We start this hour, though, with the latest situation on the ground at burning man where more than 70,000 people are stranded after torrential rains turn roads and grounds into muck. The mud is starting to dry up. Organizers have said the exodus can get under way. Well start to see several thousands of people try to make their way out of burning man. Block rock city, where we are, during the entrance to burning man. Even with good weather it can take several hours to get from block rock city to the entrance, the closest paved road. This is not even dealing with the mud situation we have here. One official told me that while some areas in camp have dried up, there are other areas that still are very wet and muddy. So it is still a concern, but organizers have been trying to do the best they can to help people out. Theyve had cell phone and wifi Portable Stations set up for people. Theyve had rangers going from campsite to campsite to give information. They even had a wet playa security guy telling people how to cope and deal with this unprecedented shelterinplace. Overall people are taking it in stride, saying this is a burning man experience and theyre prepared to deal with it. Liz kreutz, nbc news. He talked about the fact that they now have the aid of his own mother who is broadcasting a message in portuguese to encourage danelo to surrender. There have been multiple sightings of this individual in the area in which they have described. The officer also talking about the fact that theyre bringing in more aid along with more technology to help him apprehend them. Some of the sightings have been Video Sightings along with one siting by a trooper as well who pursued chase but was unable to apprehend the individual. This is Danelo Cavalcante, 34 years of age, a convicted murderer who escaped the Chester County prison at 8 50 a. M. On thursday morning. The previously littleknown provision that a growing number of Election Officials are looking into, while a growing number of democrats say it should disqualify trump from seeking reelection. In my view, the attack on the capitol was designed for a particular purpose at a particular moment, and that was to disrupt the peaceful transfer of power as is laid out in the constitution. I think theres a powerful argument to be made. It. It doesnt require youve been convicted of insurrection. It just requires that you have engaged in these acts. Its a disqualification from Holding Office again. And it fits donald trump to a t. I want to read the portion of the 14th Amendment that would apply. No person shall hold any office who having previously taken an oath to support the constitution of the United States shall have engaged in insurrection or rebellion against the same or given aid or comfort to the enemies thereof. Does this argument, the 14th Amendment could be applied to the former president of the United States in running for reelection, if, in fact, he wins, does it have any legs here . Look, it could, right . Its right there in the constitution. There are very few qualifications in the constitution. You can analogize it to being 34 when you have to be 35. The rub is going to be who gets to decide, what social or Political Institution makes the authoritative call. Adam schiff says it fits donald trump to a t. It feels to me it fits donald trump to a t. , but others will disagree. I think some secretaries of state will legitimately say were not putting him on the ballot. Then it will go and quickly to the Supreme Court. Will the Supreme Court make a decision, or will it say, man, its not to us to make the factual determination if he engaged in insurrection. Thats going to be the puzzle. In the past congressman has applied it. Can the court . What actually needs to say authoritatively, yep, he engaged in insurrection, therefore, hes out. Theres got to be something. Its as yet a bit of an unsolved puzzle. Im glad you said it that way. Carol, if you will, pick up on that. It seems somewhat subjective. If were looking at the charges, specifically the ones that apply. Im talking about d. C. , the jack smith case out of d. C. , along with fani willis case out of fulton county, none of those charges are inciting an insurrection or rebellion. This seems more subjective than it does if were referring to the charges that have been leveled across the former president , especially if it makes its way up to the Supreme Court. Youve hit the nail on the head. To put it in legal terms, that subjectivity, you have to ask yourself what standard is going to apply . The criminal standard, of course, as we all know, is beyond a reasonable doubt. In our system that has to be found by 12 jurors unanimously. That doesnt seem to be the standard for the grand jurors to have returned the indictment. Thats a probable cause standard. Is that the standard were talking about . Then you can say, as you pointed out rightly, that insurrection and incitement werent charges in the indictments, but they were described in the conspiracy, the january 6th events were described in jack smiths indictment as part of this conspiracy to have donald trump elected or declared the victor in the 2020 election. So there are all those questions out there. But, on the other hand, these who, what, where, when, how questions are not an certain by the constitution either.
