The mud is starting to dry up. Organizers have said the exodus can get under way. Well start to see several thousands of people try to make their way out of burning man. Block rock city, where we are, during the entrance to burning man. Even with good weather it can take several hours to get from block rock city to the entrance, the closest paved road. This is not even dealing with the mud situation we have here. One official told me that while some areas in camp have dried up, there are other areas that still are very wet and muddy. So it is still a concern, but organizers have been trying to do the best they can to help people out. Theyve had cell phone and wifi Portable Stations set up for people. Theyve had rangers going from campsite to campsite to give information. They even had a wet playa security guy telling people how to cope and deal with this unprecedented shelterinplace. Overall people are taking it in stride, saying this is a burning man experience and theyre prepared to deal with it. Liz kreutz, nbc news. This Press Conference got up and going in the manhunt for this convicted murderer in westchester, pennsylvania. Were asking residents to check on their neighbors. As i said, were actively searching that area. Were certainly not trying to lock anyone down. We want to keep residents as safe as possible while we thoroughly search that area. Can you elaborate on what basis the credible sighting one was the Video Sighting that i believe youve all seen. The others are not video. But after extensive interviews, we believe them to be credible sightings. Any reason to believe hes being assisted by anyone . I wouldnt want to comment you have been listening to a Press Conference out of westchester, pennsylvania, one of the officers helping to lead the investigation into capturing Danelo Cavalcante who escaped prison on thursday morning around 8 50 in the morning. He talked about the fact that they now have the aid of his own mother who is broadcasting a message in portuguese to encourage danelo to surrender. There have been multiple sightings of this individual in the area in which they have described. The officer also talking about the fact that theyre bringing in more aid along with more technology to help him apprehend them. Some of the sightings have been Video Sightings along with one siting by a trooper as well who pursued chase but was unable to apprehend the individual. This is Danelo Cavalcante, 34 years of age, a convicted murderer who escaped the Chester County prison at 8 50 a. M. On thursday morning. So donald trump is calling on supporters to help him fight potential litigation over the 14th Amendment. The previously littleknown provision that a growing number of Election Officials are looking into, while a growing number of democrats say it should disqualify trump from seeking reelection. In my view, the attack on the capitol was designed for a particular purpose at a particular moment, and that was to disrupt the peaceful transfer of power as is laid out in the constitution. I think theres a powerful argument to be made. It. It doesnt require youve been convicted of insurrection. It just requires that you have engaged in these acts. Its a disqualification from Holding Office again. And it fits donald trump to a t. Lets be gain, carol lam, and harry litman, former Deputy Assistant attorney general and host of the talking feds podcast. Harry, start things off with us if you would. I want to read the portion of the 14th Amendment that would apply. No person shall hold any office who having previously taken an oath to support the constitution of the United States shall have engaged in insurrection or rebellion against the same or given aid or comfort to the enemies thereof. Does this argument, the 14th Amendment could be applied to the former president of the United States in running for reelection, if, in fact, he wins, does it have any legs here . Look, it could, right . Its right there in the constitution. There are very few qualifications in the constitution. You can analogize it to being 34 when you have to be 35. The rub is going to be who gets to decide, what social or Political Institution makes the authoritative call. Adam schiff says it fits donald trump to a t. It feels to me it fits donald trump to a t. , but others will disagree. I think some secretaries of state will legitimately say were not putting him on the ballot. Then it will go and quickly to the Supreme Court. Will the Supreme Court make a decision, or will it say, man, its not to us to make the factual determination if he engaged in insurrection. Thats going to be the puzzle. In the past congressman has applied it. Can the court . What actually needs to say authoritatively, yep, he engaged in insurrection, therefore, hes out. Theres got to be something. Its as yet a bit of an unsolved puzzle. Im glad you said it that way. Carol, if you will, pick up on that. It seems somewhat subjective. If were looking at the charges, specifically the ones that apply. Im talking about d. C. , the jack smith case out of d. C. , along with fani willis case out of fulton county, none of those charges are inciting an insurrection or rebellion. This seems more subjective than it does if were referring to the charges that have been leveled across the former president , especially if it makes its way up to the Supreme Court. Youve hit the nail on the head. To put it in legal terms, that subjectivity, you have to ask yourself what standard is going to apply . The criminal standard, of course, as we all know, is beyond a reasonable doubt. In our system that has to be found by 12 jurors unanimously. That doesnt seem to be the standard for the grand jurors to have returned the indictment. Thats a probable cause standard. Is that the standard were talking about . Then you can say, as you pointed out rightly, that insurrection and incitement werent charges in the indictments, but they were described in the conspiracy, the january 6th events were described in jack smiths indictment