come up with a plan governing the parameters of the trial. If they cant do that, then it will be up to 51 senators to vote in some kind of resolution. 51 being the majority. Now, the question is will all the republicans go along . There are 53 republicans in the senate. So Mitch Mcconnell can afford to lose only a few of them if he wants to maintain control over and we are already seeing some republican what, maneuvering or dissent in the form of senator Lisa Murkowski of alaska who said she is concerned the way senator mcconnell is going about planning the trial in conjunction with the white house. So the bottom line is congress is gone for the holiday recess. We dont know how this trial will play out. And stay tuned until 2020 when we are going to find out. Stay tuned. Shermichael singleton, what do you make from what the senator of alaska had to say . Mild rebuke. And i think Mitch Mcconnell more than likely will give room pore some republicans who may find themselves in vulnerable reelection races next year to have those soft and mild rebukes. Sit not guaranteed they will vote that is in a way that is not beneficial to the president. I dont think Mitch Mcconnell, republicans or trump want witnesses. Politically, its not in his interest. I would advise him not to have witnesses. You want to rush this thing as quickly as you possibly can. Now, as far as ethics of this, he probably should have witnesses, right . Two different dynamics here. Do you want to follow the process thoroughly where you do hear from people with direct firsthand accounts of what occurred . Or look at the politics and say its not in the president s interest, lets try to rush this thing. I think the republicans will go with the latter of the two if they can. Are the means by which we get some sense of thinking during this holiday break is twitter. He doesnt have a lot of events. Hes spending his time in florida. He retweeted the name of somebody purported to be the whistleblower. This was a technical fluke. The tweet was up. Then it was down. A lot of news speculated that he took down the retweet. Twitter says there was a glitch in the system about it appearing, yet it remains there. Him playing around with this. As i said at the top of the show, people say he is violating the law but encroaching on what is anonymity for a whistleblower like we have. Well, first of all, aside from putting that individual in actual physical danger, because it does, it undermines our processes and institutions in the government. I can tell you this is from my government training. I was in the government for 12 years. When i saw this news, i went to cnn and there was an article that linked to something that i guess whatever article he originally posted. I couldnt click on it. I said, no, im not going to fuel this. I dont want to know this persons name. I cant. Its wrong. And i know that sounds crazy. Im out of government now. But thats our training. Its not right. Its not fair. Honestly, it makes him look bad. But it doesnt make him look bad in front of his base. This gets me to Speaker Pelosi, that plays into list base. Biden is right to say i dont have anything to offer to this. Im not the right witness. It will be nothing more than a political distraction for his campaign certainly. But at the same time they Speaker Pelosi needs to be very careful to make this the least partisan exercise as possible. Whats happening amongst the committees. It will move from the house to the senate. Is it still going to consume a lot of time . The short answer is no. A couple things are happening simultaneously. Pelosi is playing with house money. It will never start before january 6th anyway. She can say shes holding them or sending them. It doesnt really change. So the degree that it unnerves the president or might force the president to push Mitch Mcconnell in the direction democrats want him to go, this is all sort of house money for democrats until january 6th. Meanwhile, youve got court cases that are still outstanding, which could affect the trial. Or how the Judiciary Committee proceeds. There were questions about don mcgahn. Those have been outstanding for eight months. They are awaiting court decisions. John boltons charles kupperman. Yeah. There are separate investigative efforts that could be ongoing in the Intelligence Committee based on other information we might still learn about ukraine. Oh, by the way, theres federal criminal proceedings against Rudy Giulianis associates that could provide more information for impeachment trial down the line. So there are a bunch of gears turning simultaneously which informs the pelosi decision to say we can sit on our hands for two weeks and not affect this and just see how much Additional Information shakes out. You raised the spectre of a second impeachment. The council for the house saying that could happen. If as garrett says, we get more information, new evidence, they could pursue this once again. Well, it could happen. Frankly, id be surprised if it did happen. If you look how the first impeachment played out, a lot of democrats were very nervous about this, radio it . It took Speaker Pelosi a long time to come around. It took moderate democrats like slotkin a long time to come around. They want to focus on the Kitchen Table issues, health care and jobs and the economy that got them to washington in the first place. Frankly, i would be pretty surprised if in the runup to the 2020 election we went ahead with this whole exercise all over again. Honestly, i think democrats wanted to vote this impeachment and move on. And thats pretty much what we have seen them do. As you saw in the last week of the session, not only did they take the Impeachment Vote but they approved the trade agreement, passed spending bills. Great to talk to you. Thank you very much. Happy new year. Great to see you. Happy new year. The big fight that could pave the way to retake the house. Politics for men and women running for seats in the u. S. Senate. But first a show of force in the persian gulf from russia, china and iran. What that means for the u. S. T never bothered me. Until i found out what it actually was. Im david gura. Iran in the spotlight again this morning. This time for holding a fourday naval drill with russia and china in the indian ocean for the first time. Irans military leader speaking on state television they are not just about improving readiness. Hosting the powerst our relations have reached a meaningful point and may have an international impact. Such a gift to the iranian army for no reason. I find this entire thing fascinating from a National Security perspective. At first it doesnt make a lot of sense for the chinese and russians to engage in such a public drill with irans army. It doesnt make sense for their business goals globally. That doesnt make sense. It concerns me for a number of reasons. There are only two reasons. Given it is not in russia and chinas interest, only two reasons they could have done this. First, give the finger to the United States and say we also are a force to be reckoned with in this region. You are not the only power of influence here. So thats