why are you interviewing witnesses without republicans in the room? and they have had equal time to question it. why not have this open to the public? why not have this open to the republicans? >> having prosecuted a lot of cases myself, i know when the defense doesn't have the facts or the law, they attack the process. in this case that's what republicans have. if they don't have the facts on their side or the law on their side and their process arguments are quite silly. more than an investigation stage of this, you would never interview a witness in front of a tv camera in public. that would be crazy. what you do is you do these witness interviews behind closed doors. if there's enough to go forward, you make it public. there's enough to go forward. we're going to make this all public likely in november. >> likely in november. sources telling cnn the justice department will review is now itself a criminal investigation. what do you make of this? >> special counsel mueller