as part of this conspiracy to have donald trump elected or declared the victor in the 2020 election. So there are all those questions out there. But, on the other hand, these who, what, where, when, how questions are not an certain by the constitution either. The constitution says what you just read. As so many provisions in the constitution, its a little light on the specifics and how you decide what those specifics are. This is, however, no longer just a debate among academics and law professors. This is taking on some real legs here. Harry, if we look at the way these trials are playing out, the likelihood of jack smiths d. C. Trial going first is pretty high it seems right now. If that were, in fact, to go forward, and lets say hypothetically he were to be found guilty, would that create a stronger case then under the 14th Amendment . It really shouldnt. Here is where schiff is right. It is a provision thats out there that some determination has to be made whether he committed insurrection and 12 persons in one trial, maybe. As you say, it doesnt even charge it. It really is beside the point. He either has or hasnt at this point. I think insurrection would be the relevant charge. Did he try basically or aid the overthrow by power, the peaceful transition . A court case helps. A Secretary Of State determination helps. Theres this ultimate question of who decides. And i dont think those what about obstruction of an official proceeding. Does that not apply . Thats right. It doesnt apply. Its got to be insurrection. A heavy charge but one that i think is justified by the facts. Lets say you had somebody 35 or not, and you had near conclusive evidence, who would make the final call . It looks pretty good, but we cant say for sure. Somebody has to. Its an important constitutional provision. A, were not sure who, and b, i have my doubts as to whether the Supreme Court will jump to take over that task. Carol, let me quickly play you this sound, the Michigan Attorney general jocelyn benson. Lets listen. We already have some active legal cases pursuing the question of who has the authority directing me not to allow anyone on the pallet who the constitution may disqualify. The final arbiter, while the secretaries of state in various states may make an initial statement either for qualification or against qualification or within the balance of our authority, the ultimate decider in this case is going to be the courts, and really the ultimate court to resolve this will be the United StatesSupreme Court. Harry doesnt seem to think the Supreme Court is really going to take this up. Carol, what do you think . The stakes are so high, if it gets up to the Supreme Court, they can take the case or decide not to take the case. They have discretion about whether to take the case or not. Imagine if they dont take the case. Then whoever has prevailed up to that point, that status quo remains there, and you have the possibility then of disparate views among the secretaries of state throughout the country, the state secretaries of state as to whether insurrection actually occurred here. What a mess that is, right . This is a constitutional provision. This is a United States constitutional provision. So the one thing we know is that theres an absolute lack of clarity here. If it does get up in front of the Supreme Court, i think theyre going to be called upon to take it. Its very, very hard to say what will happen there. Carol lam, thank you. I dont think the court will take the case. I think the court may say after it takes the case, we cant say its for the political branches. Thank you for the clarity. This as a new Wall Street Journal poll showing donald trump dominating with 59 of the vote. Joining me is nbcs dasha burns, Eliza Collins and ashley oates. Dasha, start things off for us, if you will, and what youre hearing from New Hampshire voters today. Reporter as much as labor day in newspaper is about High School Marching bands and picnics, its also about politics and about these primary candidates and the importance of New Hampshire in winnowing the field. Not surprisingly, seeing the polls weve seen, a huge trump contingent in this labor day parade. You have Vivek Ramaswamy on the ground in milford and also Vice President mike pence currently speaking in concord, New Hampshire. You have will hurd and Asa Hutchinson on the ground. What were hearing from voters is kind of, hey, the folks here in New Hampshire, theyre often independent. They take their role in winnowing the field really seriously. And there are those that are staunch supporters of the former president but also voters we talked to that are very much open. One thing theyre frustrated with, youve got trump signs here, but you dont have the former president here. This is a state where politics really matter. There are people shaking hands with vivek, with pence, all the folks that have been coming through to the state to meet with voters. Thats really important to people. Folks ive been talking to, even some who have voted for the former president twice and are considering voting for him again, they are frustrated they havent seen as much of him. Dasha burns, appreciate you, thank you. Eliza, lets dig into this. Lets talk about the polling out of the Wall Street Journal, pretty stunning stuff, the 46 lead over ron desantis, the florida governor. What do you make of it . Is there anything any of these candidates can do that were seeing on our screen right now to overcome this huge lead that he has . I think the real problem for the other candidates right now is that trumps lead is larger than all of them combined. Thats where theres really issues. We saw in 2020, there was a lot of concern from the more moderate wing of the democratic party. A bunch of them dropped out, endorsed now President Biden to try to push senator Bernie Sanders out, and it worked. He was unable to secure the nomination. That looks unlikely at this point. First of all, because the peeled is very crowded, although we