our gadi swartz is following this investigation. >> reporter: tonight, authorities asking new questions in a tragedy off the coast of california was every crew member awake when fire first broke out on the diving vessel "conception" befor five crew members were forced to abandon ship and unable to save 34 people sleeping below deck >> there was a roving watch required for that vessel. >> reporter: but was that roving watchman asleep at the time the fire started >> i'm not at liberty to discuss any of that right now. >> reporter: the probe into what caused the fire is still ongoing, but investigators say the 33 passengers and 1 crew member in the bunk room likely died from smoke inhalation prior to being burned. >> i still don't want to believe it. i still want the wake up from this bad dream. >> reporter: the next of kin for all 34 passengers have now been notified according to the sheriff. meanwhile the owners of "the conception" have filed a preemptive lawsuit to head off litigation of victims' families, a legal maneuver common in maritime law used since 1851 the boat's owner