the first. The second is that they may or may not believe that iran is the side to place their bets on. That iran is the gaining force of the region. If they have to pick a sign they will go with the iranians. They are not arabs. It is very different. Although they are going to continue to try to explain their influence, they will not succeed in the end. So this is concerning because at the end of the day, were in a situation now globally in an us versus them type of world. And the last time we had it in the cold war, it just doesnt work for anybody. I would say the u. S. , what they need to do, is do well to partner with our allies better, President Trump. And us show a united front and the russian and chinese, this decision will bite them in the end. We have a statement from the u. S. Giving the Financial Times a statement saying iran should think twice about conducting joint naval exercises and it should concern all nations with an interest in safeguarding freedom of navigation in the region. I think it is interesting. To something you just mentioned about china and their economic interests, which we are seeing spreading throughout africa, our own backyard, brazil. They are Building Partnerships all over the middle east with the chinese Stateowned Bank which i think is very intriguing. While they are laying a foundation for the economics, you are now seeing china position itself more so militarily, more aggressively, more in the face of the United States. Whats intriguing to me about this, as the u. S. Policy of President Trump has sort of been to recede from our global position, you see china in many ways step up and saying china is the future maybe as we head into the next decade. That is something that is obviously not in the interest of the United States. When you think about russia under putin. Russia for a long time, specifically under putin, has always wanted to see a return to russian greatness. I think partnering with china, sort of taking irans back here repositions russia in a unique way i havent seen at least in a decade, arguably. This is something we need to pay a lot of attention to. I dont think we are. Right. I think china will arguably have an edge over the United States in the next 10 years and thats not something that is in our interest. Are being a drill like this, you heard the Remarkable Exchange about this Christmas Gift from north korea. To what degree is congress able to do anything about it. Here you have two leaders that the president has tried very hard to improve his own personal relationships with in xi and putin. Working with the regime that the president has been a traditional Foreign Policy policy hawk on iran. It may come from john bolton, other places. How does he respond to this and how do republicans in the u. S. Senate respond to it . Republicans in the senate traditional Foreign Policy hawks, tom cotton, Mitch Mcconnells to a lesser degree, these are three serious geo political rivals working in concert. The statement doesnt mention russia or china. What do you do when your allies are in bed with your enemies . Lastly, about this access between iran and russia, they note after this concludes on monday, zarif will meet with sergey lavrov, his counterpart, there. The Russian Partnership doesnt concern me as much. They obviously have some coordination there. The military inclement to the iranians. I had the same idea of the axis of evil. When i was in government working, one of the things we often saw when we sanctioned actors, nefarious actors would Work Together. It is common to see iranians, syrians and North Koreans Work Together for their business interests or banking because they c they count on each other. But to see iran with russia and china lends iran a whole other level of power. China doesnt need this at all. China buys iranian oil. But iran depends on them to do that. China doesnt need it. It doesnt make any sense. Its extra concerning because when you see partnerships like that, zarif going to moscow, again, thats not as new. But if you see china being more involved. Thats right. Im david gura. As we gear up for the upcoming election, redistricting will have new implications. The next census is around the corner. This is incredibly important in the south in particular. Texas and North Carolina it is expecting both parties will try to redraw Congressional Districts to their advantage. The Supreme Court declined to interve intervene. They said it is up to states. They halted a North Carolina law which requires voters to show a voter i. D. The pro director of the advancement project joins us. Help us understand this moment. Jergerrymandering is not knew. Redistricting is not either. What about this particular moment in time and whats at stake . Well, this is a moment where we are ready to have an allout voting war. We get close to an election. There are a lot of efforts to manipulate our democracy by politicians. This election is not just about trump. This is not just about congress. It is about who has power in this country. And in the Southern States in particular, what we are looking at is kind of the last stand of the confederacy and the fight for power in the south that will mean a lot for the next decades. So redistricting is not just a onetime thing, but it is about locking in power for decades to come. Shermichael, pick up on that if you would. This is something that has a long perspective to it. Census comes around every 10 years. It happens in cycles. A great piece was written by nbc news. It is so exact and effective. The map tkradrawers control of congress for a dec so much at stick here. Elections have consequences. Demography is just not on the. I remember i want to say back in 2010 when i was a College Student in georgia, i was aide to state legislator part of a redistricting process. It was very intriguing being there at the table, assisting with someone at the table, being a part of that process and learning the repercussions for those who dont win. With that said, personally, david, i think elections should be fair. And there have been some republicans in the past and some democrats who have tried to argue for maybe nonpartisan commissions set up to create districts. As my argument and it has always been run on the issues, run on your character, and allow people to vote. Allow the voters to make the best decision. If in an ideal world, we can have 50 republican, 50 democrat, i actually would love that. It goes to the interest of theg vote for people they believe will really do the job. But,again, to disenfranchise people, particumarginalized, it thus far. Going back to the demographic changes, where people are moving. Its clear, david, that that strategy just wont work forever. And youre starting to begin to see that in places like georgia, texas. Lets look at North Carolina in particular at some of the abstract articles you have seen when it comes to redistricting. This is steve schullers district for a number of years. That being redrawn. And we see how it was redrawn the last decade. You ha. Mark meadows. Help us understand the broader implications of this, what it means for those seeking