do have time. Even if they all dropped out and got behind somebody, it would be very difficult to overcome trump. There are early states that are important, the first states to vote, iowa, New Hampshire, south carolina. But trump has a very significant lead in those states as well. The pattern we saw in our poll also translates to the early states. Ashley, i thought it was interesting, 60 of Republican Voters believe the multiple indictments against trump are politically motivated. If youre the other candidates, what do you do with that number, or are they doing it by, lets say in the case of ron desantis not really speaking out against the former president . I think thats their strategy here. They realize they need his supporters in order to have any shot at winning. Youre seeing candidates spend time in New Hampshire, my former home state, because of the fact that they know in order to beat him as the nominee, they would need to beat him or stop him in New Hampshire or iowa. Right now the real truth, and you just pointed to it. Hes facing 91 felony charges. His numbers are going up in polling, not going down. The other candidates recognize this. They can only hope to be a number two at this point which is what many of the voters in New Hampshire are saying. They like ramaswamy, but hes number two. Honestly they like him for trump which is fascinating. You see a lot of candidates vying for the Vice President ial slot. If they were, youd see a lot of other candidates out there rather than the three that are there. I want to play sound of former Vice President mike pence speaking out against ramaswamy and have you weigh in. I dont have a problem with vivek, hes a good man, a good family man but just wrong on Foreign Policy. This is a pattern for vivek, he goes One Direction and goes back another direction. I dont know how we fully back and then say theres a limit to what our Military Involvement would be defending israel in an attack by iran. Lets bring up the Polling Numbers of all these candidates once again. I think its interesting to campaign that to what is happening on the campaign trail. Ramaswamy at 5 , pence at 2 . Desantis at 13 and 8 for nikki haley. Theyre going after him instead of the frontrunner, eliza. Why do you think that is . Its really fascinating. We started to see this at the debate. Ron desantis who is still number two, was expected to take a lot of arrows at the debate, and he didnt. Ramaswamy did. Im not quite sure what the strategy is other than he differs on Foreign Policy more with most of the field. I dont understand the strategy, but pence isnt the only one. Were seeing nikki haley very critical against vivek as well. Its a fascinating move. They have to move up quite significantly. Then looking at this headtohead matchup in a general between President Joe Biden and former President Donald Trump. Theyre in a dead heat. If you think about the decision that former President Donald Trump made in not appearing on this debate stage. Much of his team said, theres nothing to benefit him in doing that. You wonder if that trend is going to continue considering where he is even in a headtohead matchup with the current president of the United States. I think were in completely uncharted territory right now. Theres a world where the former president and the current president dont debate at all. They could have several debates. We just dont know. The former president thinks that he won the 2020 election. So really i have no idea what a General Election would look like. At this point, going off of polling, we can expect it to be Biden Versus Trump again. Ashley, republican governor chris sununu from New Hampshire was on Meet The Press on sunday. Chuck todd asked him what concerns you most over the next four years, four more years of President Biden or four more years of donald trump. Lets listen to what he had to say. With biden and trump youre looking backwards and relate gaiting drama. Nobody wants that. Everybody wants government and institutions we can trust. We have amazing institutions in this country but theres a lack of trust there. Do you think theres an overall dread of a rematch either way . I think a lot of the voters are tired of both candidates, quite frankly. But at the same time we know what a Trump Presidency looks like, and its not good for democracy. Thats why were seeing the Biden Administration focusing more on bidenomics and more on the differences between him and a Trump Presidency because he knows his record is stronger for the american people, stronger for the middle class. Honestly, when it comes to trumps jobs record, it wasnt great for americans. Biden is great about talking about the economy. I think the more he continues to do that and contrast himself with trump, thats going to play well with the American Public because the American Public realized under President Biden its much better for democracy than it would be with a Trump Presidency. Well, recently obviously its become a bargaining political chip for both sides of the aisle quite frankly. This year, were seeing a group of house conservatives, so a quote unquote, fiscal conservatives, who are pressuring mccarthy to backtrack on that deal he made with President Biden at the end of may to avoid a default, the first default in the nations history. Now the conservatives have a chip on their shoulder with mccarthy. They feel like he didnt fight hard enough, the Spending Level should be lower than agreed to, and theyre willing to shut the government down over it. Dont take my word for it. Anecdotally, i heard from House Freedom caucus members who said their phones have been ringing. Constituents want them to hold strong on this. The problem for mccarthy is he doesnt have the votes to get there. Were looking potentially at a shortterm funding deal, not sure how long thats going to go yet. Its certainly clear that conservatives are ready to shut down the government if they dont get what they want, and mccarthy has another battle on his hands.
