A judge in Cleveland has overturned a federal order that's stopping evictions for scores of tenants across northern Ohio. Federal Judge J. Philip Calabrese with the Northern District Court of Ohio ruled Wednesday that "the Centers for Disease Control and Prevention exceeded the scope of its authority" is issuing an eviction ban for tenants who have been financially harmed by the pandemic and have fallen behind on rent, despite seeking emergency government assistance. The Akron Municipal Court, within the legal jurisdiction of the Ohio Northern District, is ready to follow the judge's decision and allow landlords with cases dismissed under the CDC moratorium to refile those evictions without paying the fee again, so long as the eviction is against the same tenant at the same property.