reelection. Look, there is a battle between who gets do voters get to pick their candidates or do candidates pick their voters . While its very important in the south, particularly with the Voting Rights act amendment, you used to have to go to the justice department. Now you can do it more freely. Some Southern States take it as an opportunity. Not just the south. We saw redrawn maps in pennsylvania recently. And some look like a rorschach test. Extraordinary images that dont make since on any other political scape. Courts ruled that the federal government doesnt have a role in intervening in these maps. It has to be decided at state levels. A lot of state courts you have similar issues. They are working on similar issues. So this is a front line battle in democracy. And i think especially in high growth states like georgia, texas, arizona. You are seeing that in the sun belt. This will be the next 25 years. Do you characterize this as a war, how do you fight them . You look at what eric holder is doing. Where is the fight going to take place in the coming years . The fight will take place in the courts, as usual. Unfortunately the Supreme Court did get the Voting Rights act. We dont have the department of justice to go to before the plans go into place at the doj level. Court will be in federal court. The Supreme Court said the states have to take care of it. So the problem is that the republicans in some of these states where they already control, they get to stack the deck over and over again. And we understand that partisan gerrymandering isnt just about the parties. But there is a direct correlation to race. So for civil rights lawyers, were really on high anxiety about what is to come and how we will have to fight tooth and nail to change this. It means there are more people of color in the south. So we will have to fight state by state. Again, voters really can have a difference in this if they vote this election cycle, we could see changes that will even out the playing game. Ill give you the last word here. Yes, this will take place in the courts. You look at recent headlines about the composition of courts. One in four circuit nominees, at least a donald trump appointee. Right. We have been talking about the long game in redistricting. Heres the parallel story, long game involved changing the way the courts are composed in this country. The thing that gave me the most hope and the only one standing there putting down certain efforts by the administration that encroached on constitutional values. When it comes to this, i have to say as an independent i dont understand why partisan lawmakers at all are the ones who do this. The ones who draw the district lines. Theres no way they can do it objectively and without a political goal in mind. Each side its only getting worse, right . One side will do it worse. The other side will feel when i get in there, im going to finally draw in my favor, in the favor of my party or in the favor of my community. It doesnt do anyone justice. Im of a similar mind to you. An ideal system is where you have an equal group. I think a multiparty system would be better, but we dont have to go into that right now. There have been problems about states propose, havent caught wind, caught legs the way you thought they might have. Ohio is one of those places where people thought they were going to get an independent commission, but thats not happening. Because partisan politics continues to enter into the theme. So we will have to be vigil. Voters will have to get out there and vote to make sure that the people who are actually drawing the lines actually do represent their interests. Great to speak with you. As 2019 comes to a close, we look back at the decade that was, look at our lexicon. We added phrases like alternative facts, twitter explosion, and fake news. A sharp increase in hate crimes and division in the United States. In the sunday review of the New York Times, there were a bunch of essays on this decade of distrust. The biggest casualty of the decade was trust. According to a pew survey 17 of Americans Trust the government to do what is right. Most of the time or just about always. A fascinating series on the internet, our sense of faith and value. Your reaction and what has changed. I left government in 2016. I was a spokesperson. I know what happened. I worked on sanctions. I know this. People liar. Its painful. That is so not how my experience was. These articles summed it up. What we see happening with distrust of government and media as well, by the way, what you see in authoritarian countries. Russia, china, iran, zimbabwe. Dictators who often feed lies to their people. They dont trust the government or the media. Social media exacerbated that as well. I dont think this is the Silver Bullet that will fix it. But social media needs to be regulated the way banks on regulated. Is that the takeaway . How echo chambers have grown . Is regulation the answer . Maybe a little bit. Im hesitant to jump on that band wagon. There is a lacking of a sense of belonging, a sense of community. You are not just seeing it in our country. You are seeing it around the globe. That is sort of attributed to globalization. We are also like citizens. We are connect. We were talking about china as an example. How we are so codependent on one another. This idea of wanting to belong to this idea of an identity, where that identity holds, what that identity means, i think for a lot of different communities within our own country is starting to create a lot of discord. You have distrust in politicians and media institutions. And so i think if we cant figure that out, im not i guess confident that the future looks bright. I have to be honest. History shows that were going down a very, very dangerous path. One of the cool things in this section is this graph of whats happened here the last 10 years. A scale of madness from alex jones. David letterman show, the tea party. What have you seen about the erosion in truth, trust. What stuck out to me was Lance Armstrong coming clean that he had been doping. You cannot forget how culturally ubiquitous he was. This is the yellow bracelets that everybody wore. The reason people know what the word peloton means. He was absolutely everywhere and a beacon of hope, cancer survivor. Then it came out he had been lying for years about doping, cheating in a sport he put on the map in this country. It was a reminder this goes far beyond distrust in government. It is like every institution has lied to you. Sex scandals in church, sports figures lying about whether or not theyre cheating. Fundamental distrust in essentially everything. Its kind of overwhelming. And what color was the dress. People were obsessed over that. Were not doing a segment on this, are we . You can have two views on one fact. Sean spicer. Right. Its painful, right . We live in this post truth era. Its true. When we have a difficulty, when we have now every Media Organization has fact checkers. They make extra effort and all of these resources to go out and say this was wrong. A little bit fact. You have all of these organizations out there. Yet you