The consistent basic philosophy of the Founders was that government must be as close to the people as possible and therefore all powers of government are limited to states with the exception of specifically enumerated powers. “The times, places, and manner of holding elections . . . shall be prescribed in each state by the legislature.” The Constitution, “authorizes the national legislature to regulate in the last resort,” as Hamilton stated in Federalist No. 59. The last resort is defined as collusionary action by state legislatures to interfere with the federal government. Federalist No. 60 defines other potential issues but judges the possibilities as insignificant.