have people who will say, sorry, thats not what i believe. Thats not what i saw on facebook. Right . Its a shame. It is two complete sides. If you dont dress white and gold or blue and black, were not friends any more. Im a bit more optimistic than shermichael. Thats good. We have had this in our history before. The New York Times did mentioned story after lincoln. We had andrew johnson, who was so fascinating. And he brought in this super nationalism, white supremacy, racism. And New York Times noted at the time there was this distrust of government. So i hope we will now as well. He talks about why he tried to sow so much distrust. And his message he has, you know, i guess adds fuel to the fire if you will. I think some of the issues were seeing because of the degradation of community or family or inherited customs of behavior and norms, things that have been established over time. And i think when you sort of degrade those things, david, it becomes dig. Whats the order, right . Whats the order about which we govern ourselves to the point of tribalism and the lack of distrust . When those things are gone, what is next . My fear that once trump is gone, some folks in the country will want to overcorrect. By overcorrection, you still have, again, 30 who says absolutely not. We need to all come together and sing kumbaya. Was the dress black and blue . Im not going to comment. Breaking news in Rockland County, new york, just up the hudson river in new york city. Five people were stabbed overnight at a hanukkah celebration at a rabbis home. The attacker then fled the scene. Cathy, i gather the governor of new york, governor cuomo, just spoke with reporters. Reporter david, thats absolutely right. We heard from him just minutes ago. We called this a domestic act of terror. He said this is intolerable. This is not just a problem within the new York Community but also nationwide. Obviously he condemned this heinous act. He did a tour of this home. But i want to step back a little bit and give you a couple more details about what we know so far. So this attack happened just before 10 00 last night. And a man who had his face covered, burst through this home behind me. Dozens were inside celebrating the seventh day of hanukkah. The man went on an attack, striking people randomly. One man tried to stop the individual but wasnt able to, unfortunately. And ended up the suspect ended up stabbing five people. Take a listen. He took out his knife from the holder and started hitting people back and forth. They screamed after me, hey you, ill get you. Thats about it. What did he look like . I dont know. Was he big . That big. Big. Huge. We also learned that the suspect actually left this home next door to the synagogue which is yards away from this home. The synagogue was locked so the suspect wasnt able to get inside. Another person in the home, ran out quickly and took down the license plate of the suspects getaway car. Thats why authorities were able to apprehend the individual about two hours after the incident occurred. About 35 miles away from where we are in harlem, new york. Very much an active investigation. Still no more details about the suspect that we can share for you at this hour. Still no motive. But the governor has directed the hate Crimes Task Force to begin the investigation into this. But as you know, david, this comes on the heels of several attacks in the new york city area targeting jewish americans, Hasidic Community. Still unclear what motivated this attack. David . I know you will be covering it throughout the day. We will bring you updates throughout the day. Thank you very much, cathy. And two enter 2009ing stories will define 2020, impeachment and the next election. Still no indication from nancy pelosi when the House Speaker plans to send articles of impeachment to her colleagues in the u. S. Senate. Also an open question, when that trial will begin. Speaker pelosi told her caucus they should view impeachment in moral not political terms. For many lawmakers that is easier said than done. A great piece on the politics of impeachment. While the senates impeachment trial of President Trump is still stuck in limbo, he writes, the looming verdict represents the most consequential vote before next years elections and weighty challenge for those seeking to joan the chamber. Even more complicated for those trying to win the democratic nomination. Annette lopez for business insider. Fellowship is National Correspondent for the washington post. Also with us this morning josh tkpwer stein for politico. Let me start with you. The way politics fuses itself into this process, as i said, we have heardsome emily and prayerfully, the weight of politics is heavy on a lot of folks in the house and the senate. I mean, its a process predicated on politics. While the democrats are trying to argue they should be something more than that, it is inherently political. It up to politicians to determine what is the standard of impeachme it is important to remember that in recent Senate Elections with 2018 being somewhat of an outlier, how states vote on president ial races and senate races. Four people who may be in purpley states theres less of a risk in imposing impeachment because the parties are so strident in how they look at impeachment. Republicans are strong on one side. Independents lean against it. If i were the democrats i would be more worried about the democratic side than the republican side. Simply by virtue of the fact that things are so partisan already and this is such a partisan issue. What are you listening for from that point, lynette . Dug jones talked about impeachment and their willingness to engage wholly with the issue of impeachment as they look ahead to reelection campaign. Im also kind of monitoring what this caucus and what nancy pelosi are saying to the American People. How they are trying to manage how we feel about impeachment and kind of watch polling. It is a political process. It does stay inside the chamber. But i think if inside the Senate People fear the American People are turning against donald trump and more people are for getting him on it of office, then that will change the calculus inside. That is why nancy pelosi is saying, hey, this is a moral process also. She wants the American People to think of it that way. And maybe take a step back from their own partisan views and say, hey, why isnt the white house implying. Maybe we should consider looking at more information. Thats kind of where im thinking about it. Poor doug jones. I pray for him every night. Im not sure he will survive the next election. What about those who dont have to vote . If you look at somebody running for senate now, how is he or she going to get off the hook for this . That is something they will be hammered on. They have the luxury of waiting to see how it goes. I think voters, its not purely a political matter. Its not even purely a legal matter. Public opinion plays a big role. Sure, people are divided along party lines right now. It is a high number of people saying even at this point he should be removed we. Its not the whole country. But some are saying we need to hear witnesses. We need to hear john bolton and mick mulvaney. Other People Democrats will argue that illegally so far refused to testify. The greatest strength or power for any request for a witness to have to testify is in a senate trial. The question for the democrats, and i dont know if they are going to be able to do it, can they focus peoples attention now on whether it is being heard and whether there is a real trial. If nothing else, Public Opinion can shift. No president has been removed by the senate in an impeachment proceeding. I dont think we should expect that this time. But people want to see a real trial. Let me turn to josh to see where we are in where this is being hammered out. Chuck schumer september a letter to Mitch Mcconnell, rejected out of hand. Where do negotiations stand so much as you understand them. Well, my sense is those negotiations are taking place but not between those parties. Not between Chuck Schumer and Mitch Mcconnell. Instead, they are being Mitch Mcconnell and his own office. We had Lisa Murkowski saying she was disturbed by the statement from mcconnell that he was closely coordinating with the white house. There was also a less noticed comment a few days earlier from senator john kennedy, one of the most conservative members from louisiana. Sometimes a bit of idiosyncratic member who will occasionally march to his own drummer saying he wanted both sides to be treated equally, which is not exactly the messaging that Mitch Mcconnell was putting forward. It seems to be within that caucus. Mcconnell will be very eager to have a consensus position. Hes not interested in having a procedural vote where republicans are breaking off and some kind of 51 50 or 50 50 vote on the process to be used for the impeachment trial. Phillip, did you marvel at what murkowski had to say over what jokept i did had to say. They have coalesced behind him. They are mostly in lock step here . She said she is sturbed and not going to be a rubber stamp. This is murkowski. Obviously there are more important considerations. While i am skeptical she will vote for removal, it is very much for her to be cautious. People may remember there have been a number of votes where she has withheld her opinion deliberately because thats who she is. A lot of republicans will walk that line. Thats problematic for Mitch Mcconnell who wants to push things in a particular direction. Going back to Public Opinion, they said there was a quid pro quo. In a press conference he said there was a quid pro quo, and it didnt move the polling numbers. I think Rudy Giuliani and being crazy might move polling numbers. I dont know if you saw the daily beast story how he is writing his report, hes coming back, hes met with the president. The republicans are avoiding him because they dont want to hear this russian propaganda. What if rudy starts going crazy and makes the president look terrible. Thats a wild card here. I have seen him around new york city. Hes not looking great. I wouldnt want him popping off. Well, at times hes considered that. I think many of the president s other advisers think it would be a mistake if only if they view him as a fact witness in this particular situation. Every time there is talk about calling him, whether it was in the house investigation or in the senate trial, the question becomes, well, what would be the parameters of his questioning . Maybe you would give him an audience to air his russian propaganda, ukrainian conspiracy theories. You would be open to question him about all of his interactions with the president. He would say they are Attorney Client privilege. It seems like a can of worms that you can cannot imagine they would be at all interested in opening up that can and seeing what crawls out of it. I cannot imagine sisters would be interested in that sort of spectacle. Talk about the legal team versus what we are seeing pieced together by this president. Pat cipollone doesnt have a host of trial experience. Maybe jay sekulow or Rudy Giuliani. Its important to have good people on this. As you mentioned, this is something that is so novel in our history. It is a big deal. Just getting somebody to represent him as a personal attorney. Well, it is a big deal. Pres. The last time William Rehnquist had the stripes, they all have to sit there even in the short version of a trial. It is still at least two weeks or more. Bill clinton had a bunch very experienced prosecutors and lawye lawyers. For the khrarbgt he had former United States senator from arkansas who gave a real closing statement. It is a jury trial in that sense. People try to touch the emotions. The debate was over how many. At one point the senate went off in a closed caucus of 100 people without the white houses being there to set the rules. Senates role is a real separate and strong constitution. One thing that is at risk here, is the senate going to be part of a partisan rubber stamp or do its thing as an institution. This is Public Opinion. It will be a spectacle the likes of which people havent seen. It is rare that one does. It is not something all of us see. It has its own specific brand of theatrics. Theres been so much conversation about how you make the hearings we have seen in the house. Something that would appeal to the american public. How much is this trial designed for that. Yes, it will be about the senators but a means by which you can shape Public Opinion, more people will be watching that unfold. Obviously this is Something Senate majority leader is made of. He is setting the terms here essentially. Obviously in communication of this caucus. I feel every time im on the show, we end up it is viewed, how it is filtered to the public. Very few americans will sit down and watch wire to wire what a Senate Impeachment trial looks like. Instead they will turn into their famous news, fox news, msnbc or whatever it happens to be. That will show a particular view of things. We saw how that played out over the course of the house hearings. Breaking through is a bigger story than has been the case before. Were playing on the front pages. They said sparks fly at hearing. President s lawyer accuses them its Rudy Giuliani calling. What was that . I am so sorry. If you look at the same front pages, thats not the same media. World war ii headlines break out. It is other allegations of wrongdoing and law breaking by this president. Josh thank you very much for joining us today. Still ahead on up, House Democrats strategy following the impeachment of donald trump. Congressman Gerry Connolly will join us. Im david gura. New videos obtained by the New York Times feature the grim testimony of navy s. E. A. L. S speaking out about their platoon leader eddie he was acquitted of killing a captive isis fighter but was convicted of posing for a photograph with the dead prisoner. His demotion was later reversed by president donald trump. Memories of his platoon describing to investigators as, quote, freaking evil and toxic. One medic, cory scott said, you could tell he was perfectly okay with killing anybody that was moving. We should note scott changed his testimony, testifying that he, not gallagher killed the captive. In a statement gallagher said my first reaction to seeing the videos was surprise and disgust that they would make up blatant lies about me, but i quickly realized that they were scared that the truth would come out of how cowardly they acted on deployment. Nbc news has not spoken with any of the s. E. A. L. S in the taped interviews. Although the times did. All of them declined to comment. Covering the military for the New York Times, he obtained the materials. And phpbsz contributor. Dave, let me start with you and just ask you about this trove of materials. Whats in it and what picture does it paint of eddie gallagher. There is the navys Raw Materials of its criminal investigation. So a majority of the platoon that served under chief gallagher came in, sat down with criminal investigators and essentially told them what they saw. And so this is us looking at them for the first time saying heres what happened while we were in iraq. You hear from eddie gallagher. He claims his fellow team colluded against them. Help us understand the importance of that, what they hat given the sort of code around navy s. E. A. L. S. Within this trove of leaked material that we got was this group text that included half of the platoon and spanned more than a year. They would talk to each other about the case about what they said their chief did. And they never thought that anyone except for themselves would get to see this stuff. It was eventually leaked to some of the attorneys in the case. So this is like an unprecedented way to see the inner workings of this group. And if they were going to collude with each other, that would have been where they did it. But thats not what i saw here. I saw them encouraging each other to say, hey, dont worry what happens. All you need to do is be honest and say what you saw. Thats a big deal. Because in this culture, like in so many military and Law Enforcement communities, coming forward and speaking out reporting on your fellow Service Members is kind of taboo. They felt strongly enough about what they had seen that they were willing to break that and go to people outside the seals and say, hey, a crime has been committed and we need to do something. Let me bring you into the conversation here. Layers of transparency here, different kinds we have seen surrounding this case. What are the longterm ramifications going to be as you have seen them, something that was a closed proceeding before. The president intervene in something that was a closed proceedings, something germane to the navy and how he inserted himself into this process. Well, im hoping that it is a unique case and will not repeat itself. It is complex in terms of the more errors that have been described by the New York Times and that we all now know about and there was prosecutorial misconduct alleged so the case actually was complicated by that. But in addition you had the president s own lawyers involved in defending this man. And now we know that his crimes went way beyond those that he was charged with. And i want to say that in general the jag core general have the highest of standards. In this case one of the prosecutors was removed for what appears to be allegations that he actually interfered with the Attorney Client privilege of the defendant by putting an electronic monitor on their emails and maybe other things as well so that the case gets really complicated by that. In general, the jag corps has the highest ethics. That would never happen. This is unusual. I think the president s role in this is also unusual. It is clearly command influence that should not have happened. His involvement is wrong. And he is punishing whistleblowers and rewarding someone who clearly did something wrong. Even if all that he is convicted of posing is a bad thing. We know he did much more than that. The facts of the trial where you have someone on the stand sort of changing his testimony and saying, no, he didnt do it. I did it. I did it to protect the prisoner from being tortured by the iraqis. So thats why it happened. You can see why he may have been acquitted of murder with that testimony. But other charges perhaps could have and should be brought against him. Demotion reversed by the president of the United States a few days ago. He was invited to maralago. There is speculation he will be campaigning with the president as well in light of what jill said, in light of what is reporting, grievous things alleged to have happened and the president opening his arms, welcoming in a friendly way as we move to 2020. All of this goes back to President Trump wanting to present himself as tough, not beholden to the p. C. Ness as driving the culture. They talked about doing horrible things in war. Burning killing families, terrorism. This story about bullets dipped in pigs blood. Im a tough guy who doesnt abide by the rules. And gallagher was a proxy for him to present that image of himself yet again. Thats why. Donald trump did not sit down its a branding thing. If he puts himself in ex to this guy, the soft baby boy from new york will have done Something Different than spending his daddys money. I talked about this quite a bit with my son who until recently was a captain in the u. S. Army. Especially around the president s involvement. Really drove home to me how seriously people in the military, in the professional military take regular order, following the rules. Its the only way to keep things in line. And the signal that it sends to have this guy at maralago to the people up and down the chain of command about how seriously really are you supposed to take the rules and that sense of right and wrong. He thinks and i think it could be misunderstood in very significant ways. Interestingly, there was a gallup poll that among military personnel is dropping precipitously partly because of how he treated general mattis, and he is not playing straight with what they are doing. Let me ask you lastly about the level intro inspection of navy s. E. A. L. S. Standards have been reduced as well. What changes among that community as a result of what we have seen happen here . You know what, i think it gets lost if you talk about Edward Gallagher. It is easy to focus on one 40yearold s. E. A. L. And what he did. But what gets lost is that there were at least seven who came forward and testified and really put their necks out there and acted i think as we would expect our most elite war fighters to act, with integrity and bravery and they stood up for what was right. I think that is a signal that there is real conflict within the s. E. A. L. S. People support Edward Gallagher and the people who turned him in. It is an open question of, you know, who do you highlight, who do you champion, who do you promote and how do you encourage the culture you want to see in the future. Thank you for the reporting as well. Happy new year. They have already impeached the president. Is there a way of getting it passed by Mitch Mcconnell. My next guest has a prescription. Joining us is Gerry Connolly, a themselves determined in terms member us off of the nature of the case and how they would vote. It makes a mockery of the second oath every senator must take before the impeachment trial. I spoke with john yarmuth who said he was surprised by what house Speaker Pelosi has done here. Hes not behind what she was doing here but it was a surprising move. How surprised are you by it . How long do you think this will last . I dont know that i was surprised. I dont know that i fully anticipated it. In looking at it, it makes sense to me. For two reasons. One, she wants to give space for Chuck Schumer, the democratic leader and Mitch Mcconnell to work out rules of engagement. For a Senate Impeachment trial. That was done in the last impeachment trial with trent lot and tom daschle. And so i think she wants to give them some space to get there. Is this a sham trial . Or are we actually going to have witnesses, are we going to examine testimony, look at depositions and render a fair and impartial verdict . I want to play a clip tpeublgd from cnns state of the union talking about exactly what youre speaking to now. That is the way this trial is going to be conducted, what power the republicans have. Lets listen to a clip of what the senator had to say. Sure. When it comes to impeachment, the rule is there are virtually no substantive rules. Its not a criminal trial. The senate is not really a juror, it is jury and judge. He is the presiding officer. There are no standards of proof. There are no rules of evidence. And every senator, unless we pass a new rule by 51 votes in the senate, is entitled to approach it his own way. Some folks existentialism there. How do you react to that, the role he will have and his colleagues will have in the trial . Well, i think the senator, by pointing out that the constitution with respect to the process and rules regarding a trial, that doesnt mean its not really a trial. That doesnt mean theyre not really jurors, as well as ultimate deciders. And what he fails to mention in that interview is he takes an oath, a second oath. Its the only time when you are a senator you ever take a second oath. That oath is to be an impartial juror. So clearly its a lot more than what i think the senator described. I think hes down playing the gravity and the serious role, each one of those senators must play. And they have to take that seriously. And they have to approach the evidence the house is providing them in voting for the two articles of impeachment with enormous sobriety. And unfortunately people like senator kennedy and some others in the Republicancontrolled Senate seemed to have forgotten that. The last question, the role that you are going to play going forward, this will, we assume, make its way to the senate. Some managers will advance in the u. S. Senate. What about the investigations under way. How much do they proceed in the future . You sit on the oversight reform committee. His work is not done. Way to ittees work is not legislation of a different sort in 2020 or are you full steam ahead on investigations . I hope we are going to still be full steam ahead on investigations. Weve got a lot under way. Were still looking at how the Citizenship Question got added to the census. Some people seem to have misled congress in describing that process. We want to get to the bottom of that. We are looking at security clearances in the white house that were granted to, among others, jared kushner, seemingly over the objections of professionals. How did that happen . And what is the risk of that . Were looking at obviously immigration questions in terms of how children are being treated at the border and being separated from their families even now. So we have a lot of a lot on our plate. We intend to go forward full swing. Gerry connolly, congressman from the 11th district of virginia, thank you very much. Appreciate your time. Happy new year. Thank you. Lets pick up on what the congressman said a few minutes ago. Talking about all of this under pinning material that is of interest. I wonder a lot about Jared Kushners security clearance. Actually its what i wonder about every night before i go to bed. There are a lot of ways to attack the president. Theres always been the debate should this be narrow and broad. It is pretty narrow at this point. Why wouldnt congress busy itself with continuing to look into whats going on in this administration. Its exhausting. Im tired. But thank god its not my job. I just have to talk about it. You heard the nod to what happened in the late 90s there. How much is that worth studying . We were talking about the way William Rehnquist approached this before. The lack of what is in the constitution. What do you take away from what has happened in the past . Its truitt is a small sample size. But the last time in 1998 and what they were prepared to do in 1974 was something pretty formal. And what many people remember is the lead prosecutor in effect, the manager for the house was Lindsey Graham who was a very effective proponent in his view that clinton should be impeached. So, you know, theres no settle of clearly laid out rules. But there is a pretty common sense test. Again, here all these investigations whats been striking is that the Trump Administration has simply refused to cooperate in any way with almost any of them. Its really constitutionally very tough to argue that you cant that you dont have to cooperate with an impeachment investigation. You could see the memos back and forth from aides saying of course if this were an impeachment investigation we have to testify, provide all the documents. Thats in the constitution. So i again go back to the refusal to hear testimony, to allow testimony from people like john tpwopbolton. That is the drum democrats should be banging all the time. Its what the American People like. That was the second article of impeachment. Clearly that was done with the hopes that some republicans would say this is interfering with our power as a body. Lastly, phillip, i asked if the investigations continue. They have to keep doing that in effect because this has to play out, to michaels point, in order for courts to weigh in on all of this. That is exactly right. There are boundless reasons to move forward. One of the fascinating things, this doesnt really answer your questions. I have to say it is fascinating to say these donothing democrats. Yes. If we go back and look, the house did far more. They passed usmca and they said we cant focus that. We have this impeachment. 20 seconds here. The senate is a graveyard. When you talk to them for background for reporting, were here. We dont know how to pass legislation. Its stymied. This used to be the greatest deliberative body in the world. Now its a graveyard. The house voted to reauthorize the Voting Rights act in a very big deal. They have to find a way to make the politics of it not this crazy tone fighting. All right. A stabbing rocks the nuclear Jewish Community. That was Governor Andrew Cuomo calling an act on a Jewish Community an act of terrorism. The suspect is in custody following an overnight manhunt. The stab the latest in a spate of incidents in the last week alone. Governor cuomo is directing the hate Crimes Task Force to investigate. Kathy park, my colleague, is in Rockland County new york with more. The sun has risen. What more is going to happen today . What more do we know about the victims of the attack and the suspect in custody . Reporter david, this is so very much a developing story. Right now we still dont have the exact motive of this attack. And as far as the victims go, we know a total of five people were stabbed. We keep hearing reports of an elder man who was actually stabbed in the head. His wounds were actually more serious. He is being treated for those injuries at this hour. I want to backtrack a little bit and break down how this all unfolded. It happened last night just before 10 00 on sabbath night of hanukkah. Dozens of people were behind me in this home, the home of a rabbi. A man busted through the door and began attacking people randomly with a large knife. In fact, we spoke with one witness who tried to stop the man. Take a listen. He took out his knife from a holder and started hitting people back and forth. When they came out here, he screamed hey you, ill get you. Thats about it. Some what did the guy look like. I dont know. Was he big . That big. That big. Big. Huge. Shortly after the suspect began attacking people in this home, he apparently went next door, ran over to the synagogue and tried to get inside but wasnt able to. He fled in his car. There was someone who actually was able to write down his license plate number. So two hours after the attack, authorities were able to apprehend the suspect who is in custody at this time right now. We still dont have any more details about the individual. But this community, the community of muncy, a large Hasidic Community very much shaken and on edge. They say the spate of antisemitic crimes the last few weeks heightened their fear. This is obviously adding to their concerns. The arrest happening in harlem, north of here where we are at 30 rock feller center. Give us updates throughout the day as you get them. The highest number of mass kills in decades. Whoof whoof so get allstate where good drivers save 40 for avoiding mayhem, like me. Sorry hes a baby this is up. A new database compiled shows there were more Mass Shootings this year than any other year dating back to the 1970s. There were 41 mass killings this year, and of those, 33 were Mass Shootings that claimed 210 lives. One of the years deadliest was in odessa, texas, back in august. Seven were killed. At least 22 injured. Texas resident Shawna Saxton said she looked into the eyes of the odessa shooter and narrowly escaped. She called on congress to act. This awful experience has changed me. Things i once believed to be true have now been brought into question. Do private citizens need access to weapons as deadly as an Assault Rifle . As congress reconvenes, i call on all its members to be men and women of action. Mike, ill start with you. You are a scholar of the Second Amendment and have written a lot on gun policy. We talk about the cycles of all of this. Does it feel like things have changed in light of what shawna is talking about there, in light of what we saw over the course of the last year. There was news there will be federal funding for research into gun violence. Something that was not allowed for a very long time. It was literally barred by congress that you could regulate and study the danger of toasters but not of guns. Actually the congressman, a republican congressman from arkansas, who wrote that provision, has recanted and said this is crazy. Weve got to do something. I do think things are changing, though its a big question. Nobody should think they are changing so much that theres going to be dramatic change without further political change. After the newtown shooting, the background check legislation, bipartisan, didnt fail because the public wasnt for it. 90 of the public was for it. It didnt even fail because most of the senate wasnt for it. It failed because of the filibuster and the use of the filibuster. And its a political stalemate thats preventing action. But i do think when you see Something Like that very wrenching video from that woman, understanding that, you know, high capacity magazines, assault weapons, you dont need to have that to have a meaningful right to bear arms in the country. That you can regulate it. The other question is what the Supreme Court with its new conservative majority on this issue will allow. We had the Supreme Court considering a case. Didnt take up this case that would allow them to weigh in on gun policy, but that is something that seems very much on the horizon. A lot of people waiting for the court to take up a case that zould to do with gun policy. Its a fools errand to try to predict what the Supreme Court is going to do. Its a conservative majority. Who knows. Perhaps theres someone who has a change of heart. I do think its important to note that really what were talking about here is to a large extent the weapons that are being used. Theyd be the first to point out, its a much less Violent Society now than in 1992, 1993, which is a good thing. But why are these mass killings a particular thing and can you target specifically those weapons, can you target in a way that even a conservative on the Supreme Court can say this is an okay change to make to fix this problem . The numbers are ing. I go back to the dayton shooting. And they compiled a list of whats happened over the last year. The website the trace. In half a minute, a gunman fired 41 shots before he was killed by police. We have video of that happen, video of Police Coming in escapg shot herself are startling, so is the video. So is what weve seen over this year. Its shocking, and it just shows you how many can subvert the will of the American People. Thats whats happening here. The nra is completely devoted to the Republican Party. And theyve become a Political Organization with a lot of power in washington. As we were discussing on the break, two weeks ago, the New York Times did this deep dive into infighting in the nra and what the toll that the investigations are taking on the organization. And its leadership seems unrepentant. Wayne lapierre says, i dont know how it got this way, how we got so political. Im just here doing my thing. If youve ever seen Wayne Lapierre foam at the mouth at a political conference then he knows exactly how he got where he is. Its going to take a lot of cleaning up of the corruption in our politics in general to stop the nra. But it is the poster child for what money can do in our system and for what undue political influence, how it can subvert the will of the majority of americans. Weve got 30 seconds left here. To linnets point, what condition is the nra in, in light of the reporting from the new yorker, from the trace. Theres been a lot of double dealing. And it has great weakness if you look at Something Like the elections in virginia where very strong progun regulation candidates won. But it still has a lot of power. Its entwined with the Republican Party. And as long as politicians fear that they can lose elections because of the nra, it will seem much bigger than it really is.
